What procedures must be followed to apply for an import and export license?

1. Materials that must be submitted to the issuing department in an application for an export license:

(1) Application Form for an Export License containing the seal of the enterprise;
(2) A Copy of the legal export contract;
(3) All types of foreign trade companies that apply for a license for the first time shall submit a copy of the Certificate of Examination and Approval of Qualification.
(4) All types of foreign capital enterprises that apply for a license for the first time shall submit the relevant documents concerning the establishment of the enterprise and the Certificate of Approval.
(5) If the export is entrusted to an agent, the export agency agreement between both parties.
(6) The approval documents issued by the departments concerned:
A. The documents of export quota: the quota document issued by the Ministry of Foreign Economy & Trade or the document of secondary distribution of equal amount issued by local foreign economy & trade commission.
B. The document of tender for the commodity: the documentary evidence of the acceptance of the bid or the transfer of the bid in paid or un-paid tender.
C. The document for the use of commodity with compensation.
D .The approval document for a specific commodity, which is issued by the related department.
E. The approval document issued by the Ministry of Foreign Economy & Trade and local appropriate department for economy and trade and the contract for export goods shall be submitted when the goods are required to be carried with contract work and a complete set of equipment. (The treatment of a tender commodity can refer to relevant regulations).
H. The approval document for processing trade: the approval certificate for processing trade and the document of export quota issued by appropriate departments for economy and trade at all levels.

2. Materials that must be submitted to the issuing department in an application for an import license:

(1) An application Form for an Import License with the seal of the enterprise;
(2) The import agency agreement between the quota holder (the consignee) and the importer;
(3) All types of foreign trade companies that apply for a license for the first time shall submit a copy of the Certificate of Examination and Approval of Qualification.
(4) All types of foreign capital enterprises that apply for a license for the first time shall submit the relevant documents concerning the establishment of the enterprise and the Certificate of Approval.
(5) The approval documents issued by departments concerned:
A. The Quota Certificate for important industrial goods.
B. The Quota Certificate for important agricultural goods.
C. The Quota Certificate for machinery and electrical appliances quota goods.
D. The Registration Certificate for Import in the management of license.
E. The quota certificate for quota goods of foreign capital enterprise for its own use, which is issued by local appropriate departments for economy and trade.
F. The documents for commodities donated by foreign businessmen and overseas Chinese managed by an issuing license: the Certificate of Donation; the identification documents of the foreign businessman and oversea Chinese; The document of acceptance of the donation by the domestic unit (or the Office for Overseas Chinese Affairs) and the approval document of acceptance of the donation issued by provincial People's Government.

3. Procedure for application and receiving:
(1) The enterprise must provide the issuing department with the relevant documents.
(2) The issuing department shall examine and approve the application, make and collate the certificate, affix its seal on it and transmit the electronic data.
(3) The enterprise must receive the certificate, register with the department concerned, and pay the fee.
4. Time limit
The issuing department, within 3 working days, shall complete all the procedures, provided that all the materials are prepared and correctly filled.
