Ever since China opened up to the world in 1980's, the Shanghai Municipal Government, led by the Communist Party of China and the State Council, makes great effort to build the city into an international economic, financial, trade and shipping center. Shanghai will cancel 36 administrative licenses in order to make her local regulations in line with Law on Administrative Licenses

Information from the 13th Session of the Standing Committee of the Municipal People's Congress convened on June 21st, 2004 reveals that 36 administrative licenses, ranging from review and issue of production permission of important products and review and approval of suspending articles on street trees to review and approval of establishment of the permanent survey mark, set up upon Shanghai's local regulations will be canceled along with the enforcement of the Law of the People's Republic of China on Administrative Licenses in Shanghai.
According to introduction by Legislative Affairs Commission of the Standing Committee of the Municipal People's Congress, under the Law on Administrative Licenses, totally 36 administrative licenses set up upon Shanghai's local regulations are not in conformity with provisions of this Law. Inconformity is mainly in three aspects. Firstly, the created administrative licenses are those which shall not be independently created by local government, e.g. the preposition license on incorporation of enterprises or other organizations, and on qualifications of citizens, legal persons or other organizations the configuration of which shall be unified by the state. Secondly, the created administrative licenses restrain individuals or enterprises from other parts of China from entering into Shanghai to operate production or provide services, or restrain commodities from other parts of China from entering into Shanghai. And thirdly, the created administrative licenses are those which added to the administrative licenses set up by the upper law.
In addition, the Shanghai Municipal Government has, upon due liquidation, sorted out that 12 administrative licenses created under the rules whereof are those which are truly needed by the current administrative management and are necessarily continued in practice, according to introduction by the Legislative Affairs Office of the Municipal Government.
