Transaction department: Shanghai Port Administrative Bureau accepts the
application and does examination and approval work. Application formalities:
materials needed in application: 1. 3 written applications for
port operation (to download the applications forms); 2. Composition of
management and certificates on ownership or right of use of office
accommodation; 3. Certificates of acceptance inspection on such fixed
facilities as port, warehouse, storage tanks and facilities for sewage
treatment, etc.(including minutes of acceptance inspection meeting and opinions
on acceptance inspection from environmental protection, fire control and quality
supervision departments) and relevant documents on approval of using harbor
frontage; 4. Documents of port facilities in correspondence with business
scope (including design notes in technical data of port facility completion),
plan, layout plan, and recent survey drawing on water depth at dock apron),
certificates on quality control of equipment and port machinery; 5. Ship's
certificates of 使用港作船舶的,有港作船舶; 6. Major management staff in charge of safety
in production have certificates from training program issued by administrative
departments on safety in production of Shanghai; 7. Production operation
rules, safety management system and emergency plans in correspondence with
business scope of the port operation; 8. Post certificates of personnel for
special work in correspondence with business scope of the port operation; 9.
Management structural drawing of the port operation enterprise and contact
methods for managerial staff; 10. According to different categories of
application for port operation, relevant documents and materials as the
following are also needed: (1) To apply to provide such facilities as
dock, lighter anchorage and lifting camel for ships, applicants should provide
plans for treating pollutants and wastes from ships and for corresponding
pollution emergency treatment; (2) To apply to provide profit-making business
of waiting for ship or going on board or going ashore for passengers, applicants
should provide plans on passenger emergency evacuation and emergency
rescue; (3) To apply to provide services of receiving waste and treating
ballast water(including collecting residual oil and sewage), applicants should
provide specification on treatment of waste and ballast water(including
collection of residual oil and sewage); (4) To apply to provide oil
containment boom service, applicants should provide documents on oil containment
boom amount and technical specifications; (5) To apply to do business of port
equipment and machinery lease, applicants should provide certificates on
ownership or lease documents of corresponding equipments and machinery; (6)
To apply for operation of freight for foreign trade, applicants should provide
certificate on opening to the outside world authorized by port administrative
departments and "Appraisal Report on Safety Ensurance of Port Facilities" and
"Plan of Safety Ensurance of Port Facilities" endorsed by the municipal port
administrative department. (7) If ports for military use are to provide
services for port operation for non-military purposes, permit on paid service
for external units issued by military administrative departments is to be
produced.

transaction is based on: I "Law on Port" Article 22 To be engaged in
port operation, applicants should file in a written application to port
administrative departments, and go through procedures for industrial and
commercial registration in accordance with the law. Port operation includes
operation on port and other port facilities, operation of port passenger
transport, loading and unloading, barging and storing freight within port zone,
and tugboat operation at ports, etc. II. "Regulations on Port
Operation Management" Article 7 To be engaged in port operation
(excluding checking at ports), the following conditions should be met: (I)
Having fixed business ground; (II) having port facilities and equipment in
correspondence with business scope; (III) Having specialized
technical personnel and managerial staff fit for business scope.
Article 11 Applicants for port operation (excluding checking at ports)
should file in a written application (sample to be attached) to port
administrative departments and relevant documents and materials described in
Item I from Article 10. Port administrative departments should make a decision
on approving or not approving the application within 30 working days from the
day when they accept the application. Those matching qualification conditions
are to be issued a "Permit on Port Operation" by port administrative departments
(sample to be attached) and publicized on Internet or newspapers; those not
matching conditions are not to be given an administrative permission, and
informed of the decision of not approved for administrative permission as well

port and specifications from laws, regulations and relevant technical
standards; 2. Applicants for providing passengers with services of going on
board or going ashore should have such facilities as waiting rooms and those for
passenger going on board or going ashore equipped with wind, rain or snow
shield; 3. Those providing services for ships of international sea voyage
should have qualifications for opening to the outside world; 4. Those
providing such facilities as dock, lighter anchorage and lifting camel for ships
should be equipped with corresponding capacity for collecting pollutants and
waste from ships as well as capability for pollution emergency treatment,
including necessary equipment and devices. III. Having professional personnel
and managerial staff fit for business scope.
