Yang Xiong: Shanghai Prepares to Establish Intellectual Property Court and Seeks Institutional Innovations

    The Shanghai International Intellectual Property Forum, jointly sponsored by the Shanghai Municipal People’s Government and the World Intellectual Property Organization (WIPO) for the first time, opened in the city on December 8. Yang Xiong, mayor of Shanghai and Shen Changyu, commissioner of the China State Intellectual Property Office, attended the opening ceremony and delivered addresses. Francis Gurry, director general of the WIPO, made a keynote speech. Wang Binying, deputy director-general of the WIPO and Zhao Wen, vice-mayor of Shanghai attended the forum.

    Before the opening of the forum, Yang Xiong met with Francis Gurry and his party, and they together signed a memorandum of understanding on behalf of the Shanghai government and the WIPO respectively.

    In his speech, Yang Xiong said that intellectual property (IP) is an important resource for development and a core factor in competitive power. Shanghai always attaches great importance to IP work. It has implemented two rounds of IP strategic outlines in recent years focusing on IP creation, use, protection and management. This year, we have carried out explorations into institutional reforms in IP administration and law enforcement and made preparations for the establishment of Shanghai Intellectual Property Court and China (Shanghai) Pilot Free Trade Zone Intellectual Property Court. We have also explored ways of IP institutional reforms to provide a firm backing for innovations and starting of businesses. To protect IP is to protect innovation, and good use of IP can provide inspiration for innovation. In speeding up the implementation of an innovation-driven development strategy and building itself into a scientific & technological innovation center with a global impact, Shanghai must firmly focus on IP use and protection, unswervingly promote IP-related reform and innovation, and create a more favorable legal, market and cultural environment for IP. The memorandum of understanding signed with the WIPO will stand a new historical starting point for Shanghai to enhance its IP work level.

    In his address, Shen Changyu said that in today’s world, economic globalization is intensifying, knowledge economy is surging, and IP is becoming more and more a common topic of the countries in the world. In recent years, with the implementation of its IP strategy, China has scored gigantic achievements in IP endeavor and ushered in an opportune period for a new round of strategic development. We will carry out intensively the country’s IP strategy, strive for an IP power, promote the booming of innovation and business startup and upgrade “Made in China” with wisdom. As a pacesetter in reform and a pioneer in scientific development of our country, Shanghai plays the role of a guider, demonstrator and leader in IP and other areas. He believed that the forum will vigorously promote the development of Shanghai’s IP undertaking, and hoped that through exchange, learning from one another and expanding cooperation, the participants will better push forward the development of IP cause, and innovation and creation will benefit the peoples of all countries.

    At the two-day forum, government officials, experts and scholars from many countries and regions in the world will, centering on the topics of “Latest International IP Development Trends and Characteristics”, “IP Use and Value Realization” and “IP Protection at the Free Trade Zone”, share and explore international experience and practical wisdom in IP management, use and protection, and provide useful reference for Shanghai to further foster IP value realization and improve IP protection at the free trade zone.
