​Implementation Opinions of Shanghai Municipal People's Government on Further Improving the Work of Stabilizing Employment and Promoting Development

Attention: All District People’s Governments, and all Commissions, Offices and Bureaus of the Municipal People’s Government:

In order to implement the important directive spirit of General Secretary Xi Jinping on doing well the work of "Six Stability" and "Six Guarantees", now the following Implementation Opinions are put forward for further improving the work of stabilizing employment and promoting development in accordance with the demands of the Opinions of the State Council on Further Improving the Work of Stabilizing Employment and Promoting Development (SC G [2019] No. 28) and the Implementation Opinions of the General Office of the State Council on Coping with the Impacts of Novel Coronavirus Pneumonia and Strengthening the Measures of Stabilizing Employment (SC G [2020] No. 6).

 

I. Strengthening the Efforts to Protect the Market Subjects

 

1. Strengthening efforts to alleviate burdens and stabilize employment. The policies and measures will be implemented to prevent and control the epidemic, support and serve the enterprises for their steady and healthy development, the policies of periodical reduction and exemption of enterprises’ social insurance premium will be carried out, and the implementation periods of the periodical reduction policies will be extended to April 30, 2021. The enterprises supporting epidemic prevention and control during the Spring Festival and the enterprises in difficult industries affected by the epidemic will be given subsidies. The implementation periods of subsidy policies for on-the-job training of employees in difficult enterprises will be extended to December 31, 2020. Before the end of June 2020, the payment of wage deposits for the construction project migrant workers will be allowed to suspend, and the enterprises with good payment records may be exempted from such payment. For some projects with strong employ ability and controllable environmental impacts, a positive list of EIA approval will be formulated, and the reform of "release, management and service" of EIA will be strengthened. The costs of electricity, gas and logistics will be reduced. 2. Strengthening financial support. The People's Bank of China's special re-loan policies of supporting small-sized enterprises and agricultural units will be implemented, and banks will be supported to increase the supply of inclusive financial credits. Banks will be encouraged to improve the performance appraisal and incentive mechanisms of financial services for private, micro, small and medium-sized enterprises, and increase medium and long-term loans and credit loans for micro, small and medium-sized enterprises in the manufacturing industry. The commercial banks will be guided to actively launch financing and loan renewal products. For micro, small and medium-sized enterprises, the scales of financing guarantee business will be expanded, the financing guarantee rates will be reduced, and the financing guarantee service will be optimized. Credit risk compensation and credit incentive policies will be implemented for micro, small and medium-sized enterprises. Banks are encouraged to formulate special credit plans for key enterprises. 3. Guiding the development of domestic market. Comprehensive service platforms across departments will be set up to strengthen the integration of enterprise production and marketing, and extend the industrial chains within the country by way of government procurement, encouraging research and development, etc. Enterprises will be supported to connect with major domestic e-commerce platforms and bulk procurement projects in various industries and regions, new formats and new models of online shopping, online education, online office, online service, digital life, and intelligent distribution will be cultivated and supported, and sales channels in the domestic market will be developed. (the Municipal Economy and Information Technology Commission, the Municipal Commerce Commission and the Municipal Finance Bureau shall be responsible according to the division of their responsibilities.)

4. Standardizing the layoff acts. The collective negotiation between enterprises and employees will be supported to maintain the labor relationship by adopting measures such as salary negotiation, adjustment of working hours, post and day off rotation, on-the-job training, etc. For enterprises that plan to lay off employees due to economic reasons, they will be guided to formulate and implement employee placement plans in accordance with laws and rules. For the workers who cannot return to posts to provide normal labor temporarily due to novel coronavirus pneumonia, enterprises shall not be allowed to terminate the labor contracts or return labor dispatch. ( the Municipal Human Resources and Social Security Bureau shall assume the leading role for responsibilities.)

5. Strengthening the support for individual businesses. The policy of reducing the VAT collection rate of small-scale taxpayers from 3% to 1% will be implemented. Individual businesses that participate in endowment insurance, unemployment insurance and industrial injury insurance as units will enjoy the exemption and reduction policy with reference to micro, small and medium-sized enterprises. Financial institutions will be guided to increase the issuance of low interest loans and provide targeted support to individual businesses. It will be encouraged to support leasers to reduce and remit the property rents for individual businesses by means of reducing and exempting urban land use tax. The online registration of individual businesses will be promoted, and the application of electronic business licenses and official seals of individual businesses will be supported. (the Municipal Human Resources and Social Security Bureau, the Municipal State-owned Assets Supervision and Administration Commission, the Municipal Market Supervision Bureau, the Municipal Taxation Bureau, the Municipal Local Financial Supervision Bureau and the Municipal Finance Bureau shall be responsible according to the division of their responsibilities.) 

II. Creating More Jobs with Multiple Measures

 

6. Tapping domestic demands to boost employment. The pilot project of "pace-setter" for improving the quality and capacity of home service industry will be promoted, the prosperity and development of cultural and creative industries will be boosted, the distribution of tourism resources will be optimized to expand service supply, the development of the pension industry will be accelerated, the updating consumption of automobiles, household appliances and consumer electronics products will be encouraged, the domestic service outsourcing markets will be cultivated to create jobs. (the Municipal Economy and Information Technology Commission, the Municipal Development and Reform Commission, the Municipal Commerce Commission, the Municipal Bureau of Culture and Tourism, and the Municipal Civil Affairs Bureau shall be responsible according to the division of their responsibilities.)

7. Increasing investment to create jobs. The employment impact assessment of major industrial and institutional investment projects will be carried out to clarify the employment objectives, and full consideration will be given to the employment driving factors of government investment projects. More jobs will be created by accelerating the transformation of old areas, the construction of urban parking facilities and the construction of national logistics hub networks. 8. Stabilizing foreign trade to expand employment. The ways to further reduce institutional costs will be explored. The coverage of export credit insurance will be expanded and the premium will be reduced reasonably. Guidance will be given to enterprises to enhance their bargaining power and legal service institutions will be encouraged to provide public welfare legal services. International marketing service systems will be set up, the construction of cross-border e-commerce comprehensive pilot zones will be accelerated to expand and strengthen the comprehensive foreign trade service enterprises, and stabilize the employment of foreign trade enterprises. (the Municipal Commerce Commission, the Municipal Justice Bureau, the Shanghai Customs and the Shanghai Banking and Insurance Regulatory Bureau shall be responsible according to the division of their responsibilities.)

9. Cultivating and expanding new momentum to expand employment space. The Action Plan for Promoting the Construction of New Infrastructure in Shanghai (2020-2022) will be conscientiously implemented, the construction of new generation network infrastructure (new network), innovative infrastructure (new facility), integrated infrastructure (new platform), and intelligent terminal infrastructure (new terminal) will be vigorously carried out to create employment opportunities. The implementation opinions to promote the normative and healthy development of the Municipality's platform economy will be formulated to promote the platform economy so as to form new development advantages and expand employment channels. (the Municipal Development and Reform Commission, the Municipal Economy and Information Technology Commission and the Municipal Commerce Commission shall be responsible according to the division of their responsibilities.) 

III. Broadening Channels to Ensure Residents' Employment

 

10. Encouraging employing units to absorb people for employment. The employment units of this Municipality that have absorbed those with registered unemployment for more than 6 months or the college graduates of this Municipality in the year of graduation will be given a one-time employment subsidy in accordance with the relevant provisions, and the implementation period will last till December 31, 2020. The government's purchase of social organization services will be increased to give full play to the roles of social organizations in absorbing people for employment, stabilizing employment and ensuring people's livelihood. (the Municipal Human Resources and Social Security Bureau, the Municipal Education Commission, the Municipal Civil Affairs Bureau and the Municipal Finance Bureau shall be responsible according to the division of their responsibilities.)

11. Supporting entrepreneurship to promote employment. The application requirements for business startup guarantee loans will be lowered, that is, the proportion of those with this Municipality’s registration to be employed shall not be less than 15% (the proportion of employees with more than 100 employees will be lowered to 8%). The recommendation mechanisms of credit villages, credit parks and demonstration carriers of entrepreneurial incubation will be established so that the enterprises applying for entrepreneurial guarantee loans may be exempted from providing counter guarantee of mortgage and pledge. The high-quality incubation carriers such as "mass entrepreneurship and innovation" demonstration bases and professional mass innovation spaces will be guided to undertake relevant public service affairs. Actions will be taken to improve the abilities to start businesses back home. For those who start their business back home for the first time and their businesses have been in normal operation for more than one year, all the districts may give them one-time subsidy for starting businesses. (the Municipal Development and Reform Commission, the Municipal Human Resources and Social Security Bureau, the Municipal Science and Technology Commission, the Municipal Agricultural and Rural Affairs Commission, and the Municipal Finance Bureau shall be responsible according to the division of their responsibilities.)

12. Supporting flexible employment and new forms of employment. The workers will be supported in finding jobs via platforms, and will be provided with entrepreneurial guarantee loans and interest subsidy according to the relevant provisions; platform enterprises will be guided to relax the entry requirements, reduce management service fees, and establish communication and coordination mechanisms with platform employees on labor remuneration and labor protection. The flexible employment registration system will be promoted in a comprehensive way. For those who have difficulty in obtaining employment and have not achieved stable employment after the expiration of the social insurance subsidy policy for flexible employment, the policy enjoyment periods may be extended for one year after the application is approved, and the deadline will be December 31, 2020. (the Municipal Human Resources and Social Security Bureau, the Municipal Commerce Commission and the Municipal Finance Bureau shall be responsible according to the division of their responsibilities.)

13. Strengthening reassured arrangement for employment. Classified assistance for the people with employment difficulties and dynamic management of real name system will be strengthened, and the people affected by the novel coronavirus pneumonia, the fishermen withdrawn from the Yangtze River and the disabled workers will be included in the scopes of employment assistance in a timely manner. According to the actual needs, the development of public welfare posts such as disinfection and epidemic prevention, cleaning and sanitation will be strengthened, and subsidies and support will be provided according to the relevant provisions. During the periods when the social insurance premium is reduced or remitted, the social insurance subsidy standards for public welfare posts will be calculated according to the actual payment amounts and the original proportions. 14. Stabilizing the employment of college graduates and other youth groups. The implementation of the various policies and measures to promote the employment of college graduates in this Municipality will be promoted, greater efforts will be made for the government agencies, state-owned enterprises and institutions, grass-roots employment projects and community worker teams to absorb college graduates for employment, and the Pilot Free Trade Zone Lingang New Area, the Yangtze River Delta green ecological integration development demonstration zone, and various industrial parks will be encouraged to provide batches of jobs and conduct targeted recruitment for the college graduates in this Municipality in combination with their regional talent development strategies. More college graduates in this Municipality will be encouraged to enlist in the army and relevant supporting policies and incentive measures will be implemented. The college graduates of 2020 in this Municipality from Hubei province will be given one-time employment and entrepreneurship subsidies. The policy of internship for college graduates will be implemented according to the requirements of the State. Psychological hotlines will be set up to strengthen the psychological counseling of college graduates seeking jobs. The registered permanent residence, files of the unemployed graduates will be well kept and relevant procedures will be well conducted according to the relevant provisions. The employing units that employ the college graduates with this Municipality’s household registration and obtain employment for the first time within two years after leaving school will be given social insurance subsidies in accordance with the relevant provisions. (the Municipal Human Resources and Social Security Bureau, the Municipal Education Commission, the Municipal State-owned Assets Supervision and Administration Commission, the Municipal Economy and Information Technology Commission, the Municipal Civil Service Bureau, the Municipal Civil Affairs Bureau, the Municipal Conscription Office and the Municipal Finance Bureau shall be responsible according to the division of their responsibilities.) 

IV. Focusing on Vocational Skills Training

 

15. Promoting vigorously actions to improve vocational skills. Vocational training will be carried out extensively for all kinds of groups, and subsidies for vocational training and living expenses will be provided in accordance with relevant provisions. Online vocational training will be promoted and training fee subsidies will be provided according to relevant provisions. The training of new apprenticeship will be comprehensively promoted, and vocational skills competition activities will be extensively carried out by taking the preparation and participation of the world skills competition as the guide. Vocational colleges will be supported to carry out both pre and post service vocational skills training for the society, and exploration will be made to form performance appraisal mechanisms and total performance salary adjustment methods linked to the vocational colleges’ undertaking of vocational skills training tasks. (the Municipal Human Resources and Social Security Bureau, the Municipal Education Commission, the Municipal Civil Affairs Bureau, the Municipal Finance Bureau, the Municipal Veterans Bureau, the Municipal Federation of Trade Unions and the Municipal Disabled Persons' Federation shall be responsible according to the division of their responsibilities.)

16. Strengthening the basic capacity building for vocational training. The pilot construction of industry and education integration will be promoted, and the construction of industry and education integration training bases will be strengthened to enhance the function of public training bases. The construction of high-skilled talent training bases will be promoted continuously and the special subsidy policy for the high-skilled talent training bases will be implemented continuously. The evaluation systems for the skilled talents will be improved, the skill level identification will be comprehensively implemented, and the diversified evaluation systems for skilled talents consisting of professional qualification appraisal, skill level identification and special professional ability assessment will be improved. The introduction and cultivation of quality training and certification institutions will be strengthened. V. Highlighting the Demand and Strengthening Employment and Entrepreneurship Services

 

17. Attracting excellent talents to Shanghai for quality jobs. Working closely around the new three major tasks, actively serving the national strategy, taking the construction of "the Five Centers" and "the Four Brands" in Shanghai as the key points, focusing on key areas and key fields, good talent development environments will be actively created with gradient talent introduction policies such as residence permit points, residence transfer and direct settlement, so as to attract college graduates and overseas students from all over the country for employment and entrepreneurship in Shanghai. (all the member units of the Municipal Leading Group for Employment Work shall be responsible according to the division of their responsibilities)

18. Ensuring the orderly employment of workers in Shanghai. The labor dispatching support service for the key enterprises, the "point-to-point, one-stop" service for the migrant workers to return to work, and the coordination and cooperation of employment recruitment for the enterprises in the Yangtze River Delta region to resume work, production and market will be vigorously promoted. Exploration will be made to turn the effective ways for collecting and releasing employment information, strengthening coordination and docking with labor export areas, and guiding workers in seeking employment into long-term mechanisms. For the human resources service institutions and other organizations that carry out cross regional organized labor export, employment and entrepreneurship service subsidies may be given by each district. 19. Improving the abilities of employment service. Online employment services and subsidies will be vigorously promoted, and the supply of online services will be increased. The plan to improve the handling capacity of grass-roots public employment services will be implemented and follow-up surveys on registered unemployed persons will be conducted at least once a month, and employment services will be provided in a timely manner according to their needs. Those enterprises that "share employment" with other enterprises during the epidemic periods may continue to enjoy the corresponding employment subsidy support. The activities to create harmonious labor relations will be carried out in a deep-going way. 20. Accelerating the construction of information service platform. By way of business process re-engineering and data sharing and exchange, the docking of public employment service items with the "Integrated Online Platform" general portal will be actively promoted, so that the high-frequency service items will be handled without personal contacts. The employment service monitoring platforms and big data analysis platforms will be improved to provide support for decision-making. Exploration will be actively made for the application of artificial intelligence and other technologies, so as to accurately grasp the supply and demand information, and provide technical support for orderly flow and optimal allocation of labor resources. VI. Strengthening the Reassured Guarantee for the People's Livelihood

 

21. Giving better play to the role of unemployment insurance. For those who are really unable to obtain employment afresh for reasons other than their own subjective ones and are less than 2 years away from the statutory retirement age, unemployment insurance benefits will continue to be paid until the statutory retirement age. The adjustment of unemployment benefits policies will be conducted in a good way. (the Municipal Human Resources and Social Security Bureau and the Municipal Finance Bureau shall be responsible according to the division of their responsibilities.)

22. Ensuring the livelihood of the people in difficulty. In accordance with the national regulations, the coverage scopes of price subsidy linkage mechanism will be expanded periodically and the standards of temporary price subsidy will be raised. For the unemployed and their families who are in difficulties, they will be included in the scopes of social assistance such as the subsistence allowance and temporary assistance in accordance with the relevant provisions. For those living on minimum subsistence allowances and having achieved employment, their employment willingness and employment stability will be enhanced via measures such as "gradual withdrawal of assistance" and income exemption. VII. Perfecting Mechanism and Strengthening Organizational Guarantee

 

23. Perfecting the work organization and coordination mechanism. All the member units of the Municipal Leading Group for the Employment Work shall base on their respective functions, form joint forces and study and solve major problems in the employment work. Each district shall establish a leading group for the employment work, clarify the objectives and tasks, work responsibilities and supervision and implementation mechanisms, coordinate, lead and promote the stabilizing employment work and the risk response and disposal for large-scale unemployment in their respective districts, and make specific arrangement for the responsibilities of promoting employment. The target responsibility system of the employment work will be improved, the target tasks will be refined and decomposed, and stabilizing employment will be taken as an important content in the supervision and inspection work. The work of stabilizing employment will be included in the annual (performance) assessment index systems of the Party and government leading groups at all levels. 24. Perfecting the guarantee mechanism for capital investment. Financial departments at all levels shall make good use of all kinds of funds with overall planning, and further increase investment for promoting employment. Funds needed for staffing and capacity improvement will be ensured in the construction of grass-roots employment service teams to ensure the grass-roots operation. 25. Perfecting the employment situation monitoring mechanisms. The employment monitoring index systems will be perfected and the mechanisms of study and judgment of employment situation with multi-party participation will be improved. Exploration will be made for the establishment of a mechanism of data sharing among the departments and a mechanism of cooperation with the market-oriented services and research institutions so as to carry out multi-dimensional employment monitoring. The impacts of various uncertain factors at home and abroad on employment will be fully studied and predicted, and reserve policies and response plans will be designed according to the severity of the impacts. In accordance with the unified deployment of the State, exploration will be made for the establishment of a monthly statistical release system for the surveyed unemployment rate. 26. Strengthening public opinion publicity and guidance. The policies and measures to support employment and entrepreneurship will be vigorously publicized so as to improve the policy awareness. Typical experience and typical people in the employment and entrepreneurship work will be selected and promoted for timely commendation and incentive. Public opinions will be well monitored, studied and judged, and a major public opinion communication, coordination and emergency response mechanism will be established.
