Chapter I General Provisions

Article 1

With a view to fulfilling the scientific outlook on development in an all-round way, promoting the rapid and healthy development of advanced manufacturing industry and modern service industry, guiding and encouraging organizations of all professions and trades to enhance the quality administration, improving and raising the quality level of products and services of this Municipality, pursuing and realizing excellent operation performance, cultivating a batch of brands and organizations with international competitive edge, expediting the construction of Shanghai as“four centers”, realizing the goal of“taking the lead in four aspects”and raising the international competitive edge of the city in an all-round way, these Procedures are formulated in accordance with the“Law of the People’s Republic of China on Product Quality”, the“Outlines for Quality Promotion”, and the“Notice on Enhancing the Work on Product Quality and Food Safety”promulgated by the State Council.

Article 2

The Shanghai Mayor Quality Award mentioned in these Procedures (hereinafter referred to as the mayor quality award) is the highest quality award established by the Municipal People’s Government. The mayor quality award has two types, one for organizations and the other for individual persons.

Article 3

The judgment of the mayor quality award shall follow the scientific, open and fair principle, to urge various kinds of organizations to exercise excellent performance management, and encourage people in all walks of life to make outstanding contributions to this Municipality’s quality work, so as to raise the core competitive capability of organizations and the international competitive edge of the city and push forward the continued, coordinated and healthy development of Shanghai’s national economy.

Article 4

The mayor quality award shall be judged every year in accordance with the quality work of this Municipality. The judgment shall be carried out strictly in accordance with the standards and procedures by recommendation of relevant departments or organizations on the basis of voluntary application made by organizations or individual persons.

The organizations and individual persons that obtain the mayor quality award shall not exceed two in number respectively every year in principle.

Article 5

No fee shall be charged to organizations or individual persons for judgment of the mayor quality award and outlays for the award and work shall be covered in the municipal financial budget of the same year.

Chapter II Recipients of the Award

Article 6

The mayor quality award shall be mainly conferred to various kinds of organizations that exercise quality management and have obtained excellent operational performance, and to individual persons who have made outstanding contributions to the quality promotion career.

Organizations mentioned in these Procedures mean enterprises, mass organizations and other organizations in this Municipality; and individual persons mentioned in these Procedures mean natural persons engaged in quality work, including employees of organizations and personnel engaged in teaching, scientific research and management of quality.

Chapter III Organization and Leadership

Article 7

Under the leadership of the Municipal People’s Government, the municipal quality and technical supervision bureau shall be responsible for the judgment organizing work of the mayor quality award, and its major duties are: taking charge of the formulation of working principles for judgment of the mayor quality award; drawing up the“Evaluation Standards for Shanghai Mayor Quality Award”, the“Detailed Rules of Judgment Procedures for Shanghai Mayor Quality Award”, and the“Implementation Rules on the Management of Judge Panel of Shanghai Mayor Quality Award”; training, appraising and appointing judges of the mayor quality award; assigning judgment observers; organizing relevant departments to examine, approve and put forward the list of organizations and individual persons recommended for the award.

Article 8

A judge of the mayor quality award shall meet the following conditions:

1. being able to carry out conscientiously the Party’s general and specific policies, familiar with the state laws, rules and regulations concerning quality and economic work;

2. having over five years of experience on quality management and professional work with abundant practical experience on quality management;

3. having received systematic training on knowledge relating to quality management, possessing new knowledge and methods of quality management, and acquiring relevant knowledge on operation management;

4. knowing well the evaluation methods and skills of the“Evaluation Standards of Shanghai Mayor Quality Award”, having sharp observation power, precise and quick response capability, and having comprehensive analysis capability and independent judgment and communication capability; and

5. having good professional ethics and being able to conscientiously perform the judge’s duty, strictly observe discipline in judgment and make just and impartial judgment.

Article 9

The municipal quality and technical supervision bureau shall organize the training on judges of the mayor quality award. After examination, the judge who meets the conditions provided in Article 8 shall be given a certificate.

Article 10

The competent administrative departments of all trades, trade associations of this Municipality and the municipal, district/county quality and technical supervision bureaus shall be responsible for the cultivation and recommendation of organizations or individual persons in the corresponding trade or jurisdiction for the mayor quality award and responsible for the work of giving publicity to the organizations and individual persons that have obtained the mayor quality award.

Chapter IV Application Conditions

Article 11

An organization that applies for the mayor quality award shall simultaneously meet the following conditions:

1. having more than five years of registration term and normal operation in this Municipality;

2. having an effectively operated quality management system or other management system of relevant industries established and having a self-improvement quality improving mechanism formed;

3. having excellent operation performance, leading in major economic and technical indexes and quality level in the last three years in our country or in the same trade;

4. having a good credit record and social reputation; and

5. having no heavy accidents concerning quality, safety, equipment, casualties, fire, explosion, environment pollution or public health in the last three years, and having no major complaints made by users (customers) with blame ascribed to the organization, and having no law or regulation-breaking acts.

Article 12

An individual person who applies for the mayor quality award shall simultaneously meet the following conditions:

1. having more than 10 years of quality work experience;

2. having the good consciousness of quality and strong ability of innovation, and enjoying a high social reputation;

3. having highly effective research achievements on quality management theory or abundant practical experience, and having made outstanding contributions to quality improvement;

4. scrupulously abiding by professional ethics and social morals; and

5 no heavy accidents concerning quality, safety, equipment, casualties, fire, explosion, environment pollution or public health have occurred in the last three years in the organization that the individual person is affiliated with.

Chapter V Evaluation Standards

Article 13

The evaluation standards of the mayor quality award shall adopt the“Evaluation Standards for Shanghai Mayor Quality Award”.

Article 14

The evaluation standards of the mayor quality award may be properly amended in accordance with the development of the theory and practice of quality management.

Chapter VI Evaluation Procedures

Article 15

The evaluation procedures for the mayor quality award mainly include:

1. Application. Every organization and individual person that meets the application conditions of the mayor quality award shall, on a voluntary basis, fill in the“Application Form for Shanghai Mayor Quality Award”, and make self-evaluation and explication on its or his/her quality work performance in accordance with the“Evaluation Standards of Shanghai Mayor Quality Award”and the requirements for filling-in the form.

The“Application Form for Shanghai Mayor Quality Award”and necessary testimonial materials, on which the municipal competent administrative department, or the district/county quality and technical supervision bureau or the trade competent administrative department has written recommendation comments with signature, shall be submitted to the municipal quality and technical supervision bureau.

2. Examination on qualification. The municipal quality and technical supervision bureau shall carry out examination on basic conditions, recommendation comments and application materials of the organizations and individual persons that make application. The applicants that pass the qualification examination shall have their applications officially handled.

3. Evaluation on materials. The municipal quality and technical supervision bureau shall organize the judges to carry out evaluation on materials of the organizations and individual persons who pass the examination, and, based on the evaluation results, to determine the list of the organizations and individual persons for on-the-spot judgment.

The municipal quality and technical supervision bureau shall feed back the evaluation results to those organizations or individual persons who fail to get the opportunity of on-the-spot judgment.

4. On-the-spot judgment. The municipal quality and technical supervision bureau shall, based on the decided on-the-spot judgment list, set up a judge panel to carry out on-the-spot judgment and the judge panel shall put forward the on-the-spot judgment report.

5. Comprehensive appraisal. The municipal quality and technical supervision bureau shall put forward the candidate list of organizations and individual persons for the award after carrying out comprehensive appraisal on the judgment.

6. Announcement of examination and approval. The municipal quality and technical supervision bureau shall organize relevant departments and experts to form the examination and approval group of the mayor quality award to hear the judgment report, approve the candidate list of organizations and individual persons for award, and make public the list through mass media. The municipal quality and technical supervision bureau shall synthesize various opinions and put forward the recommendation list of the organizations and individual persons for the award, and report to the Municipal People’s Government for approval.

7. Announcement after approval. The list of the award-winning organizations and individual persons approved by the Municipal People’s Government shall be made public through mass media.

Chapter VII Commendation and Award

Article 16

The Municipal People’s Government shall commend and reward the organizations and individual persons who obtain the mayor quality award, and confer a medal, a certificate and a prize to every award-winning organization and individual person.

Chapter VIII Administration and Supervision

Article 17

The award-winning organizations and individual persons shall perform the obligation of making public and spreading their advanced experience and methods. The municipal quality and technical supervision bureau shall, jointly with relevant municipal competent administrative departments and all trade associations, disseminate and popularize the advanced experience, achievements and methods of the award-winning organizations and individual persons through mass media.

Article 18

The award-winning organizations and individual persons at the mention of the honor of the mayor quality award in propaganda activities must give clear indication of the award-winning year.

Article 19

Every organization and individual person shall provide real application materials and is strictly prohibited from practicing fraud. Where the honor of the mayor quality award is obtained by dishonest methods, the municipal quality and technical supervision bureau shall, upon approval of the Municipal People’s Government, withdraw the honor qualification, take back the medal, certificate and prize, give criticism in circular notices and reject application from the wrongdoer within three years.

Article 20

Relevant organs and personnel participating in the evaluation work for the mayor quality award shall guard commercial and technical secrets of the organizations or individuals that make application, strictly abide by the administration procedures, detailed rules of evaluation procedures, and detailed rules on the administration of judge panel of the mayor quality award, and work in the impartial and honest manner. The regulation-breaking organs and personnel shall be deprived of evaluation qualification and prosecuted for liability according to laws.

Chapter IX Supplementary Provision

Article 21

These Procedures shall be effective as of the day these Procedures are printed and distributed.
