Application for Establishment of Resident Office for Tourism in Shanghai by Foreign, Taiwan, Hong Kong or Macao Enterprise

Execution authority: Tourism Market Management Division of Shanghai Tourism Management Commission
Application procedure: 1. Recommendation document issued by the international tourist agency that is registered in Shanghai and has at least one-year cooperation in tourism with the applicant enterprise. The recommendation document shall state the basic information of the recommended enterprise, number of tourists to China and arrearage of touring party expense.
2. The written application signed by the chairman of board or general manager of the applicant enterprise, stating the information of resident office, including name, business scope, number of staff, term of business and location.
3. Duplicate copy of business license and written certifications of engagement of tourist business issued by the relevant authority of the county/region where the applicant enterprise registers.
4. Copy of membership certificate issued by the tourism association or any other organization alike of the county (region) where the applicant enterprise registers.
5. Capital credit certification issued by the financial institution with business with the applicant enterprise.
6. Assignment document of chief representative and representatives of the resident office signed by the chairman of board or general manager of the applicant enterprise and resume, photo and identity certification of them.

7. Brief introduction to the applicant enterprise, including business history, achievements, principals, organization structure and the tourist business with China.
8. The application document shall be submitted in four copies and with Chinese version.
Execution procedure: 1. The recommending enterprise, an international tourist agency registered in Shanghai and qualified, shall submit the application to Shanghai Tourism Management Commission.
2. Shanghai Tourism Management Commission shall accept the application and submit the application to State Tourism Bureau upon approval. 3. Upon the approval after examination, State Tourism Bureau shall issue the approval document, stipulating the residence term.
4. The resident office shall handle the registration process and obtain the registration certificate subject to the approval document at the authority for industry and commerce of Shanghai within 30 days since being approved. The foreign staffs and their family members shall obtain the stay permit subject to the approval document at the authority for public security of Shanghai.
5. When planning to change the name, staffs and residence term of the resident office, the enterprise shall submit the written application signed by the chairman of board or the general manager of the enterprise to Shanghai Tourism Management Commission and follow the original process of application. Upon the approval, it shall reregister at the registration authority and renew the stay permit at the authority for public security subject to the new approval document.
6. Dispatched staffs and employed staffs: (1) The number of dispatched staffs shall not exceed 5.
(2) When employing the employee of recommending organization as the representative, the applicant shall negotiate with the recommending organization and report the employment to State Tourism Bureau for approval. If approved, it shall handle the registration process at the appointed foreign affairs service institution and Administration of Industry and Commerce subject to the approval document.
(3) When employing the staff of Chinese governments as the representative, thee applicant shall register the employment at the relevant foreign affairs service institution and report the employment to State Tourism Bureau for approval.

(4) When employing the staff of foreign enterprise service company as the representative, the applicant shall obtain the certification issued by the personnel department of the company and handle the registration process as per regulations.
(5) When employing common employees, the applicant shall follow the regulations on employment by resident office of foreign enterprise.
7. This application procedure applies to the representative office, executive office, business office, liaison office and the resident office with any other name set in China by the foreign, Taiwan, Hong Kong and Macao enterprise.

Time limit: Shanghai Tourism Commission shall examine the application within 30 working days since accepting the application and, if approving the application, submit the application to the State Tourism Bureau for examination and approval.
