Where both parties shall conclude the labour contracts in writing but
actually fails to do that and the labourers fulfill their labour obligations
according to the requirements of the employers at last, the labour contractual
relationships are deemed to be established, and the labour rewards and working
conditions of the labourers shall be affirmed subject to provisions as follows:
(1) the labour rewards and working conditions are higher or better than what is
stipulated in the rules and regulations of the employers, terms and conditions
of the collective contracts or the legal labour standards, the affirmation shall
be carried out subject to the actual fulfillment; and (2) the labour rewards and
working conditions are lower or worse than what is stipulated in the rules and
regulations of the employers, terms and conditions of the collective contracts
or the legal labour standards, the affirmation shall be carried out under the
policy of benefiting the labourers.
