Departments on registration of adoption of children at all civil affairs administration bureaus on district or county level

Shanghai Civil Affairs Administration Bureau

Departments on registration of adoption of children shall do examination work within 30 days from the next day when the application is accepted on adoption registration and relevant materials. Those answering for the prescribed conditions are to be issued a Certificate on Adoption Registration; those not answering for the conditions are denied the registration and the reasons are to be given.

(I) Having reached the age of 30.

(II) Childless (excluding from step father or step mother who wants to adopt a step son or step daughter in Shanghai).

(III) Being capable of rearing and educating the adopted person.

(IV) No illness which is deemed medically as inappropriate for the adopter to adopt children;

(V) Both the husband and wife must agree on the adoption affair; where an unmarried male adopts an abandoned infant girl or a female child, the age gap between the adoptive and the adopted person must be over 40 years.

(I) The adopter should submit the following credentials and certificates

1. Where the adopted person is an abandoned infant or child whose parents can not be ascertained or found and who is raised by non-social welfare institutes in Shanghai, the adoptive adopter should submit the following credentials and certificates:

£¨1£©A written application on the adoption of a child (or children), including such contents as the reasons and purpose of the adoption, and the promise on not abandoning or maltreating the adopted child (or children)and on bringing up the adopted child (or children) in a healthy way, as well as the detailed information on the source of the adopted child (or children).

£¨2£©ID card, or residential registration booklet.

£¨3£©Marriage Certificate, or Certificate on Divorce for those who are divorced.

£¨4£©Papers provided by the work unit of the adopter, which should be issued by the work unit of the adopter or by the villagers¡¯committee or neighborhood committee of his residence, and shall be stamped with official seal of the government on village or town level (or the official seal of the subdistrict office); the papers should demonstrate the age, marital status, profession of the adopter and whether he (or she) has a child (or children) and whether the adoptive is capable of bringing up the adopted child (or children)in a healthy way (such particulars as the property status, health condition and morality of the adopter).

£¨5£©Medical Certificate. Certificate issued by central hospitals over district or county level demonstrating the adopter having no illness which is deemed medically as inappropriate to adopt children.

£¨6£©Certificate on Abandoned infant. Certificate on report of picking up an abandoned infant or child issued by police stations.

£¨7£©Notary Deed on site witness (a notary deed on witness testimony presented by 2 relatives of the party discovering or picking up the abandoned infant or by the adopter, testifying the adopted person is indeed an abandoned baby);

£¨8£©Notice on looking for biological parents. A notice published on designated newspaper to look for biological parents of the abandoned infant.¡£

£¨9£©Certificate certifying the adopter has no child. Certificate on the adopter being childless issued from department on family planning of the place where his or her registered residence is located.

£¨10£©An agreement. For the unmarried adopter or the one wishing to adopt a child instead of giving birth to a child, he or she should submit an agreement signed with family planning department on district or county level promising to obey rules on family planning.

£¨11£©Certificate on illness and deformity. Where the adopted child has illness or is disabled, a certificate on diagnose of medical expertise on disabled child issued by a medical expertise panel on municipal, district or country level is needed.

2. Where the adopted person is the child of Shanghai residents who are incapable of rearing the child due to unusual difficulties, the adopter should submit the following relevant credentials and certificates:

£¨1£©A written application on adoption of children, including such contents as the reasons and purpose of the adoption, and the promise on not abandoning or maltreating the adopted child (or children)and on bringing up the adopted child (or children) in a healthy way, as well as the other relevant needed information.

£¨2£©ID card, or residential registration booklet.

£¨3£©Marriage Certificate, or Certificate on Divorce for those who are divorced.

£¨4£©Papers provided by the unit of the adopter, which should be issued by the unit of the adopter or by the villagers¡¯committee or neighborhood committee of his residence, which are stamped with official seal of the government on village or town level (or the official seal of the subdistrict office); the papers should demonstrate the age, marital status of the adopter and whether he (or she) has a child (or children) and whether the adopter is capable of bringing up the adopted child (or children)in a healthy way (such particulars as the property status, health condition and morality of the adopter).

3. Where the adopted person is an orphan placed out for adoption by his or her guardian in Shanghai, the adopter should submit the following credentials and certificates:

£¨1£©A written application on adoption of the child, including such contents as the reasons and purpose of the adoption, and the promise on not abandoning or maltreating the adopted child (or children)and on bringing up the adopted child (or children) in a healthy way, as well as the other relevant information.

£¨2£©ID card or residential registration booklet.

£¨3£©Marriage Certificate, or Certificate on Divorce for those who are divorced.

£¨4£©Papers provided by the work unit of the adopter, which should be issued by the work unit of the adopter or by the villagers¡¯committee or neighborhood committee of his residence, and shall be stamped with official seal of the government on village or town level (or the official seal of the subdistrict office); the papers should demonstrate the age, marital status of the adopter and whether he (or she) has a child (or children) and whether the adoptive is capable of bringing up the adopted child (or children)in a healthy way (such particulars as the property status, health condition and morality of the adopter).

£¨6£©Those already having a child but wishing to adopt a healthy child should submit the Notice on Returning the Certificate on the Only Child of the Couple issued by family planning department on district or country level.

4. Where the adopted person is a child belonging to a collateral relative by blood of the same generation and up to the third degree of kinship in Shanghai, the adopter should submit the following credentials and certificates:

£¨1£©A written application on the adoption of child, including such contents as purpose of the adoption, relationship between the adopter and the adopted person, and the promise on not abandoning or maltreating the adopted child (or children)and on bringing up the adopted child (or children) in a healthy way, as well as the other relevant information.

£¨2£©ID card, or residential registration booklet.

£¨3£©Marriage Certificate, or Certificate on Divorce for those who are divorced.

£¨4£©Papers provided by the work unit of the adopter, which should be issued by the work unit of the adopter or by the villagers¡¯committee or neighborhood committee of his residence, and shall be stamped with official seal of the government on village or town level (or the official seal of the subdistrict office); the papers should demonstrate the age, marital status of the adoptive and whether he (or she) has a child (or children) and whether the adopter is capable of bringing up the adopted child (or children)in a healthy way (such particulars as the property status, health condition and morality of the adopter).

5. Where the adopted person is a step-son or step-daughter in Shanghai, the adopter should submit the following credentials and certificates:

£¨1£©A written application on adoption of the child, including such contents as the reasons of the adoption, and the promise on not abandoning or maltreating the adopted child (or children)and on bringing up the adopted child (or children) in a healthy way, as well as other relevant information.

£¨2£©ID card and residential registration booklet.

£¨3£©Marriage Certificate. The marriage certificate of the adopter and the biological father or mother of the adopted person

£¨4£©Those already having a child but wishing to adopt a healthy child should submit the Notice on Giving Back the Certificate on the Only Child of the Couple issued by family planning department on district or country level.

(II) The person placing out a child (or children) for adoption should submit the following credentials and certificates:

1. Where the person placed out for adoption is the child of Shanghai citizens who are incapable of raising the child due to unusual difficulties, the person placing out the child for adoption should submit the following credentials and certificates:

£¨1£©A Written application on placing out a child (or children) for adoption, including such particulars as reasons for placing out the child (or children) for adoption and relevant needed information.

£¨2£©ID card and residential registration booklet.

£¨3£©Marriage Certificate, or Certificate on Divorce for those who are divorced.

£¨4£©Papers certifying the person placing out the child (or children) for adoption is unable to raise the child (or children) due to unusual difficulties. Papers issued by the work unit of the person placing out the child (or children) for adoption or by the villager¡¯s committee or neighborhood committee of his or her residence, proving the person placing out the child (or children) for adoption is indeed unable to raise the child (or children) due to unusual difficulties, and the papers should be stamped with official seal of the government on village or town level (or the official seal of the subdistrict office).

£¨5£©An agreement. The agreement signed with family planning department of the place where the registered residence of the party placing out a child for adoption is located, promising to obey prescriptions on family planning.

£¨6£©For the person placing out a child for adoption whose spouse is dead or can not be ascertained, he or she should submit the death certificate of his or her spouse or the proof on the death declared by the people¡¯s court and a written consent on placing out the child for adoption from the parents of the dead or unascertained spouse; where the person who is divorced wishes to place out a child for adoption, he or she should submit the written consent on placing out the child for adoption from his or her former spouse.

£¨8£©Where the child placed out for adoption is the only child of a couple, the Notice on returning the certificate on the only child of a couple issued by family planning department on district or county level should be submitted.

2. Where the child to be placed out for adoption is an orphan placed out for adoption by his or her guardian in Shanghai, the person placing out the orphan for adoption should submit the following credentials and certificates:

£¨1£©A written application for placing out a child (or children) for adoption, including such particulars as reasons for placing out the child (or children) for adoption and relevant needed information.

£¨2£©ID card, residential registration booklet and certificate on guardianship. Where an organization acts as the party placing out the child (or children) for adoption, the identity documents of the person in charge of the organization are needed.

£¨3£©Death certificate. Death certificate of the biological parents of the orphan or certification on the death of the biological parents of the orphan declared by the court.

£¨4£©Letter of consent on placing out the child(ren) for adoption. A written consent on placing out the child(ren) for adoption from persons who have obligations to raise the minor(s).

£¨5£©Where the child placed out for adoption is the only child of a couple, the Notice on Returning the Certificate on the Only Child of a Couple issued by family planning department on district or county level should be submitted.

£¨6£©Certificate on actual guardianship. Where the work unit of the passed parents of the orphan or villagers¡¯or neighborhood committee of the orphan¡¯s residence actually takes on the guardianship obligations, a certificate on the actual guardianship is needed.

3. Where the adopted child is a child belonging to a collateral relative by blood of the same generation and up to the third degree of kinship in Shanghai, the person placing out the child for adoption should submit the following credentials and certificates:

£¨1£©A written application for placing out a child (or children) for adoption, including such particulars as reasons for placing out the child (or children) for adoption and relationship between the person placing out the child (or children) for adoption and the adopter.

£¨2£©ID card and residential registration booklet.

£¨3£©Marriage Certificate, or Certificate on Divorce for those who are divorced.

£¨4£©An agreement. The agreement signed with family planning department of the place where his or her registered residence is located, promising to obey prescriptions on family planning.

£¨5£©For the person placing out a child for adoption whose spouse is dead or can not be ascertained, he or she should submit the death certificate of his or her spouse or the paper on the death of his or her spouse declared by the people¡¯s court and a written consent on placing out the child(ren) for adoption from the parents of the dead or unascertained spouse; where the person who is divorced wishes to place out a child for adoption, he or she should submit the written consent on placing out the child(ren) for adoption from his or her former spouse.

£¨6£©Kinship certification. A notarized deed certifying the person placing out a child for adoption and the adopter belong to a collateral relative by blood of the same generation and up to the third degree of kinship.

£¨7£©Where the child placed out for adoption is the only child of a couple, the Notice on Returning the certificate on the Only Child of a Couple issued by family planning department on district or county level should be submitted.

4. Where the child placed out for adoption is a step-son or step-daughter in Shanghai, the person placing out the child for adoption should submit the following credentials and certificates:

£¨1£©Letter of consent on placing out the child for adoption. A written consent on placing out the child for adoption from the biological father or biological mother of the adopted person.

£¨2£©ID card and residential registration booklet.

£¨3£©Divorce certificate. Divorce certificate between the person placing out the child for adoption and the biological father or biological mother of the adopted person.

£¨4£©Where the child placed out for adoption is the only child of a couple, the Notice on Returning the Certificate on the Only Child of a Couple issued by family planning department on district or county level should be submitted.

(III) The adopted person should submit the following papers and certificates

1. Residential registration booklet. Where the adopted persons are abandoned infants or children who are raised by other institutes rather than social welfare institutions in Shanghai and whose biological parents can not be ascertained or found, they are excluded from the restriction.

2. ID card. The adopted persons younger than 16 are excluded.

3. Birth certificate or notarial deed on birth. Where the adopted persons are abandoned infants or children who are raised by other institutes rather than social welfare institutions in Shanghai and whose biological parents can not be ascertained or found, they are excluded from the restriction.

4. A letter of Intent. Where the adopted person has reached the age of 10 years, he or she should submit a letter of intent indicating he or she is willing to be adopted.

5. Paper(s) certifying the adopted person who is younger than 14 years. Where the adopted person is the child or step child belonging to a collateral relative by blood of the same generation and up to the third degree of kinship, he or she is excluded from the restriction.

(I) Charging standard

1. Fee for processing application for an application for adoption of a child: 20 RMB

2. Production Cost for a Certificate on Adoption: 10 RMB

3. Fee for Investigation on the adoption registration: 220 RMB
