Article 8  Units and individuals setting up water transport enterprises, water transport service enterprises and those beyond water transport enterprises engaged in profit-making transport business are to be examined and approved by communications administrative departments in accordance with relevant prescriptions of the Regulations and overall balancing conditions of social hauling capacity and freight volume. Examination and approval methods are stipulated by Ministry of Communications.
Article 13  Communications administrative departments issue transport licenses to units and individuals approved to set up water transport enterprises or enterprises for other profit-making transport services beyond water transport; transport service licenses are to be issued to those approved to set up water transport service enterprises. 
Article 14  Units and individuals getting transport license and transport service license apply for business registration to local industry and commerce administrative departments with their licenses, and they can start their business after being verified and getting their business licenses. 
II. "Regulations on Water Transport Management of Shanghai"
Article 7  License system is adopted for profit-making water transport business in Shanghai.
Those to be engaged in profit-making water transport business should follow laws and regulations as well as regulations on water transport issued by the state administrative organs on water transport, and get legal qualification certificate for water transport operation, operating within authorized business scope.
Article 9  Those to set up water transport service enterprises should meet the following conditions:
(I) Having corresponding institutional framework and professional personnel;
(II) Having fixed business ground and necessary facilities for business operation;
(III) Having a registered capital corresponding to business scope.

Applicant qualifications: I. Those having a prescribed registered capital, among which, it is 200,000 RMB for those engaged in marine agency business; it is 300,000RMB for those engaged in transport business of both travelers and goods; it is 500,000RMB for those engaged in both marine agency business and transport business of both travelers and goods at the same time.
II. Having a stable business source for water transport for both passengers and goods.
III. Having an institutional framework and personnel fit for its business scope, among which, those engaged in domestic coastal ship management business must have at least one personnel for maritime affaire or maintenance work holding a certificate of competency above Grade III captain or chief engineer fit for work on ship and navigation area managed by the applicant, and other managerial staff for maritime affairs and maintenance work should have certificates of competency for above the grade of Grade III second mate or second engineer fit for work on ship and navigation area managed by the applicant Those engaged in inland water ship management business must have at least one personnel for maritime affaire or maintenance work holding a certificate of competency for above the grade of second-class ship captain or chief engineer, and other managerial staff should have certificates of competency for above the grade of second mate or second engineer of second-class ship fit for work on ship and navigation area managed by the applicant company.
IV. Having fixed business ground and necessary equipment and devices.
V. Meeting requirements on safety management system, and having a "Certificate of Meeting Requirements on Safety Management System" or a "Temporary Certificate of Meeting Requirements on Safety Management System".   

Approval on non-profit-making water transport units temporarily engaged in profit-making water transport for both freight and

passengers within boundary of Shanghai

V. Valid ship's certificates: certificate on ship inspection, Certificate on Ship Ownership, Certificate on Ship's Nationality, and Certificate on Minimum Staff for Ship Safety (copies);
VI. Description on institutional framework for safety management and safety management system;
VII. Certificate on property right of fixed business ground or lease agreement of fixed business ground (copies).

Article 15  If non-profit-making water transport units of Shanghai are to temporarily operate profit-making water transport business for both passengers and freight within boundary of Shanghai, they should file in an application to Navigational Affairs Department of Shanghai and get approval from water transport administrative department of Shanghai; application for temporarily operating profit-making water transport business for both passengers and freight within boundary of Shanghai is to be handled according to Article 10 of the Regulations.
Term of temporary profit-making water transport business for both passengers and freight must not exceed 1 year.
