Where are the labour contracts deemed void?

The labour contracts shall be deemed void where (1) they are against the laws and administrative regulations; and/or (2) they are concluded by means of fraudulence or threat.

The void labour contracts are not legally binding to both parties upon their conclusion. Where part of the labour contracts are affirmed void, the remaining part whereof shall be valid if their effects are not impacted.

The nullity of the labour contracts shall be affirmed by the labour disputes arbitration commission or the people's courts.
