Shanghai Municipal Human Resources and Social Security Bureau

Shanghai Municipal Human Resources and Social Security Bureau is established as one of the departments of the municipal government in accordance with the “Notice of the General Office of the CPC Central Committee and the General Office of the State Council on Printing and Distributing ‘Plan on Reform of Organs of Shanghai Municipal People’s Government’” (Ting Zi [2008] No. 17). Shanghai Municipal Human Resources and Social Security Bureau hangs out a temporary signboard designating Shanghai Municipal Administration of Foreign Experts Affairs and Shanghai Medical Insurance Office.

Main Functions

1. to implement laws, rules, regulations, guidelines and policies regarding human resources and social security; to study and draw up drafts of local rules and regulations regarding human resources and social security, and organize to implement related local rules and regulations; to draft, organize to carry out, supervise and examine the development plans and policies for the municipality’s human resources and social security;

2. to draft human resources market development plans and human resources flow policies, promote to establish an integrated and standardized human resources market, and promote the rational flow and effective allocation of human resources; to take charge of administration over overseas personnel’s employment in the municipality; to take charge of administration over talent introduction into Shanghai;

3. to take charge of employment promotion through drafting plans and policies for urban and rural employment development, improving the public employment service system, planning the employment aid system and encouraging business start-ups to create more employment opportunities; to improve the occupation qualification system, establish an unified vocational training system geared to urban and rural areas and cooperate in drafting employment policies for university and college graduates; to cooperate with relevant departments in serving the whole country through talents; to cooperate with relevant departments in drafting cultivation and incentive policies for highly-skilled talents and rural practical talents;

4. to cooperate with relevant departments in drafting policies on wage and income distribution for personnel of public institutions, establishing the regular pay increase and payment security mechanism for personnel of public institutions, and drafting the welfare and retirement policies for personnel of public institutions; to draft macro-control policies on wage and income of enterprises’ employees and improve the minimum wage system and wage payment security system;

5. to draft overall labor and personnel dispute mediation and arbitration stipulations as well as policies on labor relation coordination, improve labor relation coordination mechanism, formulate policies against illegal employment of child labors and special labor protection policies for female and underage workers, organize to carry out supervision over labor security; to coordinate the work of protecting laborers’ rights, and investigate and punish violations;

6. to cooperate with relevant departments in guiding personnel system reform of public institutions, and draft policies on management over public institutions’ personnel and service personnel of government departments; to participate in talent management through formulating policies on professional and technical personnel’s management and further education, taking the lead in deepening the reform on appraisal and professional title system for professional and technical personnel, improving postdoctoral management system as well as selecting and cultivating high-level professional and technical talents;

7. to take charge of administration over the work or settlement in China of foreign (overseas) talents, experts and students abroad, draft policies to attract foreign (overseas) talents, take charge of coordination work of dispatching non-educational-system students to study abroad (overseas) and settling them after they return to China, and take charge of reviewing and administrating outbound training groups and personnel;

8. to cooperate with relevant departments in drafting policies on and plans of allocation of demobilized soldiers, take charge of educating and training demobilized soldiers, organize to draft the policies to overcome difficulties and stabilize demobilized soldiers of some enterprises, and take charge of administrating and providing services for demobilized soldiers selecting jobs for themselves;

9. to take charge of comprehensively managing public servants for administrative organs, draft policies on personnel assignment and special personnel allocation, cooperate with relevant departments in drafting the municipality’s honor system and government incentive system, and cooperate with relevant departments in carrying out evaluation on public servants’ performance;

10. to cooperate with relevant departments in drafting comprehensive policies on and plans of the work regarding migrant workers, promote the implementation of policies related to migrant workers, coordinate to solve the major and difficult problems, and safeguard migrant workers’ lawful rights and interests; to undertake the routine work of the Shanghai Municipal Office of Joint Conference on Migrant Workers Affairs;

11. to establish an overall social security system covering urban and rural areas; to draft overall policies and standards for urban and rural social insurance and supplementary insurance, policies on transfer and connection of social insurance accounts and overall basic pension insurance policies for government departments, enterprises and public institutions as well as other social organizations and personnel; to cooperate with relevant departments in drafting a system on managing and supervising social insurance funds and supplementary insurance funds, organizing to prepare drafts of budgets and final statements of social insurance funds and doing a good job in supervising and managing value maintenance and appreciation of social insurance funds in accordance with stipulations;

12. to take charge of drafting administrative measures on the payment standards related to basic medical insurance, work-related injury insurance and maternity insurance, scope of diagnostic items, medicines and service facilities, expense settlement and review of designated medical institutions, take charge of administrating and supervising medical treatment covered by basic medical insurance, and take charge of reform on payment of medical insurance fund; to cooperate with relevant departments in studying and drafting policies regarding medical system reform;

13. to take charge of the prediction, warning and information guidance concerning employment, unemployment and social insurance funds, draft contingency plans, implement prevention, adjustment and control measures, maintain the stable employment situation and overall balance of social medical insurance funds;

14. to take charge of the acceptance and hearing of relevant administrative reviews and responses to administrative proceedings;

15. to undertake other tasks assigned by the municipal government.
