In China, the standard working-hour system is 8 hours per day and 40 hours
per week on average, at the most.
For employees paid with a partial wage, the employer should determine the
workload and standard of the partial wage properly, according to the national
working-hour system.
Employers must guarantee the employees at least 1 day of rest per week.
In the case of the employer needing to extend the working hours due to
production necessities, it must negotiate this with the labor union and the
employees concerned. In general circumstances, the extended time cannot exceed 1
hour. In the case of the working hours needing to be extended for special
reasons, the extended work cannot harm the health of the employees concerned nor
exceed an additional 3 hours per day or 36 hours per month.
For enterprises that cannot take the standard working-hour system due to the
character of their operation or production, they can adopt the non-fixed
working-hour system or the comprehensive working-hour system according to their
actual situation, and have it approved by the administrative government
department for labor protection.
