What are the rights of enterprises or individuals that are approved to develop and utilize tidal shoal areas?

Following are the legitimate rights of enterprises or individuals that are approved to develop and utilize tidal shoals:

(1) They can apply for the License for the Use of State-owned Land;

(2) the acquired land can be transferred, leased or mortgaged for other business operations during the validity of the license;

(3) economic compensation will be given to those who enclose tidal shoal areas for farming purposes and for the construction of key supporting farming facilities;

(4) those who enclose tidal shoal areas for agricultural purposes can benefit from agriculture tax for a certain number of years;

(5) those who enclose tidal shoal areas for public interests do not have to pay the tidal shoal usage fee;

(6) reasonable compensation shall be paid to the original developer and user of a tidal shoal area in case of the confiscation of tidal shoal usage rights, and

(7) enterprises or individuals that have contributed tremendously to the protection, development and research on tidal shoal resources shall be praised in public and honored by municipal, district or county level government or water affairs authorities.
