Directory on applying for the mark for the special use of green foods

Transaction department: Green Food Development Center of Shanghai
Application formalities: applicant enterprises applying for green food mark should submit the following materials:
1. Written report on applying for green food mark;
2. Brief introduction on the enterprise;
3. "Application for Using Green Food Mark"(two copies for one application form);
4. The enterprise should produce report on quality inspection issued by inspection organs above municipal (or provincial) level(original or copies);
5. Copies of business license, trademark registration certificate, hygienic license, certificate on legal person code and those of taxation registration certificate of the enterprise;
6. Product standards from the enterprise (to be put on record by technique supervision departments above county level);
7. Manual of quality management of the enterprise;
8. Operation technical regulations on products and raw materials, and operation technical regulations on processed products;
9. Purchases and sales contract on major raw materials of the product (original, attached with copies of purchases and sales invoices);
10. Present packing and product label of processed product;
11. Copies of pictures of the enterprise, its plant side, equipment, workshops, laboratories, ware house for finished products and pictures of products, etc.;
12. Copies of certificates on reward of the enterprise;
13. Others
The above materials are clear and clean copies in A4 paper, two copies for one document.

Transaction procedures:
1. Applicant enterprises file in an application:
¡¡¡¡Of their own will, enterprises file in an official application to Green Food Development Center of Shanghai, which is to be confirmed by official seals of the enterprise or by signature of its legal person.

2. Contents of preliminary examination:
¢Ù After receiving application from enterprises, Department of certification is to send at least two personnel specially for management work on green food mark to applicant enterprise to inspect its basic condition, conditions of raw material production and supply, and to verify conditions on quality control at the enterprise. After the inspection work and acceptance inspection, Green Food Development Center of Shanghai is to fill in "Form on Investigation of Enterprises and Their Production Conditions" and work out report of comprehensive investigation of the enterprise;
¢Ú Applicant enterprises should submit "Application for Using Green Food Mark"(two copies for one application form) and application materials for certificating enterprises (refer to "IV on application materials for certificating green foods"), submitting both of them to Green Food Development Center of Shanghai;
¢Û Green Food Development Center of Shanghai is to entrust environment detection organ from green food department of Ministry of Agriculture to do surveillance and appraisal on origin of major raw materials of products manufactured by applicant enterprises passing examination;
¢Ü Green Food Development Center of Shanghai will send application materials of the qualified applicant enterprise, report on surveillance and appraisal on environmental quality and comprehensive investigation report to Green Food Development Center of China for verification.
¢ÝGreen Food Development Center of China is to do verification work on application materials, for those proved to be qualified, the Center is to inform Green Food Development Center of Shanghai to do sampling inspection on applied products, and green food department of Ministry of Agriculture is to entrust organs for food inspection to do detection work on the applied food in accordance with standard on green food, then issuing detection report, reporting the report to Green Food Development Center of China.
¢ÞGreen Food Development Center of China is to do final examination work, and those qualified are to sign an "Agreement on Using Green Food Mark"; for those not qualified, whose applications are not to be accepted in the same year;
¢ßGreen Food Development Center of China is to do registration and numbering work on qualified products, and issue certificate on using green food mark, publicizing the result at the same time;
¢àIf applicants are not satisfied with results from environment surveillance and product sampling, they can file in an application for arbitration at Green food Development Center of China. Green food department from Ministry of China is to entrust two or more than two detection organs to do inspection work again and   make the arbitration judgment according to relevant regulations.

Green food applicant enterprises should submit the following materials:
1. Written report on enterprise applying for green food mark;

4. The enterprise should produce report on quality inspection issued by inspection organs above municipal (or provincial) level(original or copies);

The above materials are to be copied in A4 duplicating paper, which should be standard, clean, with two copies respectively for each material.

Charging standard and its basis: according to "Provisional Methods for Fee Collecting for Using Green Food Mark" issued by Ministry of Agriculture in 1994, application fee for each product is 500RMB, fee for examination is 8000RMB(including expenses on spot checking and publicity expenses for each product for three years), advertisement expenditure is to be charged according to actual expense, and fee for using the mark is to be charged in the proportion of 1-2% of sales revenue of products using the mark each year, with its specific sum being negotiated between Green Food Development Center of China with the applicant enterprise.

The transaction is based on: to be done according to relevant management methods on green food standard and procedures on certificating green food issued by Green Food Development Center of Ministry of Agriculture.

Time for transaction: Monday-Friday (9:00- 17:30)
Time limit for transaction: (1) Green food development center of Shanghai is to do registration and numbering work on the same day when they receive written application, and should finish investigation on the applicant enterprise within 2 weeks. If the enterprise is proved to be qualified from the investigation work, the Green food development center is to entrust surveillance department on environment to do surveillance work on environment of the enterprise. Preliminary examination on application materials is to be finished within 5 weeks; for those whose application materials are not complete, they are requested to submit the rest materials within 5 weeks.
(2) Those proved to be not qualified in the investigation or those whose application materials are not up to standard, they are to be informed that their application is not to be accepted in the same year;
(3) After green food development center of Shanghai finishes preliminary examination on application materials, they are to submit the materials to Green Food Development Center of China for first examination (its time limit is to be set by the Center in Beijing).
Applicant qualifications: 1. The applicant enterprise should be a corporate entity;
2. The enterprise have ownership or right of use for trademark of food or agricultural products for which they apply for green food mark;
3. Tthe enterprise have batch production capacity for the food or agricultural product for which they apply for green food mark, with stable quality.
