application and does examination and approval work. Application formalities:
I. To set up enterprises to operate international ship management business
1. Application for Operating International Ship Management Business (to
download application form); 2. Notice on prior approval of enterprise
name; 3. A feasibility analysis report; 4. Agreement on investment; 5.
Business registration documents of major investors (copies; official seals are
to be stamped for domestic enterprise and documents of notarization proving the
copies are consistent with the original script are needed) or their identity
documents. II. Chinese entities apply to operate international ship
management business 1. Application for Operating International Ship
Management Business (to download application form); 2. A feasibility analysis
report; 3. Business registration documents of the applicant enterprise
(copies); 4. Certificates of fixed business offices (copies); 5. At least
two notarized certificates on professional qualifications of senior line
executives (Chinese citizens with professional titles on middle rank or above
and holding the position of department manager or above) who have the
certificate on professional qualifications with an experience of international
Marine Transport for at least3 years working at the applicant companies as well
as their labor contracts (copies); 6. Certificates of competency for captain
and chief engineer fit for the work on ship and navigation area to be managed by
the applicant (copies). III. Operators of international ship management set
up branch offices in China for related business 1. Application for Operating
International Ship Management Business; 2. A feasibility analysis
report; 3. Certificates of fixed business offices (copies); 4. Business
registration documents of the parent company (copies); 5. "Certificate on
Qualifications for Operating Supporting Business of International Marine
Transport" of the parent company (copies); 6. Documents for the parent
company confirming business scope of the branch office; 7. At least two
notarized certificates on professional qualifications of senior line executives
(Chinese citizens with professional titles on middle rank or above holding the
position of department manager or above) who have the certificate on
professional qualifications with an experience of international Marine Transport
for at least3 years working at the applicant companies as well as their labor
contracts (copies); 8. Certificates of competency for captain and chief
engineer fit for the work on ship and navigation area to be managed by the
applicant (copies).
Transaction procedures: Charging standard and its basis: Submit

transaction is based on: I. "Regulations on International Marine Transport of
People's Republic of China" Article 11 To operate international ship
management business, the following conditions should be met: (I) At least
two managers out of senior line executives have an experience of international
Marine Transport for over 3 years; (Άς) Having personnel with certificates of
competency for captain and chief engineer fit for the work on ship and
navigation area managed by the applicant; (Άσ) Having equipment and devices
fit for international ship management business. Article 12 To operate
international ship management business, applicant should apply to communications
administrative departments of the province, autonomous region or the
municipality where the business is to be done, submitting relevant materials
prescribed in Item 11 of the Article. Communications administrative departments
of the province, autonomous region or the municipality should finish
verification work within 15 days from the day when application materials are
received. Those submitting complete application materials with true contents are
to be registered and informed of the result; those with uncompleted materials or
untrue contents in the materials are not to be registered and notified in
written form, and also informed of reasons. Article
13 Operators of international Marine Transport, operators of non-vessel
operating carrying transportation business and operators of international ship
agency service as well as operators of international ship management after
getting approval and registration according to the Article, should take relevant
certificates to go through enterprise registration procedures at organs in
charge of enterprise registration work, according to the law. II. "Detailed
Rules on Implementing Regulations on International Marine Transport of People's
Republic of China" Article 8 Chinese legal entities applying to
operate international ship management business or to set up enterprises to
operate international ship management business should file in an application to
communications administrative departments of the province, autonomous region or
the municipality where the business is to be done, submitting the following
application materials: (I) A written application; (II) A feasibility
analysis report and agreement on investment; (III) Business registration
documents of applicants (for those planning to set up enterprises, business
registration documents of the major investors or their identity documents are
needed); (IV) Certificates of fixed business offices; (V) Professional
qualifications certificates of senior line managers prescribed in Item (I) from
Article 11 of "Regulations on International Marine Transport of People's
Republic of China"; (VI) Copies of certificates of competency for captain and
chief engineer prescribed in Item (II) from Article 11 of the
Regulations. After relevant communications administrative departments of
province, autonomous region and municipality receive application materials, they
should do verification work within 15 working days from the day when the
materials are all ready. Those with true contents in their materials and meeting
specifications in Article 11 from "Regulations on International Marine Transport
of People's Republic of China" are to be registered and issued with a
"Certificate on Qualifications for Operating Supporting Business of
International Marine Transport"; those with untrue contents in their materials
or not meeting Article 11 from "Regulations on International Marine Transport of
People's Republic of China" are not to be registered, and are to be notified in
written form, and also informed of reasons. Applicants are to go through
procedures on enterprise registration with their "Certificate on Qualifications
for Operating Supporting Business of International Marine Transport" at organs
in charge of enterprise registration work, and also go through relevant
procedures at banks designated by taxation administrative organ and by foreign
exchange administrative organ. Article 9 Operators of
international ship agency service and those of international ship management
operating corresponding business through their branch offices in China should
meet prescriptions in Article 9 and 11 from "Regulations on International Marine
Transport of People's Republic of China" and go through registration procedures
by following Article 9 and Article 11 from "Regulations on International Marine
Transport of People's Republic of China" and Article 7 and 8 from the "Detailed
Rules of Regulations on International Marine Transport of People's Republic of
China". The registration application materials include the following: (I) A
written application; (II) A feasibility analysis report; (III) Business
registration documents of the parent company; (IV) Duplicate of "Certificate
on Qualification Registration for International Shipping Agent Service" or
"Certificate on Qualifications for Operating Supporting Business of
International Marine Transport"; (V) Documents from the parent company
confirming business scope of the branch office; (VI) Certificates on fixed
business offices; (VII) Certificates on qualifications of personnel
prescribed in Article 9 and 11 from "Regulations on International Marine
Transport of People's Republic of China"; (VIII) Agreement on the company (or
branch offices) doing electronic data exchange with such organs as port and
customs. Those not qualified for doing electronic data exchange should provide
corresponding certificates from relevant ports or customs.
