What credentials and materials must be submitted in an application?

The following materials are required to be submitted in application:
(1) A letter of application signed by the president of the board or the general manager which includes a brief introduction of the enterprise; the purpose of establishing the resident representative office; the name of the resident representative office; the list of dispatched personnel (the chief representative, representative), the scope of the business, the residence term, and the office address, etc.
(2) A Copy of the legal opening certificate issued by authorities concerned in the host country.
(3) The Original of the capital credit certificate issued by the corresponding bank.
(4) The certificate of authorization for the appointment of its chief representative and representatives of the resident representative office, signed by the president of the board or the general manager; the resume and identification documents of the chief representative and representatives (in duplicate); if the chief representative is acting as the president of the board, the certificate of authorization shall be signed by more than two directors. If no director's board is set up in the enterprise, the executive director shall sign the certificate and documents concerned.
(5) Complete the Declaration Form for the Establishment of the Resident Representative Office and the Declaration Form of the Personnel in the Resident Representative Office for Foreign Enterprise.

(6) Other materials considered necessary by examination and approval authorities.

l Provisions for labor protection in a foreign capital enterprise
A foreign capital enterprise must comply with the Chinese laws and related legal rules for the protection of labor, industrial hygiene, boiler pressure container safety inspections, and special status of female employees, enforce the protection of workers, and accept the supervision and inspection from labor department at all levels. The enterprise shall apply necessary personnel to manage labor protection, industrial hygiene, and adopt practicable measures to improve the employee's working conditions so as to guarantee the workers' safety and health throughout production procedures. The enterprise is also required to supply workers with appropriate labor protection equipment and nutritious food.
