According to the applied provisions in the Trust Law of the People’s Republic of China, all of the following three prerequisites shall be satisfied to establish a trust:

(1) A legitimate purpose of the trust must be served;

(2) there must be certain trust properties and the properties must be properties lawfully owned by the trustor, and

(3) a written form must be adopted.
