Implementation Suggestions on Launching the Work of Screening and Rectifying Potential Fire Hazards in a Centralized Manner in this Municipality

In recent years, under the unified leadership of the Municipal Party Committee and the Municipal People¡¯s Government, a series of specialized administration campaigns for fire fighting and prevention were launched in this Municipality with the public crowded places, old-style citizens¡¯residential buildings and underground space as key point, a number of potential fire hazards were rectified in time, and this Municipality¡¯s safety from fire accidents was effectively safeguarded. For the purpose of thoroughly carrying out the series of important directives by the CPC Central Committee and the State Council on strengthening the work of safety from fire accidents, further rectifying potential fire hazards, radically improving the safety conditions of fire prevention, enhancing the whole society¡¯s anti-fire capability, curbing the occurrence of fire accidents causing group casualties, according to the spirit of the¡°Notice on the Printing and Distributing of the¡®Plan for Launching the Work of Screening and Rectifying Potential Fire Hazards in a Centralized Manner¡¯¡±made by the Safe Production Committee of the State Council, and in the light of the actual circumstances, we hereby put forward the implementation suggestions on launching the work of screening and rectifying potential fire hazards in a centralized manner in this Municipality(hereinafter referred to as the¡°work of screening and rectification¡±) as follows:

I. Guiding thought

With the laws and regulations such as the¡°Fire Fighting and Prevention Law of the People¡¯s Republic of China¡±, the¡°Law of the People¡¯s Republic of China on Safe Production¡±, and the¡°Regulations of the State Council on Investigating and Affixing the Administrative Responsibility for Exceptionally Serious Safety-related Accidents¡±(Decree of the State Council No.302) as the basis, the¡°Suggestions on Further Strengthening the City Planning for Fire Fighting and Prevention and the Construction of Public Fire Facilities¡±made by the Ministry of Public Security, the Ministry of Construction, and the State Development and Reform Commission, the¡°Suggestions on Further Carrying out the Responsibility System for the Work of Fire Fighting and Prevention¡±made by the Ministry of Public Security, the Ministry of Supervision, the State Administration of Safe Production Supervision, and the spirit of this Municipality¡¯s related documents shall be thoroughly implemented; taking the resolute elimination of potential fire hazards and the prevention of the occurrence of fire accidents causing group casualties as the target, highlighting the key points, and seeking both a temporary solution and a permanent effect, potential fire hazards shall be screened and rectified, the responsibility system for safety from fire accidents shall be implemented in an all-round way, and this Municipality¡¯s work of safety from fire accidents shall be fully strengthened so as to create a safer environment for promoting Shanghai¡¯s economic and social development and safeguarding Shanghai¡¯s social stability.

II. Organization and leadership

The Municipal Work Group for Screening and Rectifying Potential Fire Hazards (hereinafter referred to as¡°work group¡±) with the municipal leader assigned with the specific responsibility for fire fighting and prevention as the leader, the Municipal Public Security Bureau, the Municipal Administration of Safe Production Supervision, the Municipal Supervisory Committee, the Municipal Construction Commission, the Municipal Economic Commission, the Municipal Foreign Economic and Trade Commission, the Municipal Education Commission, the Municipal State Assets Management Commission, the Municipal Culture, Broadcasting, Film and Television Bureau, the Municipal Public Health Bureau, the Municipal Administration of Industry and Commerce, the Municipal Tourism Commission and the Municipal Fire Bureau as members shall be established, with a subordinate agency named the Municipal Office for the Work of Screening and Rectifying Potential Fire Hazards (set up in the Municipal Fire Bureau) to take the specific responsibility for the screening and rectification work in the whole Municipality. All districts and counties shall establish the corresponding work groups.

III. Scope and key points of the work of screening and rectifying potential fire hazards

The scope of the work of screening and rectifying potential fire hazards covers the places crowded with people and the grounds for producing, storing and operating inflammable and explosive chemicals.

The key points of the screening and rectification include:

1. Places crowded with people

(1)The locking-up, blockade or occupation of evacuation passageways, evacuation stairs or safety exits that affect safe evacuation shall be rectified without delay.

(2)The iron railings set up in evacuation passageways, evacuation stairs and at safety exits, and the metal rail fences erected at the external windows of public areas and the collective accommodation rooms, which affect safe evacuation and emergency rescue, shall be removed within a prescribed limit of time.

(3) Where the position and number of evacuation passageways, evacuation stairs and safety exits do not meet the requirements, and the safety exits are not positioned separately for the business section and the residential section in a commercial-residential building, rectification shall be made within a prescribed time limit.

(4) Where the indicatory signs for evacuation and the emergency lighting for fire accidents are sheltered or covered, rectification shall be made without delay; where such indicatory signs and such emergency lighting are insufficient, damaged or wrongly marked, rectification shall be made within a prescribed time limit.

(5) Where the employees¡¯collective dormitories and workshops or storerooms are set up in the same building/structure, rectification shall be made within a prescribed time limit.

(6)The use, and storage of inflammable and explosive chemicals in violation of the regulations on safety from fire accidents in the places densely crowded with people shall be rectified without delay.

(7)The unauthorized alteration of the area division for fire prevention that may easily cause the spread and extension of fire shall be rectified without delay.

(8)Where the building-bound fire facilities such as the automatic fire alarming system, automatic fire extinguishing system and smoke prevention and exhaustion system are not in good repair and effective, thus affecting the function of preventing and extinguishing fire, rectification shall be made without delay.

(9)Where at the time of the open fire operations such as electric welding and gas welding in a building, the operation is carried out without effecting anti-fire separation of the operation area from the use area, or clearing inflammable or ignitable matters away from the areas easy to flare up, or providing fire equipment or arranging special guardians in violation of regulations, rectification shall be made without delay.

(10)The erection of buildings or structures in the vicinity of buildings that affects persons¡¯escape, fire extinguishment and rescue operation shall be rectified within a prescribed limit of time.

2. Grounds for producing, storing and operating inflammable and explosive chemicals

(1) Where the grounds do not meet the requirements of the city layout for safety from fire accidents, thus affecting public safety, rectification shall be made within a prescribed time limit.

(2)Where the fuel gas source plants, storage and distribution stations, pressure adjusting stations and the fuel gas transmission and distribution piping networks including pipelines and installations in cities and towns do not conform with the requirements of the Sate-set standards, rectification shall be made within a prescribed time limit.

(3)The mingled storage and placement of the matters that may cause chemical reaction between each other or are suitable for different methods of fire extinguishment shall be rectified without delay.

(4) Where the safety layout, fire water source, fire extinguishing facilities and anti-thunder, anti-explosion and anti-static-electricity facilities do not meet the requirements, thus affecting the function of fire prevention and extinguishment, rectification shall be made within a prescribed limit of time.

IV. Implementation Steps

The pattern of¡°combining vertical lines of leadership with horizontal lines of leadership, taking¡®horizontal lines of leadership¡¯as the principal¡±shall be adopted in the present work of screening and rectifying potential fire hazards, and such work shall be implemented in four stages:

1.The stage of mobilization and arrangement(from now on to the third ten-day stage of September). All districts and counties shall, in the light of actual circumstances, draw up the plan for the work of screening and rectifying potential fire hazards in their respective areas, and make known to the society in time the scope, key contents and work requirements of screening and rectification of potential fire hazards.

2. The stage of self-check and self-rectification (from the third ten-day stage to the second ten-day stage of October).The persons responsible for safety from fire accidents of all units shall, according to the requirements of the¡°Suggestions on Further Carrying out the Responsibility System for the Work of Fire Fighting and Prevention¡±made by the Ministry of Public Security, the Ministry of Supervision, and the State Administration of Safe Production Supervision and the¡°Regulations on the Administration over the Safety from Fire Accidents in Organs, Organizations, Enterprises and Institutions¡±promulgated by the Ministry of Public Security, and the related standards and norms for fire fighting and prevention technology, conduct an all-round self-check against the key contents of the screening and rectification of potential fire hazards. In respect of the potential fire hazards found out in the check, those belonging to the type subject to immediate rectification must be rectified immediately; in respect of those belonging to the type subject to limited-time rectification, the responsible persons, limit of time and measures for the rectification must be ensured, and the measures to ensure safety must be adopted during the stage of rectification; where safety from fire accidents cannot be ensured, the units concerned shall stop by themselves the production or business at the hazardous spots for rectification. All units shall, after finishing the self-check and self-rectification, fill out the uniform¡°Unit¡¯s Letter of Promise on the Self-check and Self-rectification of Potential fire Hazards¡±(attached) , and submit it to the district/county work group for screening and rectifying potential fire hazards in the locality before the end of October 20, and at the same time submit the same letter to the competent administrative department of their own trade or setup if they have their own competent administrative departments.

3.The stage of centralized administration (from the third ten-day stage of October to the first ten-day stage of November). All district/county work groups for screening and rectifying potential fire hazards shall organize force to conscientiously launch supervision and inspection on the screening and rectifying work in their own administrative areas. On this basis, the competent administrative departments of trades and setups shall launch re-inspection on their subordinate units¡¯screening and rectifying work. All district/county work groups for screening and rectifying potential fire hazards shall conduct supervision and check on the situation of the re-inspection by the competent administrative departments of trades and setups and the situation of self-check and self-rectification by the units without competent administrative departments, and order the departments and units whose work is not well done and measures are not implemented to make rectification within a prescribed time limit until the potential fire hazards are completely eliminated; and urge them to rectify one by one the serious potential fire hazards not yet rectified and put forward specific rectification suggestions. The public security fire departments at all levels shall strictly fulfill their function of supervision over fire fighting and prevention, and in the light of different situation, order rectification on the spot or within a prescribed time limit according to law, order a stop of construction, use or production/business, and impose on the related responsible persons the administrative punishment such as warning, fine or detention. All district/county work groups for screening and rectifying potential fire hazards shall, prior to November 5, submit a report on the situation of screening and rectifying potential fire hazards to the Municipal Office for the Work of Screening and Rectifying Potential Fire Hazards.

During the stage of centralized rectification, the public security department shall, in the name of the government at the same level, hang the warning plate of¡°Units with Serious Potential Fire Hazards¡±clearly marking the spots with serious potential fire hazards, the limit of time and responsible persons for the rectification in the conspicuous position of the unit that has been confirmed as having serious potential fire hazards after the approval of the municipal or district/county work group for screening and rectifying potential fire hazards, and make them known to the society. Governments at all levels shall actively coordinate related functional departments in urging the implementation of the rectification measures according to their respective functions and duties until the potential fire hazards have been completely rectified. The¡°work group¡±shall launch inspection on the situation of the performance of the rectification of the serious potential fire hazards under the superintendence of all districts and counties, and according to related laws and regulations, severely investigate and affix the responsibility of the related leaders and persons that exercise weak leadership, enforce law loosely, practise fraud or neglect duty.

4.The stage of supervisory check and summarization(the second ten-day stage of November). The¡°work group¡±shall form a certain number of teams to conduct on-the-spot supervisory check and acceptance check on the work of screening and rectifying potential fire hazards in all districts and counties (the form and timing of the supervisory check and acceptance check to be notified separately), and explore the establishment of a long-term mechanism to consolidate the achievements made in the screening and rectification work.

V. Work requirements

1. All districts and counties and related departments shall, proceeding from the height of practising the important thought of Three Represents and sticking to the ruling for the people, fully understand the importance of the present work of screening and rectifying potential fire hazards, earnestly enhance the sense of duty, and adopt feasible and effective measures to ensure this work develops in a really effective manner.

2.The departments of public security, fire fighting and prevention, safety supervision and control, supervision, education, construction, commercial affairs, culture, public health, industry and commerce and tourism at all levels shall extend close cooperation with a concerted effort, coordinate the resolution of the major problems arising in the screening and rectification work to form a joint force. The competent administrative department of all setups shall perform their own duty and function, further intensify the work of supervising and urging the screening and rectification of potential fire hazards within their own setup or trade, further strengthen units¡¯awareness of the responsibility subject for potential fire hazards in order to truly realize¡°self-check on safety from fire accidents and self-elimination of potential hazards¡±.

3. All press units shall earnestly strengthen publicity and educate the broad masses to actively participate in the activity of screening and rectifying potential fire hazards, and raise their awareness of safety from fire accidents and the capability of extinguishing fire and saving themselves. Publicity shall be conducted throughout the whole screening and rectification work.

4. Relevant functional departments shall actively establish and implement the mechanism for the announcement of serious potential fire hazards, the system for reporting potential fire hazards, the systems for superintending serious potential fire hazards and the mechanism for appraising the danger of fire accidents and the capability of safeguarding safety from fire accidents, and bring the work of screening and rectifying potential fire hazards into the orbit of systemization, normalization and regularization. By means of the establishment of a long-acting mechanism, the¡°passive defense¡±shall be changed to¡°active attack¡±to achieve that not only old potential fire hazards can be screened and rectified in time, but also the multiplication of new potential fire hazards can be prevented and reduced in order to decrease the occurrence of fire accidents to the minimum.
