Approval of Postponed Payment of Social Insurance Premium by Organization

Execution authority: Shanghai Labor and Social Security Bureau
Application procedure: 1. Written application for postponed payment of social insurance premium, stating the reasons for such postponement, the term of postponement and the repayment schedule;


2. Relevant documents to explain the postponement;

(1) Bankruptcy sentence issued by the court
(2) Finance statements of the organization;
(3) Relevant documents issued by the municipal government approving the postponed payment.

3. Real estate ownership certificate and relevant structure map of the house.

Execution procedure:
¡¡¡¡1. The organization to pay the premium shall submit the written application to the district/county social security center and fill in the "Application Form for Postponed Payment of Social Insurance Premium", in five copies;
¡¡¡¡2. The district/county social security center shall check the completeness and qualification of submitted documents and confirm the sum of social insurance premium to be postponed for payment;
¡¡¡¡3. The municipal Labor and Social Security Bureau shall take field investigation of the real estate mentioned in the application and ask for the planning;
¡¡¡¡4. The organization that plans to postpone the payment of social insurance premium shall employ the eligible real estate evaluation organization, with relevant qualification certification, to evaluate the real estate subject to the notification of the municipal Labor and Social Security Bureau;
¡¡¡¡5. The organization to pay the premium shall get its real estate registered at the municipal, local/county trade center in charge of its real estate subject to the notification of the municipal Labor and Social Security Bureau;

Duration of service: 9:00-11:30 and 13:00-16:30 from Monday to Friday 

Time limit:  The municipal Labor and Social Security Bureau shall make decision and issue the "Approval of Application for Postponed Payment of Social Insurance Premium" within 10 working days in response to the organization that applies for postponed payment of social insurance premium and has its real estate registered.

Applicant's qualification: 1. The organization to pay the premium but failing to payment the social insurance premium in full sum upon any of following conditions shall apply to the municipal Labor and Social Security Bureau for postponed payment, with agreement of the employees' conference or labor union: 

(1) The organization to pay the premium but sentenced in the process of bankruptcy by the court;


(2) The organization with suspension of production or continuous loss for over one year or close to bankruptcy;

(3) Other organizations approved by the municipal government.

2. The organization to pay the premium shall present the relevant real estate ownership certificate when applying for postponed payment of social insurance premium.

The organization to pay the premium and with sole ownership of the real estate shall have the right to apply for postponed payment; the organization to pay the premium but without sole ownership of the real estate shall apply for the postponed payment together with the third party that also has the ownership of the real estate.

The real estate used for postponed payment shall be free from any other liability or sequestration or freezing of judicial authority.

3. The term of postponed payment shall be not longer than one year at most.
