Shanghai Municipal Housing Security and Administration Bureau

    Shanghai Municipal Housing Security and Administration Bureau was set up as a department directly under the municipal government in accordance with the “Notice of the General Office of the CPC Central Committee and the General Office of the State Council on Printing and Distributing ‘Plan on Reform of Organs of Shanghai Municipal People’s Government’” (Ting Zi [2008] No. 17).

    Main Functions

    1. to implement laws, rules, guidelines and policies on housing security, housing construction, housing system reform, real estate market supervision and housing administration; to study, draft and implement local laws, regulations and policies on housing security, housing construction, housing system reform, real estate market supervision and housing administration;

    2. to study, formulate and organize to carry out professional plans for housing security and housing industry development in line with the municipality’s overall plan for national economic and social development;

    3. to promote the implementation of the national housing industry technical standards and industry norms, and comprehensively coordinate and promote the modernization of the municipality’s housing industry and the development of a energy-and-land-saving housing industry; to organize to study and formulate technological advancement plans and policies for housing industry; to participate in reviewing detailed planning schemes for residential bases, examining and approving development designs and specifying construction indexes in land bidding, auction and listing documents;

    4. to take charge of compiling development plans for housing security, construction, completion and supporting facilities; to cooperate with the municipality’s relevant departments in compiling and adjusting the municipality’s standards for residential design and residential districts’ public service facilities, organize to carry out them after they are approved by the municipality’s relevant departments, and supervise and inspect the implementation;

    5. to take charge of establishing and improving the municipality’s housing security system, formulate policies on housing allocation system reform and on sale and lease of public housings, as well as compile and organize to carry out annual working plans for indemnificatory housings;

    6. to take charge of managing housing quality and performance within the municipality; to examine and approve the commissioning of new residences; to supervise and examine district and town residential construction administrations’ review and certificate issuing regarding the commissioning of new residences; to cooperate with the municipality’s relevant departments in reviewing or recording the qualifications of residence developers and project supervision institutions;

    7. to formulate and supervise the implementation of systems regarding the municipality’s housing mapping, housing ownership registration and housing ownership administration; to take charge of administration affairs such as housing mapping as well as registration, certificate issuing and filing of housing ownership; to establish and manage a unified housing ownership information system;

    8. to organize to carry out monitoring analysis on real estate market as well as to establish, improve, and organize to implement real estate market information system and early warning and forecasting system within the municipality; to organize to draft and supervise the implementation of policies and measures for a stable real estate market; to take charge of supervision over real-estate development, transactions and capitals, administration of house tenancy, and administration of real estate development, assessment and brokerage within its jurisdiction;

    9. to take charge of administrating property management industry; to guide and supervise owners’ committee’s operation and residential maintenance fund management;

    10. to take charge of administrating the renovation, alternation and safety appraisal of residences; to promote projects of old area renovation; to protect and administrate excellent historical buildings; to supervise and administrate the assets of the state-owned properties directly under its control as entrusted by the Shanghai Municipal State-Owned Assets Supervision and Administration Commission; to implement policies on private houses, solve private-house issues left over from the past and hold religion properties under custody; to cooperate with the municipality’s relevant departments in perfecting the functions of completed residences;

    11. to formulate and supervise the implementation of the municipality’s rules and regulations on housing levy, demolition and relocation; to take the lead in formulating and supervising the implementation of housing demolition and relocation plans and annual demolition and relocation plans; to review and issue administrative permits for housing demolition and relocation, establish an information system for supervision over housing levy, demolition and relocation, and organize to coordinate in investigations on and punishments for illegal demolition and relocation;

    12. to organize, guide, coordinate, and supervise the administrative law enforcement concerning housing construction, real estate market and property management; to make administrative punishments on unlawful acts, and solve the housing ownership disputes according to law;

    13. to take charge of the work of science, technology and education concerning housing security and administration; to organize and coordinate the system’s informatization construction;

    14. to take charge of the statistics of and analysis on real estate market, housing security and administration, timely submit or provide development trend and information to the municipal government, relevant departments and the society;

    15. to participate in administrating funds for housing security and administration; to participate in adjusting public housing rents; to collect charges of residence supporting projects, and use and administrate the charges according to the approved annual plans;

    16. to take charge of the acceptance and hearing of relevant administrative reviews and responses to administrative proceedings;

    17. to undertake other tasks assigned by the municipal government.
