1. By saying¡°application and issuance¡±in Applying for a Resident
Identification Card, it means that Chinese citizens residing within the boundary
of the People¡¯s Republic of China who reach the age of 16, can lawfully apply to
the public security organ at the place of his permanent residence for a resident
identification card. Overseas Chinese who return to reside in the People¡¯s
Republic of China, compatriots from Hong Kong or Macao or from Taiwan who move
to resettle in inland areas, foreigners settling down in the People¡¯s Republic
of China, or the stateless ones who are permitted to be naturalized, who have
reached the age of 16, can apply for resident identification cards on their
going through procedures of residence registration. Citizens recruited for
active service who return to the place of their former residence registration
after retired from military service, and who have not gone through the
procedures for applying for and issuing resident identification cards shall also
apply for resident identification cards while going through the procedures of
residence registration. Those who are subject to such criminal penalties as
being taken into custody, fixed term imprisonment, labor education and
rehabilitation or detainment, but have not gone through the procedures for
applying for and issuing resident identification cards shall also apply for
resident identification cards after they are released from prison or after their
labor education and rehabilitation is disburdened. To apply for a resident
identification card, the applicant shall fill in Registration Form of
Application for Residence Registration (Application for Resident Identification
Card), present his or her residential registration booklet for examination, and
submit two of his 1¡±full-faced pictures which are taken recently, and then
obtain the Receipt of Applying for Resident Identification Card, Applying for a
new Resident Identification Card and Applying for reissue of a New Resident
Identification Card, or Applying for a Temporary Resident Identification Card.
2. By saying¡°applying for a new Resident Identification Card¡±, it means that
where the bearer changes his registered residence, or the term of validity of a
resident identification card expires, or the card is so seriously damaged that
what is registered becomes illegible, or contents registered on the card need to
be changed or corrected, the bearer shall apply for a new card. To applying for
a new resident identification card, the applicant shall fill in the Registration
Form of Application for a New Resident Identification Card or Application for
Reissue of a New Resident Identification Card, submit two of his 1¡±full-faced
pictures which are taken recently, and then obtain the Receipt of Applying for a
Resident Identification Card, Applying for a new Resident identification Card
and Applying for reissue of a New Resident Identification Card, or Applying for
a Temporary Resident Identification Card. While issuing the new resident
identification cards, the organ issuing new cards shall take back the old cards.
3. By saying¡°applying for reissue of a new resident identification card¡±, it
means that anyone who loses his resident identification card, which can not be
found within 3 months from the day when the loss case is reported to public
security organ, shall apply for reissue of a new resident identification card.
On losing his resident identification card, the citizen shall go to report the
loss at the police station of the place where his permanent residence
registration is located and obtain a¡°Registration Sheet on Report of the Loss of
Resident Identification Card¡±. Those whose resident identification cards can not
be found within 3 months from the day when the loss case is reported to public
security organ, shall take the said¡°Registration Sheet on Report of the Loss of
Resident Identification Card¡±, submit their Written Application, certifications
from their work units, and present their residential registration booklet for
examination, fill in Registration Form of Application for a New Resident
Identification Card or Application for Reissue of a New Resident Identification
Card, and illustrate the course of the loss and reasons for their application
for the reissue of a new card. After investigation work is done by policeman of
the police station and the superintendent of the police station does the
examination work on the application and signs his opinion, the reissue of a new
resident identification card can be done with the approval of the
superintendent; the applicant shall submit two of his 1¡±full-faced pictures
which are taken recently. The applicant shall submit the Receipt of Applying for
a Resident Identification Card, Applying for a New Resident identification card
and Applying for reissue of a New Resident Identification Card, or Applying for
a Temporary Resident Identification Card. Anyone whose original card is found
after obtaining a new one shall return the original card to the police station
of the place where his permanent registered residence is located. The police
station shall process and wind up the case within 2 months from the day when the
case is accepted.
4. By saying¡°applying for a temporary resident identification card¡±, it
means: (1) Before obtaining a Resident Identification Card, the citizen goes for
some event and needs a certification on his identity; or the original resident
identification card is lost or damaged, and the citizen shall apply for reissue
of a new card; before obtaining the new card, if the citizen goes for some event
and needs a certification on his identity, he can apply for a temporary resident
identification card with the term of validity being 3 months (hereafter
abbreviated as Article I). (2) Anyone who has reached the age of 16 and whose
permanent residence registration is undetermined, and who has not obtained a
resident identification card but whose residence is not registered or who can
not get his residence registered at the place where he presently resides in the
near term, and can not leave the place in recent period, can be permitted to be
issued a temporary resident identification card with the term of validity being
one year. (hereafter abbreviated as Article II) Anyone who comes under one of
the circumstances in Article I shall apply for a temporary resident
identification card at the police station of the place where he has his
permanent residence, fill in the Registration Form on Applying for Temporary
Resident Identification Cards, present his residential registration booklet for
examination, and submit one 1¡±full-faced picture which is taken recently (the
applicant whose resident identification card is lost and applying for reissue of
a card shall submit¡°Registration Sheet on Report of the Loss of Resident
Identification Card¡±). After the investigation work is done on the application
by policeman and examination and approval is done by the superintendent of the
police station, a temporary resident identification card is issued by public
security branches or by public security battalion(or squadron) of public
security bureaus on district or county level. The applicant shall obtain the
Receipt of Applying for a Resident Identification Card, Applying for a new
Resident Identification Card and Applying for Reissue of a New Resident
Identification Card, or Applying for a Temporary Resident Identification Card on
getting the new card. Anyone who comes under one the circumstances in Article II
shall apply for a temporary resident identification card at the police station
of the place where his present residence is located. The applicant shall fill in
the Application Form on Temporary Resident Identification Cards, present the
certifications on his residence registration (i.e., relocation certificate,
birth certificate, certification on his being released upon completion of his
term of imprisonment, certification on his being released from labor education
for rehabilitation, or paper on his residence registration being canceled) or
notarial certifications, and submit two of his 1¡±full-faced pictures which are
taken recently. After investigation work is done on the application by policeman
and examination is done by the superintendent of the police station, a temporary
resident identification card can be issued with the examination and approval
from public security branches or public security battalion (or squadron) of
public security bureaus on district or county level. Police stations shall do
examination work and wind up the case within 2 working days after accepting the
application.
Applications with complete formalities shall be processed then and there
(blocked areas are excluded).
