Examination and Approval of Establishment of Funeral Home, excluding Crematory

Execution authority: Shanghai Funeral and Burial Management Division, authorities for funeral and burial of district/county Civil Affairs Bureau

Application procedure: (I) Written application;
(II) Qualification certificates of the legal representative, managers and technicians to be assigned;
(III) Feasibility report;
(IV) Program design;
(V) Result of examination of governmental planning administration higher than district/county level;
(VI) Result of examination of governmental land administration higher than district/county level;
(VII) Other relevant documents.
Execution procedure:
(I) The district/county Civil Affairs Bureau shall submit the application to municipal Civil Affairs Bureau when it approves the application after primary examination;
(II) The municipal Civil Affairs Bureau shall make the decision within 30 days since receiving the application primarily approved by district/county Civil Affairs Bureau and, if approving the application, submit the application to Shanghai Municipal Government for approval;
(III) The application for establishment of a foreign-capital funeral home shall be submitted to Ministry of Civil Affairs for approval;
(IV) The funeral home to be established upon approval shall be examined, approved and registered at the authorities for industry and commerce, environment protection and fire prevention respectively;
(V) Before beginning the business, the funeral home operator shall submit a written application to municipal Funeral and Burial Management Division, which shall make a decision within 30 days since receiving the application and issue the "Service License of Shanghai for Funeral and Burial" to those qualified with following conditions:
1. Business license issued by the authority for industry and commerce;
2. The construction of funeral home meet the requirements stipulated in "Standards of Design of Funeral Home Construction", No. JIANBIAO [1999] 257, promulgated by Ministry of Construction;
3. The facilities of the funeral home meet the requirements of national and Shanghai regulations on environment protection;
4. Relevant management and technical staff are employed and 50% of professional employees have relevant national incumbency certificates;
5. The main principals obtain the certificate of incumbency issued by Shanghai Funeral and Burial Management Division.

Time limit: The district/county Civil Affairs Bureau shall make a primary decision within 30 days since receiving all valid documents and the municipal Civil Affairs Bureau shall make the decision within 30 days since receiving the application primarily approved by the district/county Civil Affairs Bureau.
Applicant's qualification: (I) Applicant
The legal person or the natural person with full civil capacity.
(II) Conditions for application:
1. The funeral home is designed with annual capacity of corpus over 5000.
2. The area of funeral home is not smaller than 15000 m2.
3. The design of funeral home (location and general layout plan) must conform to the "Arrangement and Layout of Funeral Facilities in Shanghai" and the overall planning of local district/county government, to the "Standards of Design of Funeral Home Construction", No. JIANBIAO [1999] 257, promulgated by Ministry of Construction, and to the requirements of national and Shanghai regulations on environment protection.
4. Relevant management and technical staff shall be employed.
