On Applying for Permit on Operating International Marine Transport Business

Transaction department: accepted by Port Administrative Bureau of Shanghai on behalf of Ministry of Communications, and then submitted to Ministry of Communications for examination and approval after opinions from preliminary examination being proposed

Application formalities: 1. A written application (to download the application form);
2. Notification on Prior Approval of Enterprise Name;
3. A feasibility analysis report;
4. An agreement on investment;
5. Copies of business registration documents of major investors (to be confirmed or notarized by registration organ) or copies of their identity documents;
6. Copies of business registration documents of applicants (to be confirmed by registration organ or to have notarization documents proving the copies are consistent with the original script);
7. Duplicates or copies of certificate on ownership of ship, certificate on ship nationality and those of prescribed examination certificate;
8. Samples of bill of lading, passenger tickets or combined transport document;
9. Copies of business registration documents of parent company (to be confirmed or notarized by registration organ);
10. Copies of "License for Operation of International Marine transport" of the parent company;
11. Documents confirming business scope of the branch office from parent company;
12. At least 2 notarized certificates on professional qualifications of senior line executives (Chinese citizens with professional titles on middle rank or above holding the position of department manager or above) who have the certificate on professional qualifications with an experience of international marine transport for at least3 years working at the companies or offices. 
Those applying to set up legal entity for operation of international shipping transport business should provide materials mentioned in items 1-5, items 7,8, and 12; Chinese legal entities applying for international shipping transport business need to provide materials mentioned in items 1.3,4, 6, 8 and 12; Chinese operators of international marine transport business applying to set up branch offices in Shanghai should provide materials mentioned in items 1-3, and items 9-12.

Transaction procedures:
(¢ñ) To set up enterprises to operate international marine transport business;
(¢ò) Chinese legal entities applying for operation of international marine transport business;
(¢ó) Chinese operators of international marine transport business setting up branch offices in Shanghai.

Applicants for business mentioned in Item (I) applying for an enterprise with Sino-foreign investment or sine-foreign operation file in an application to Ministry of Communications via Shanghai Port Administrative Bureau, and submit relevant application materials (two copies for each document) to Shanghai Port Administrative Bureau; Applicants for Item (I) applying for an enterprise with domestic joint investment and those for Item (II) and (III) file in an application to Ministry of Communications and submit relevant application materials, reporting the materials to Shanghai Port Administrative Bureau. On receiving the materials, Shanghai Port Administrative Bureau does verification work and report relevant opinions to Ministry of Communications. Ministry of Communications is to do verification job after receiving complete application materials, and then decides to approve or not to approve the application. For those getting the approval, they are to be issued with approval document or "Permit on Operating International Marine Transport Business"; for those not getting the approval, they are to be notified in written form and informed of reasons.
