Question: This May holiday, the company I work for requires me and other
employees to work during the holiday to check the equipment, and they promised
to give us two days off in lieu. Is this correct practice?
Answer: This is not correct practice. According to China¡¯s Labor Law, the
employer shall compensate employees for working overtime. Therefore, the
employer shall give extra days off as compensation if it requires employees to
work on their days off. If the employer requires its employees to work overtime
during holidays, it shall pay compensation in cash. Employees who work extra
time shall receive an overtime salary that is no less than 150% of their
standard hourly salary. Employees who work during their holidays shall receive
overtime salary that is no less than 300% of their standard hourly salary.
