Notice on Issues about Handling Work Permits for Foreign Graduates Working In Shanghai (HRSG [2017) No.25)

To relevant entities:

In order to implement the strategic deployment on accelerating the construction of the science and technology innovation center with global influence in Shanghai, support international students to innovate and start business directly in Shanghai after graduating from colleges and universities in China, attract intellectual resources of outstanding foreign college graduates in China and facilitate the work of foreign college graduates in Shanghai, according to Opinions on Further Deepening the Reform of the Talent Development System and Mechanism and Accelerating the Construction of the Science and Technology Innovation Center with Global Influence (HWF [2016] No.19), Notice of the Ministry of Human Resources and Social Security, the Ministry of Foreign Affairs and the Ministry of Education on Relevant Matters Concerning Allowing Excellent Foreign College Graduates to Obtain Employment in China (RSBF [2017] No.3) and Notice of the State Administration of Foreign Experts Affairs, the Ministry of Human Resources and Social Security, the Ministry of Foreign Affairs, and the Ministry of Public Security on Comprehensively Implementing the Work Permit System for Foreigners in China (WZF [2017] No.40), the relevant matters are notified as follows:

 

I. Scope

The foreign graduates referred to in this notice are categorized into international students, foreign graduates from any of overseas universities and foreign post-doctors, specifically:

 

(I) International students

1. International students from any of the universities in Shanghai with a bachelor or above degree who intend to work in Free Trade Zone or Zhangjiang National Innovation Demonstration Zone.

2. Outstanding international students from any of universities in China (not in Shanghai) with a master or above degree who intend to work in Shanghai.

 

(II) Foreign graduates from any of overseas universities

1. Outstanding foreign graduates from any of world-known foreign universities with a bachelor or above degree, intending to be employed by the headquarters of multinational corporations or investment companies or foreign-funded R&D centers in Free Trade Zone or Zhangjiang National Innovation Demonstration Zone.

2. Outstanding foreign graduates from any of world-known universities with a master or above degree, intending to work in Shanghai.

 

(III) Foreign post-doctors

Foreign talents under the age of 40 who are engaged in post-doctoral research at high-level universities abroad or universities in China.

 

II. Approval Conditions

(I) The applicant should reach the age of 18 in good health status.

 

(II) Having obtained corresponding academic qualification, degree and professional skills for work.

 

(III) Having no bad behavior records at school.

 

(IV)  No criminal record.

 

(V) Having graduated within one year.

 

(VI) Having a specific clearly-defined employer in normal operation and conduction of activities by law within the administration of Shanghai. The employer shall offer a job that fits in with his/her major. The salary shall be no lower than the average of local urban employees.

 

(VII) Having valid passports or any other equivalent international travel certificates.

 

(VIII) Other conditions stipulated by laws and regulations.

 

III. Procedure

When employing qualified foreign graduates, the employers shall apply to the Shanghai Municipal Administration of Foreign Experts Affairs or the competent authority of foreign talents of the district government authorized by it in accordance with the law and provide the following materials:

 

(I) Its valid business license or any other legally registered certificate and organization code certificate. Besides, foreign-invested enterprises also need to provide the approval certificate or record-keeping certification. Furthermore, when employers that are the headquarters of multinational corporations or investment companies or foreign-funded R&D centers registered in Free Trade Zone or Zhangjiang National Innovation Demonstration Zone employ foreign graduates from world famous universities to work in Shanghai, they shall also provide the certificate of headquarters of multinational corporations, the certificate of foreign-funded R&D centers and the certificate of investment companies recognized by the Shanghai Municipal Commission of Commerce.

 

(II) Employment Intention Letter (the employer, content of work, working hours, intended salary, etc. shall be specified and both parties shall sign on it).

 

(III) Employment Reason Report (the official seal of the employer is required).

 

(IV) Complete CV in Chinese that include education background and internship or work experience (the official seal of the employer is required).

 

(V) The highest degree (academic qualification) certificate (original and copy) and certification documents: If the highest degree (academic qualification) is issued by a foreign university, it shall be certified by a Chinese embassy or consulate in the related country, that country’s embassy or consulate in China, or a Chinese academic certification institution. In particular, foreign graduates from any of overseas universities shall graduate from overseas high-level universities based on the list of overseas high-level universities published by the Service System for Foreigners Working in China of the State Bureau of Foreign Experts Affairs.

 

(VI) Certificate of no criminal records (foreign post-doctors who have no criminal records can provide personal commitments).

 

(VII) International students with a bachelor or above degree from universities in Shanghai working in Free Trade Zone or Zhangjiang National Innovation Demonstration Zone shall provide a work certificate (original) issued by the Management Committee of China (Shanghai) Pilot Free Trade Zone or Zhangjiang National Innovation Demonstration Zone.

 

(VIII) Foreign graduates valid passport or resident permit for an international student (original and copy).

 

(IX) Certificate of physical examination of foreign graduate: a certificate of verification on physical examination record for foreigners or a certificate of health examination issued by Chinas inspection and quarantine authority, or a medical certificate issued by an overseas health medical institution approved by Chinas inspection and quarantine authority, issued within 6 months.

 

(X) Bareheaded and full-face photo of the foreign graduate taken within the last six months: electronic photo, white background, frameless, centered headshot accounting for about 2/3 of the photo and clean.

 

(XI) Certificate of no bad behavior at school of foreign graduates (foreign graduates from any of overseas universities may be exempted from provision). Besides, international students with a master or above degree obtained from any of the universities in China and foreign graduates from any of overseas universities shall also submit an academic performance certificate and the academic performance must be excellent, with an average score of no less than 80 (hundred-mark system or equivalent) or above B+/B (grading system).

 

(XII) Other certification materials deemed necessary by the issuing authority.

 

Shanghai Municipal Administration of Foreign Experts Affairs or the competent administrative department for foreign talents of the district government as authorized by Shanghai Municipal Administration of Foreign Experts Affairs in accordance with law shall approve the application according to regulations. Issue work permits for foreigners (category C) to eligible international students, and international students who have obtained work permits for foreigners should go to the public security department to complete residence permit conversion procedures; issue work permits for foreigners to eligible foreign graduates from any of overseas universities, and foreign graduates from any of overseas universities who have obtained work permits for foreigners should apply for the Z visa and apply for the work permit for foreigners (category C) after entering China and should go to the public security department to apply for a corresponding residence permit; and issue work permits for foreigners (category A)to eligible foreign post-doctors.

 

IV. Other Matters

(I) The validity period of foreign graduates working in Shanghai for the first time is one year. Upon expiration of the term of employment, if the employer intends to continue employment, the examination and approval procedures must be handled as required, and the term shall not exceed five years. If the individual income tax paid by foreign graduates is lower than that payable for the intended salary or the salary offered by the employer is lower than the prescribed standard, the Work Permit for Foreigners shall not be extended.

(II) The quota management shall apply to the employment of foreign graduates in Shanghai.

(III) This notice will be implemented from July 1, 2017 and valid until June 30, 2020.
