Procedures of application for filing and registration of foreign trade dealers in Shanghai

I) According to the applied provisions in the Foreign Trade Law of the People’s Republic of China (hereinafter referred to as the Foreign Trade Law), foreign trade dealers refer to any and all of legal entities, other organizations, or individuals who have registered in the industrial and commercial administration or completed other formalities necessary for foreign trade practicing according to law and are engaging in foreign trade dealings in compliance with the provisions of the Foreign Trade Law and other applied laws and/or administrative regulations.

II) Shanghai Municipal Foreign Economic Relation and Trade Commission is, under authorization by Ministry of Commerce of the People’s Republic of China, responsible for formalities necessary for application for filing and registration of foreign trade dealers in Shanghai. Any and all of enterprise or individual applicants intending to engage in import and export businesses of goods and technologies shall, upon completing formalities necessary for change of business scope or for new industrial and commercial registration in the competent industrial and commercial administration, go to Shanghai Municipal Foreign Economic Relation and Trade Commission to complete formalities necessary for application for filing and registration of foreign trade dealers.

III) Procedures:

Online filling in the Application Form for Filing and Registration of Foreign Trade Dealer in Shanghai.

Upon completing of the above online Application Form, the following materials required for such application shall be submitted to Shanghai Municipal Foreign Economic Relation and Trade Commission at Room 1403, New Town Mansion, No. 55, Loushanguan Road, Shanghai:

1. the signed and/or sealed Application Form for Filing and Registration of Foreign Trade Dealer in Shanghai;

2. the xerox copy of the business license;

3. the xerox copy of the certificate for code of the organization/institution;

4. xerox copy of the valid personal ID certification of the enterprise’s legal representative;

5. xerox copy of the certificate of approval of the foreign investment venture in case the foreign trade dealer is a foreign investment venture; and

6. the supporting materials for property notarization issued by the competent public notarial authority in case the applicant is a small industrial or commercial business (individual proprietor) lawfully registered in the industrial and commercial administration, or the supporting materials for fund credit issued by the competent public notarial authority in case the applicant is a foreign business lawfully registered in the industrial and commercial administration.

Shanghai Municipal Foreign Economic Relation and Trade Commission will, within 5 working days upon receipt of the required materials submitted by the applicant, complete process of such filing and registration and issue the Form for Filing and Registration of Foreign Trade Dealer (Office Hours: AM 9:30 through PM 4:30 on Mondays, Wednesdays, and Fridays; Telephone No.: 62754440 and 62195869).

IV) The applicant may download the same Form for Filing and Registration of Foreign Trade Dealer from the official site of Ministry of Commerce of the People’s Republic of China, and, upon completing filling-in, submit the Form with the above required materials to Shanghai Municipal Foreign Economic Relation and Trade Commission for completing formalities necessary for such application for filing and registration.
