Certification of Labor and Employment Service Enterprise

Execution authority: Shanghai Labor and Social Security Bureau
Application procedure: (1) "Application Form for Certification of Labor and Employment Service Enterprise" signed by the legal representative; (2) Duplicate copy of "Business License of Legal Person of Enterprise" (original copy and the photocopy with the official seal); (3) Articles of association (copy); (4) Name list of employees of the labor and employment service enterprise, with the compulsory allocation of employees specified (the term of contract of the allocation of burden-like employees shall be at least one year); (5) Capital assessment report (original copy and photocopy), including the capital assessment report, certification on assessment of capital, table of assessment of capital and subscription record of shareholders; (6)"Shanghai Notification of Payment of Social Insurance Premium" (original copy and photocopy); (7) When an existing enterprise applies for certification of "labor and employment service enterprise", if it has enjoyed the preferential policies to "labor and employment service enterprise", it shall submit the basic information statement (original copy and photocopy with official seal) of the annual accounting statements in previous 6 years before the year applying for certification, or, if it has never enjoyed those preferential policies, it shall submit the basic information statement (original copy and photocopy with official seal) of the annual accounting statements in previous 3 years before the year applying for certification. The base number of former employees shall be the maximum number at the end of the previous 6 years or 3 years. For the enterprise cannot submit the basic information statement of the annual accounting statement, it shall submit the "List of Three Expenses in Salary and Welfare" (original copy and photocopy with official seal) of the "Annual Declaration of Enterprise Income Tax"; (8) Other documents required by Shanghai Labor and Social Security Bureau.

Execution procedure:
¡¡¡¡1. The applicant enterprise shall fill in "Application Form for Certification of Labor and Employment Service Enterprise" and submit it with other required documents to its senior superintendent authority. The enterprise that has no senior superintendent authority shall submit the application documents to the local district/county authority for labor and social security. 2. Upon the approval, the senior superintendent authority shall submit the application documents to the peer authority for certification of labor and employment service enterprise. 3. District/county Labor and Social Security Bureau shall submit the application documents to the municipal Labor and Social Security Bureau upon approval of these documents. 4. The municipal Labor and Social Security Bureau shall examine and approve the labor and employment service enterprise.

¡¡¡¡The municipal Labor and Social Security Bureau shall make decision within 20 working days since accepting the application.

Applicant's qualification: The newly established enterprise shall meet following requirements besides being registered at the authority for industry and commerce: (1) with 10 million yuan capital (the enterprise with over 10 million yuan capital but a good allocation of the people hard to be employed shall be taken into joint examination and certification by the municipal Labor and Social Security Bureau and municipal Local Taxation Bureau); (2) with a staff more than 5 but less than 300 (including this number); (3) the burden-like employees allocated at the current year accounting for 50% of the total employees; (4) with the newly allocated burden-like employees accounting for over 50% or 20% of the total employees based on the number of employees at the time when the enterprise applies for certification (the year that the enterprise has the most employees during the period that the enterprise enjoys the tax exemption or tax reduction) for the enterprise already established or enjoying the preferential policy to labor and employment service enterprises, besides above stipulations.
