What are the procedures for starting construction projects within the administration area of watercourses?

There are two necessary procedures before starting construction projects within the administration area of watercourses in Shanghai.

1. Obtaining the approval from a watercourse administration authority on planned construction projects within the administration area of watercourses is needed.

2 Obtaining the approval from a watercourse administration authority on the actual construction of a project within the administration area of watercourses is needed.

The legal basis for the first procedure is Article Eighteen (18) of the Regulations of the Shanghai Municipality on Watercourse Administration. The construction company shall submit an application for the project within the administration area of the watercourse to the Shanghai Municipal Watercourse Administration Department, or district/county watercourse administration departments for approval.

The legal basis for the second procedure is Article Nineteen (19) of the Regulations of the Shanghai Municipality on Watercourse Administration. Before the actual construction begins on a project within the administration area of watercourses that has been approved, the construction company shall submit the construction plan to the Shanghai Municipal Watercourse Administration Department, or district/county level watercourse administration departments and finish all construction before the deadline.

Procedure details and processes: the construction company shall submit an application; approval is obtained from the watercourse administration authorities and the Approval of Construction is issued; application for the Construction License is made; checking of the final design and construction plan; issuing the Construction License after approval; the supervision and check-up of the construction project; the construction company submits the project completion documents.
