Where can the labour contracts be terminated?

The labour contracts can be terminated where any of the following cases occurs.

I.The labour contracts shall be terminated upon

(a) expiration of the periods of the labour contracts;

(b) occurrence of any of the termination conditions defined by both parties involved wherein;

(c) bankruptcy, dissolution or cancellation of the employers; or

(d) retirement, resignation or death of the labourers.

II.The labour contracts can be terminated where the non-performance of the labour contracts by the either party involved wherein has been up to three months.

III.The labour contracts can be terminated where the labourers are confirmed to have partially lost their labour ability due to occupational diseases or work-related injuries and the employers have, upon expiration of the labour contracts, paid the employment subsidies for the disable in accordance with the applicable laws and regulations.
