Article 1 In order to earnestly do a good job of swimming place services
in this Municipality and ensure swimmers¡¯health and safety, and in accordance
with laws, regulations and national standards of the People¡¯s Republic of
China¡°Conditions and Technical Requirements for Sports Place Services (Part I:
Swimming Places)¡±(hereinafter referred to as the¡°Technical Requirements¡±), these
Provisions are formulated. Article 2 These Provisions shall apply to the
swimming places within this Municipality¡¯s administrative area. The¡°swimming
places¡±mentioned in these Provisions refer to artificial indoor or outdoor
swimming places, swimming halls or water play pools that are open to the public,
and natural waters such as river, lake or sea and equipment and facilities
thereof that are open to the public. Article 3 A swimming place open to
the public shall be good for bodies and minds of the broad masses of the people
and beneficial to the construction of socialist spiritual
civilization. Swimming place services shall follow the principles of
administration according to law, in a localized way, and by legal
persons. Article 4 The Shanghai Municipal Sports Bureau (hereinafter
referred to as the¡°SMSB¡±) is the competent administrative department of the
swimming places in this Municipality and shall administrate the swimming places
in the whole Municipality according to law. The district/county administrative
departments of sports shall be responsible for the daily administration of the
swimming places in their respective administrative areas. The social sports
guidance and service organs, swimming associations and swimming lifesaving
associations in this Municipality shall, according to their relevant functions
and duties and the provisions of their constitutions, do a good job of guidance
and service work of swimming places. Article 5 The Municipal Joint Meeting
for Swimming Place Services in Summer, composed of the departments of sports,
education, public security, pubic health, quality and technology supervision,
etc., shall be established. The Municipal Joint Meeting for Swimming Place
Services shall mainly be responsible for the work plan of swimming place
services and shall guide and coordinate the relevant departments and
associations in doing a good job of supervision and services. The
district/county may establish corresponding guidance and coordination organs by
referring to the municipal joint meeting system. Article 6 The municipal
and district/county administrative departments of sports shall be cooperative
with their relevant departments to do a good job of inspection in strict
accordance with the¡°Technical Requirements¡±. Article 7 The planning,
construction and administration of swimming places shall be in conformity with
the provisions of the State relating to urban planning, construction, public
health, and design standards for sports discipline. Article 8 An
artificial indoor or outdoor swimming place open to the public shall satisfy the
following conditions: 1. The water surface area of a newly-built artificial
indoor swimming pool (a single pool) shall not be less than 100 square meters.
The wall and bottom of the pool shall be bright and clean in a light color
without water seepage and its construction quality shall meet the requirement of
the State standards for construction. 2. There shall be conspicuous water
depth signs and warning marks for deep and shallow water areas on the surface of
the pool, or a conspicuous isolation belt between deep and shallow water. The
depth of water in the shallow water area shall not be more than 1.2 meters.
There shall be at least two entrance-exit ladders provided for the swimming pool
with a surface area of not more than 500 square meters and four entrance-exit
ladders for the swimming pool with a surface area of not less than 2000 square
meters. 3. There shall be non-slip walkways around the swimming pool and
there shall be drainage ditches between the swimming pool and the non-slip
walkways. There shall be safety protection nets for water spouts in the swimming
pool. 4. The water and air hygiene must be in conformity with the provisions
of State standards. There shall be recirculating water purification and
sterilizing equipment that are with certificates of quality issued by qualified
quality-inspection agencies. Where chlorination disinfection is adopted,
protective measures shall be taken. There shall be disinfection ponds for feet
soaking that the swimmers have to pass between the locker rooms and the walkways
of the swimming pool. 5. The surface of the swimming pool shall have not less
than 80 lux of illumination. The swimming pool open in evenings shall be
equipped with enough emergency lights and have the entrance, exit and evacuation
passage that meet construction standards. 6. The special equipment in the
swimming pool, if any, shall be in conformity with the provisions of the
relevant laws and regulations. 7. Being in conformity with other provisions
of State standards. Article 9 A natural swimming place open to the public
shall satisfy the following conditions: 1. The water surface area shall not
be less than 1000 square meters. There shall be signs to indicate the dangerous
area and effective safety protection nets. And there shall be a command
(lookout) stand from which the whole swimming area can be supervised. The
distance between two elevated lifeguard stands shall be less than or shall be
equal to 100 meters and the height of lifeguard stands shall not be less than
two meters. There shall be broadcasting and communication facilities. 2. The
illuminance on the water surface of the swimming pool shall satisfy the need of
lifesaving safety. 3. There shall be no obstacles such as branches and stumps
of trees, reeves and pollution sources on the water bottom. The speed of water
flow shall not be more than 0.5 m/s. 4. The water hygiene shall be in
conformity with the provisions of State standards. 5. Being in conformity
with other provisions of State standards. Article 10 There shall be at
least two elevated lifeguard stands provided for an artificial swimming pool
with a surface area of less than 250 square meters; on this basis, one more
lifeguard stand shall be provided for a further increase of every 250 square
meters of surface area or less pro rata. The height of the lifeguard stands
shall not be less than 1.5 meters. Article 11 The number of swimmers
shall be limited by the standard that the swimming area shall not be less than
2.5 square meters per swimmer in average in an artificial swimming pool and 4
square meters in a natural swimming pool. Article 12 A swimming place
shall normalize the service contents. Its promised service items, matters
needing attention for swimmers and other necessary safety warnings shall be put
to the conspicuous places of its gates or entrances. Article 13 A swimming
place shall institute and perfect normalized safety and health administration
systems, be equipped with full-time personnel or special posts and designate
special persons to make inspections and checks. The persons in charge of the
swimming place and the persons engaged in teaching, lifesaving, water quality,
medical matters, physical examination, etc. shall, according to relevant laws,
regulations and trade provisions, attend professional training and obtain
corresponding certificates of competence. A swimming place shall do a good
job of inspecting the acute conjunctivitis of swimmers before swimming and
putting eye drops after swimming. The heath administration shall be strengthened
to prevent the spread of disease. The clothes worn by all staff at swimming
places shall bear distinct marks. Article 14 A swimming place shall,
according to the¡°Technical Requirements¡±, be equipped with lifeguards,
lifesaving facilities, first-aid rooms, first-aid medicines, etc., formulate a
pre-determined rescue scheme for injury accidents and institute a rescue and
delivery system for drowning persons. A natural swimming place shall be
equipped with, besides lifeguards, patrol and lifesaving ships/boats and
communication facilities that correspond with their water surface
areas. Article 15 Where there is any typhoon or thunderstorm or waters are
polluted and swimming activities are impropriate, an artificial outdoor swimming
place or a natural swimming place shall stop the sale of tickets, timely
dissuade swimmers from swimming and guide them to get into the safety area.
Article 16 Any person that enters a swimming place to go swimming shall
hold an effective health certificate for swimming and comply with the following
provisions: 1. Obeying the command of the lifeguards and carrying out
activities within a prescribed time and areas. 2. Abiding by the code of
conduct in public places and administrative rules governing activities in the
swimming place. The swimming place shall put up notices that any patient with
hepatitis, heart disease, skin tinea or rash (including feet tinea), severe
trachoma, acute conjunctiva, otitis media, infectious intestinal disease or
mental disease or any heavy drinker shall be banned from entering the swimming
place to go swimming. Article 17 A system in which certificates for
swimming in the deep water area are examined shall be implemented step by step
in artificial swimming places. A swimmer may enter the deep water area to go
swimming upon passing the examination for swimming in deep water. Examination
procedures on certificates for deep water swimming shall be formulated by the
Municipal Swimming Associations. Article 18 Where a major injury accident
such as drowning occurs, the swimming place shall report such an accident to the
district/county administrative department of sports in its locality within one
hour after the injured person is sent to hospital for emergency treatment, and
inform the district/county department of public security in its locality as
prescribed. The district/county administrative department of sports shall report
to the SMSB within one hour upon receiving the report from the swimming place
and submit a written report within 48 hours. Where an accident that is
detrimental to health occurs, the swimming place shall, within 24 hours, report
to the district/county administrative department of public heath. Article
19 The administrative departments of sports shall implement a supervision and
guidance system for swimming place services. The supervision and guidance staff
shall make inspection tour of and give instructions to swimming places and put
forward improvement opinions and suggestions for their services. The SMSB
shall be responsible for the supervision and guidance work of swimming place
services and the formulation of specific implementation procedures
thereof. Article 20 Where any swimmer, in violation of Article 16 of these
Provisions, affect the health or safety of other swimmers, he/she shall be
handled according to the relevant provisions; in case that the accident injury
is caused by himself/herself, he/she himself/herself shall bear the
liability. Article 21 Where any swimming place violates the provisions of
the law, rules and regulations on sports, public security, fire fighting, public
heath, city appearance and sanitation, quality and technology supervision, etc.,
the departments of sports, public security, public health, city appearance and
sanitation, quality and technology supervision, etc. shall handle such
violations according to law. Article 22 These Provisions shall become
effective from the date of promulgation. |
