(I) Foreigners adopt an abandoned infant or child in China

With the Notice on Placing out a Child for Transnational Adoption issued from China Center of Adoption Affairs, the person involved in the adoption registration is to be examined within 7 days after his or her arrival in Shanghai, and those answering for the prescribed conditions are to be registered and issued an adoption registration certificate.

(II) Chinese citizens adopt an abandoned infant or child in China

After Shanghai Civil Affairs Administration Bureau receives the application for registration of child adoption and relevant materials, examination work shall be done on the application materials within 30 days from the next day when the application is accepted. Those answering for the prescribed conditions are to be registered and issued a certificate on adoption registration; those not answering for the prescribed conditions are not to be registered and reasons for being denied the registration are to be given.

(I) Both husband and wife reach the age of 30 years;

(II) The adopter is capable of rearing and educating the adopted child;

(III) No illness which is deemed medically as inappropriate for the adopter to adopt children;

(IV) Both husband and wife must agree on the adoption issue;

(V) Where the adopter is an unmarried man and he wants to adopt a female child, the age gap between the adopter and the adopted child must be over 40 years;

(VI) The adopted child must be the abandoned infant, younger than 14 years whose biological parents can not be ascertained or found and who is raised by social welfare agencies.

(I) The adopter should submit the following credentials and certifications:

1. Foreigners adopt a child or children in China

If a foreigner wants to adopt a child (or children) in China, the government of his or her resident country or the adoption organization entrusted by the government should present and deliver to China Center of Adoption Affairs the following papers which are authenticated by the department of foreign affairs of his or her resident country, or by the agency authorized by the department of foreign affairs and also authenticated by the Embassy or Consulate of the People's Republic of China in the country concerned:

£¨1£©A Written Application for Transnational Adoption of a Child;

£¨2£©Birth Certificate;

£¨3£©Marital Status Certificate;

£¨4£©Certificates on Profession, Economic Income and Property Status;

£¨5£©Certificate on Physical check-up;

£¨6£©Credential proving whether the adopter has once been subject to criminal punishment;

£¨7£©Credential certifying that the responsible agency of the adopter¡¯s resident country agrees on the adoption issue.

£¨8£©Report on family information of the adoption.

2. Overseas Chinese adopt a child (or children) in China

£¨1£©A written application, including such contents as the reasons and purpose of the adoption, and the promise on not abandoning or maltreating the adopted child (or children) and on bringing up the adopted child (or children) in a healthy way.

£¨2£©Passport of the adopter and credentials on his or her residing overseas.

£¨3£©The adopter shall submit papers certifying such particulars of the adopter as age, marital status, profession, property, health, whether having a child or not , and whether having once been subject to criminal punishment, which are provided by the authoritative agency of his or her resident country. Such certifying papers shall be authenticated by the department of foreign affairs of the country of his or her residence, agency authorized by the department of foreign affairs and by the Embassy or Consulate of the People's Republic of China in the country concerned.

3. Chinese citizens living in Hong Kong or Macao Special Administrative Region or in Taiwan adopt a child (or children) in China shall submit the following materials:

£¨1£©A written application, including such contents as the reasons and purpose of the adoption, and the promise on not abandoning or maltreating the adopted child (or children)and on bringing up the child (or children) in a healthy way.

£¨2£©ID card of Hong Kong Residents, Pass of Hong Kong Residents Going to and From Mainland China or Home-Visiting Pass for Compatriots from Hong Kong; ID card of Macao Residents, Pass of Macao Residents Going to and From Mainland China or Home-Visiting Pass for Compatriots from Macao; Valid certificate proving the adopter residing in Taiwan and valid travel certificates issued or endorsed by authorities of the People¡¯s Republic of China.

£¨3£©Credentials on the age, marital status, profession, property, health condition of the adopter and on whether he (or she) has a child (or children) and whether the adoptive has once been subject to criminal punishment. The credentials shall be attested by the notary organ in Hong Kong entrusted by the responsible authority in China, or shall be issued by the authorities in Macao or notarized by notary organs in Taiwan Region.

4. Chinese citizens living in Mainland China adopt a child (or children)

£¨1£©A written application, including such contents as the reasons and purpose of the adoption, and the promise on not abandoning or maltreating the adopted child (or children)and on bringing up the adopted child (or children) in a healthy way.

£¨2£©ID card and residential registration booklet of the adopter.

£¨3£©Marriage Certificate (certificate on divorce is needed for those who are divorced).

£¨4£©Papers provided by the unit of the adopter, which should be issued by the unit of the adopter or by the villagers¡¯committee or neighborhood committee of his residence, and shall be stamped with official seal of the government on village or town level (or the official seal of the subdistrict office); the papers should demonstrate the age, marital status of the adopter and whether he (or she) has a child (or children), and whether the adopter is capable of bringing up the adopted child (or children)in a healthy way (such particulars as the property status, health condition and morality of the adopter).

(II) The unit placing out a child (or children) for adoption should submit the following credentials and certificates:

1. ID card (photocopy) of the person in charge of the social welfare agency;

2. Credentials certifying the report of picking up an abandoned child or infant issued by security authorities, or certificate on the death of the biological parents of the orphan or paper on the court declaring the death of his or her biological parents;

3. Original record on the abandoned infant or child entering a children¡¯s welfare house and credential on the collective residential registration of the abandoned infant or child;

4. Report on Growth Information of the abandoned infant or child;

5. A notice on the infant being abandoned;

6. Certificate on Physical Check-up or certificate on illness and deformity of the abandoned infant issued by Shanghai Children¡¯s Hospital before he or she is placed out for adoption;

7. An agreement on adoption of a child and certificate on adoption of a child.

(III) Credentials and certificates are needed from the adopted person: the adopted person over 10 years old shall submit a letter of intent demonstrating that he or she is willing to be adopted.

(II) Overseas Chinese and Chinese citizens living in Hong Kong or Macao or in Taiwan region adopt an abandoned infant or child:

To fill in an application form¡úto submit credentials and certificates¡úto sign an agreement on the adoption with children¡¯s welfare house¡úto go through examination procedures¡úto be issued a¡°Certificate on Adoption Registration¡±

(III) Chinese citizens in Mainland China adopt an abandoned infant or child:

To fill in an application form¡úchildren¡¯s welfare house notifies the child to be adopted of the adoption affairs and signs an agreement on the adoption with the adopter¡úto submit certificates and credentials¡úto go through examination procedures¡úto be issued a¡°Certificate on Adoption Registration¡±

Adoption Law of the People¡¯s Republic of China, Measures for Registration of Adoption of Children by Chinese Citizens, Measures for Registration of Adoption of Children by Foreigners in the People¡¯s Republic of China, Prescriptions on Administration over Registration of Adoption of Children by Overseas Chinese, Chinese Citizens Living in The Regions of Hong Kong or Macao or in Taiwan and Prescriptions on the Credentials and Certificates Needed for the Registration.

(I) Charging standard

1. Fee for processing an application for adoption of a child: 20 RMB

2. Production Cost for a Certificate on Adoption: 10 RMB

3. Fee for Investigation on the adoption registration: 220 RMB
