Shanghai Municipal Commission of Commerce shall mainly fulfill the following responsibilities:

1. Implement the laws, regulations, rules, guidelines and policies concerning domestic and foreign trade, foreign investment, foreign economic cooperation and port services, study and draft local regulations and rules on domestic and foreign trade, foreign investment, foreign economic cooperation and port services, formulate relevant policies, and organize the implementation of such as adopted.

2. Organize the drafting of construction plan and development strategy for Shanghai as an international trade center, and coordinate and boost the building of Shanghai as an international trade center. Formulate the development strategies, planning programs, standards and measures for domestic and foreign trade, foreign investment, foreign economic cooperation and port services, and organize the implementation of such as adopted.

3. Propel the construction of modern market systems and take charge of industrial management of spot commodity market. Promote the development of trade headquarters. Work with relevant departments to push forward supply-chain innovation and application, and take the lead in boosting the development of platform economy. Promote the development of modern logistics, as well as the work related to construction of a recycling system for renewable resources in line with the division of labor. Manage the automobile sales, used car circulation and abandoned vehicle dismantling industries in line with the division of labor. Facilitate the brand construction in the fields of commerce and trade, and promote the reform and innovation of time-honored brands.

4. Promote credit construction in the field of commerce, optimize the consumption environment, establish a public service platform for business credit, facilitate the classified supervision of business credit, and guide business credit sale. Take the lead in establishing a working mechanism for coordinated supervision of single-purpose repaid consumer cards, and organize relevant supervision and service well. Manage the drug distribution industry.

5. Organize and conduct the regulation for important consumer markets and the management of circulation of important production materials, and establish a complete emergency response mechanism for market supply of necessities of life. Take charge of reserve management of key commodities and market regulation in line with the division of labor. Supervise the distribution of edible agricultural products, establish a traceability system for important products, cultivate and develop the aquatic product market, and formulate any development plan and strategy for distribution of liquor and alcoholic beverage. Promote the construction of rural market systems, and organize and implement rural modern circulation network projects.

6. Advance the commerce and trade development, promote modern circulation methods, and promote and expand consumption. Guide and coordinate the planning for commodity transaction market, coordinate the layout of commercial network, improve and implement the safety production responsibility system in the field of commerce, and guide, coordinate, supervise and manage relevant safety production work. Promote the development of chain operation, commercial franchise and other modern circulation methods, and the consumption in the fields of commerce and trade. Oversee commercial and trade operation and management, and monitor and analyze macro commercial and trade operation conditions.

7. Advance the development of life service industry, improve the statistical monitoring system, and research and promote innovative development modes. Manage the life services within its scope of responsibility. Supervise and administrate the auction industry in line with governing rules. Promote the development of modern service clusters.

8. Take the lead in developing and promoting e-commerce, propel the innovation of commerce and trade circulation models and the promotion and application of new technology in the field of commerce, and facilitate the digital business development. Organize and carry out e-commerce demonstration projects, promote the construction of e-commerce public service system, and conduct statistical monitoring over e-commerce.

9. Guide the adjustment to structure of imports & exports, promote the construction of goods trade promotion system, coordinate and propel trade facilitation, and push excellent brands into domestic and foreign markets. Take the lead in promoting cross-border e-commerce development. Develop statistics and monitoring for the import & export trade of goods. Manage the import of important industrial products, the licenses for some import & export commodities, and the quota for export commodities excluding grain, cotton and coal. Manage the import and export of mechanical and electrical products, complete equipment, high-tech products, etc. Supervise and administrate the import and export of dual-purpose articles and technologies within its scope of responsibility.

10. Promote the construction of service trade promotion system, the development of key service trade areas, service outsourcing and other major models, and the establishment of an international public platform for technology import & export trading; manage technology import & export, service outsourcing and software export, international freight forwarder and other industries within its scope of responsibility; work with relevant departments to promote innovation in the emerging fields of service trade; and develop statistics and monitoring for service trade operations.

11. Formulate and cooperate with relevant departments to implement local comprehensive response plans after China’s accession to the WTO; set up the fair trade early-warning mechanism for regional import and export, guide and coordinate the anti-dumping and anti-subsidy efforts in exports; participate in organizing industrial damage investigations and mediating and settling major foreign economic and trade disputes; review the trade policy compliance and undertake the work related to IPRs of foreign trade.

12. Guide foreign investment in Shanghai, guide and coordinate Shanghai’s foreign investment promotion and the approval and record management of foreign-invested enterprises, guide the introduction of foreign investment into development zones and the work related to national economic and technological development zones. Review, approve and record the establishment and change of foreign-invested enterprises and provide policy consultation and other coordinated services for foreign-invested enterprises, in accordance with its authority.

13. Establish the economic statistic index system and credit rating system for the MICE industry, improve the MICE industry environment, promote the integrated development between the MICE industry and other related industries, manage international economic and trade exhibitions, and guide and support the development of key brand exhibitions. Plan as a whole and coordinate various urban guarantees for large-scale exhibitions like China International Import Expo (CIIE).

14. Oversee foreign economic cooperation, implement relevant foreign economic cooperation and foreign aid matters; record and mange the overseas startups by Shanghai-based companies according to laws (rather than financial institutions); guide and promote overseas project contracting, labor export cooperation, overseas employment and other relevant work of Shanghai-based companies; take the lead in protect the rights and interests of personnel assigned or employed to work overseas. Host and participate in multi-lateral and bilateral trade and economic negotiations and take part in handling economic relations with other countries and regions under the national overall strategic planning framework for foreign economic cooperation.

15. Preliminarily review the opening of new port, expanded opening of existing port, temporary opening of port and temporary exit & entry to and from non-open areas, and submit them for approval. Review, check, accept and submit for approval the opening and enabling of newly-established, rebuilt and expanded wharf, terminal, station and other foreign-related operation areas within the range of opening. Review and approve any temporary access to the range of opening, and take the lead in organizing the preparation for check and acceptance of newly-established or expanded special controlled areas. Plan as a whole, coordinate, supervise and urge to implement the planning, design, investment and construction of supporting facilities for check at port of entry, and coordinate the planning and construction of supporting facilities for check in special controlled areas.

16. Coordinate and support the customs clearance procedures at the port of entry, coordinate and promote the linkage and cooperation between port check units, and make innovation in supervision model. Coordinate and ensure the customs clearance services for major events such as important international conferences, major international competitions and large-scale international exhibitions. Participate in port safety coordination. Focus on coordinating and addressing the port check units’ problems to be solved by local government.

17. Coordinate and promote the informatization of customs clearance supervision at ports of entry and in special controlled areas, and conduct statistical analysis and release of port operation data.

18. Organize and conduct major trade and economic activities concerning foreign affairs. Review, approve and manage Shanghai-based representative offices of non-enterprise economic organizations from foreign countries and Hong Kong, Macao and Taiwan. Develop investment promotion and trade and economic cooperation between Shanghai and Hong Kong, Macao and Taiwan, and handle trade and economic affairs concerning Taiwan.

19. Guide and supervise the work of relevant social intermediary agencies and social organizations in the fields of commerce and port, guide and coordinate the talent team construction such fields, and organize foreign publicity in such fields.

20. Perform other tasks as may be assigned by CPC Shanghai Municipal Committee and Shanghai Municipal People’s Government.
