Time limit for preliminary examination in district/county judicial bureau is 15 days (that is, propose preliminary examination opinions within 15 days after receiving the application documents, and report to municipal judicial bureau). Time limit for examination and checking in municipal judicial bureau is 30 days (that is, make examination and approval decisions within 30 days after receiving the preliminary examination opinions of district/county judicial bureau and application documents. If qualified, issue lawyer’s practicing certificate; if disqualified, do not issue practicing certificate and notice the applicant in written form).

（1）With legal profession qualification or lawyer qualification;

（2）One year’s apprenticeship in a lawyer’s office;

（3）Good moral conduct.

Note: First time or re-application of practicing certificate, the applicant shall submit he following documents (all use A4 size paper; all the replicate copies bear the“Original Identity Seal”with the checker’s signature from district/county judicial bureau):

（1）Lawyer practicing registration form (two copies in one format)

（2）Replicate copy of legal profession certificate or lawyer qualification certificate;

（3）Replicate copy of ID card;

（4）Replicate copy of academic certificate;

（5）Replicate copy of permanent residence certificate;

（6）The applicant’s apprentice appraisal documents, including apprentice appraisal form and replicate copy of lawyer’s assistant. The apprentice appraisal form is uniformly printed by the municipal judicial bureau, and comes into effect upon stamping by the lawyer’s office. The lawyer’s assistant certificate is uniformly issued by the municipal judicial bureau.

（7）The replicate copy of the applicant’s dissolution of employment relationship with the original unit or retirement certificate;

（8）Employment signed by the applicant and lawyer’s office or the resolution to absorb as a talent;

（9）Personnel archive preservation note, issued by Shanghai Exchange Center of Legal Talents;

（10）Moral conduct appraisal opinions, including resume, performance and award/punishment, issues by district/county judicial bureau or Shanghai Exchange Center of Legal Talents after checking personnel archive documents. Personnel having resigned form legal administration shall simultaneously submit the political examination opinions and the testimonial of normal resignation.

（11）Receipt of social insurance payment (pension, unemployment, medical care, public fund);

（12）Other documents: part-time personnel shall submit the testimonial issued by personnel department of the working unit on engagement in legal education or research work and the consent of practicing as a part-time lawyer; overseas personnel shall submit the residence card for returned overseas student or identity certificate of short-time work in the country; graduate college student of the year employed by lawyer’s office shall submit employment report credential; other documents required by judicial administrations.

Lawyer’s category-transfer practicing (part-time lawyer transferred to professional lawyer, professional lawyer transferred to part-time lawyer), still the replicate copy of the original lawyer’s practicing certificate, lawyer’s category-transfer application form.

When an applicant applied for lawyer practicing certificate, documents such as Lawyer practicing certification application form filled by the applicant, the applicant’s lawyer qualification certificate, replicate copy of ID card, etc. shall be delivered to the district/county judicial bureau under affiliation by the lawyer’s office when the applicant works in or transferred to. District/county judicial bureau shall propose preliminary examination opinions within 15 days after receiving the application documents, and report to municipal judicial bureau; Time limit for examination and checking in municipal judicial bureau is 30 days (that is, examine the application documents within 30 days after receiving the application documents, if qualified, issue lawyer’s practicing certificate; if disqualified upon examination, do not issue practicing certificate and notice the applicant).
