Announcement of the Standing Committee of Shanghai Municipal People's Congress No. 50

  Regulations of Shanghai Municipality on Public Health Emergency Management were adopted at the 26th Session of the Standing Committee of the 15th Shanghai Municipal People’s Congress on October 27, 2020, and are hereby promulgated. They shall be effective as of November 1, 2020 .

Chapter I  General Provisions

Article 1

With a view to improving public health emergency response capabilities, preventing and reducing the occurrence of public health incidents, controlling,  mitigating and eliminating their social hazards, ensuring the public’s life safety and physical health, and maintaining public safety and social order, these Regulations are formulated according to the Law of the People’s Republic of China on Prevention and Control of Contagious Diseases, the Emergency Response Law of the People’s Republic of China

and other relevant laws and administrative rules, and in light of the actual circumstances of this Municipality.

Article 2

These Regulations apply to public health and social governance in the administrative area of this Municipality, as well as public health incident prevention and emergency preparedness, monitoring and early warning in respect of public health incidents, emergency response, medical treatment, and security supervision.

Article 3

The public health emergency management work shall adhere to the  principles of people first, life first, unified leadership, hierarchical responsibility, prevention first, combination of peacetime and wartime, prevention and control according to law, systematic governance, respect for science, accurate implementation of strategies, joint prevention and control, and mass group prevention and control.

Article 4

This Municipality shall establish and improve the public health emergency management system, build a public health social governance system involving all parties, a centralized and unified public health emergency command system, a professional and modern disease prevention and control system, a coordinated and comprehensive public health monitoring and early warning system , and an emergency medical treatment system applicable to both peacetime and wartime.

Article 5

The Municipal People’s Government shall uniformly lead the public health emergency management of this Municipality.

The district and township people’s governments and sub-district offices are specifically responsible for the public health emergency management within their jurisdictions, and implement the public health emergency management measures formulated by the next higher-level people’s government and their related departments.

Article 6

The health department shall, in accordance with its duties, be responsible for organizing and implementing the daily management of public health, and related work such as monitoring and early warning ,emergency handling, and medical treatment. ,

The departments of development & reform, economy and informatization, commerce, emergency management, food and strategic reserves, drug supervision and others shall, in accordance with their respective responsibilities, be responsible for organizing and implementing the storage, requisition, emergency production, and emergency procurement of relevant drugs, medical equipment, protective equipment and other emergency materials and for dispatching and supplying basic necessities.

The civil affairs department shall be responsible for guiding the prevention and control of public health incidents in the community, as well as the prevention and handling of public health incidents in institutions of elderly service, and child welfare, and nursing institutions for the disabled, as well as guiding the related activities of charitable donations and voluntary services.

The education department shall be responsible for guiding and supervising schools, child care institutions and training institutions to implement the prevention and handling measures of public health incidents, and formulating and organizing the implementation of schooling suspension and resumption plans during the emergency handling of public health incidents.

The departments of public security, transportation, market supervision, greening and city appearance, ecological environment, agriculture and rural affairs, housing and urban-rural development, urban management and law enforcement, housing management, culture and tourism, sports, human resources and social security, healthcare security, finance, taxation, technology, State-owned assets, finance administration, judicial administration, customs and others shall, in accordance with their respective duties, do a good job in the prevention and handling of public health incidents.

Article 7

All units and individuals shall abide by relevant laws and rules, obey the decisions, orders, and announcements issued by the people’s governments at all levels and their relevant departments, and cooperate in all the prevention and  handling measures for public health incidents taken by the people’s governments at all levels and their relevant departments in accordance with the law.

Article 8

The measures taken by the people’s governments at all levels and their departments to respond to public health incidents shall be compatible with the nature, extent and scope of the social harm that the public health incident may cause;  Where there are various measures available, they shall choose measures conducive to the maximum protection of the rights and interests of citizens, legal persons and other organizations.

Article 9

No unit or individual shall discriminate against patients with infectious diseases, patients with suspected infectious diseases, pathogen carriers and their families who are receiving treatment or have been cured, or discriminate against persons from or passing through epidemic areas or high-risk areas, or disclose relevant information related to personal privacy.

Article 10

This Municipality shall establish a joint prevention and control mechanism for public health incidents with relevant provinces and cities, and carry out information sharing and work collaboration.

Under the framework of regional cooperation in the Yangtze River Delta, this Municipality shall promote the docking of public health incident prevention and control plans, the interconnection of information, and the coordination of prevention and control measures.

Article 11

This Municipality shall actively participate in global public health governance, strengthen international exchanges and cooperation in the field of public health, such as information sharing, personnel and technical exchanges, and jointly prevent public health and safety risks.

Chapter II  Public Health and Social Governance

Article 12

This Municipality shall establish and improve a public health social governance system, adhere to the leadership of the Party, implement territorial and departmental responsibilities, and make organic integration of regional governance, departmental governance, community governance, unit governance, and industry governance to form a cross-department, cross-level, and cross-regional public health incident prevention and handling system.

Article 13

The district people’s governments shall, in accordance with the requirements of the Municipal People’s Government and its relevant departments, clarify the responsibilities and division of labor for the prevention and control of public health incidents, establish a grid prevention and control management mechanism, and guide and supervise the territorial units and individuals in implementing various prevention and control measures.

The town/township people’s governments and sub-district offices shall, in accordance with the unified deployment of the municipal and district people’s governments and their relevant departments, give full play to mass prevention and control forces, and organize and guide neighborhood committees and villagers’ committees to implement various prevention and control measures.

Article 14

The people’s governments at all levels and their relevant departments shall establish and improve public health safety protection networks, give full play to the role of the Integrated Online Administration in urban operations, and do a good job in monitoring, early warning, prevention and control of public health incidents.

The people’s governments at all levels and their relevant departments shall give fullplay to the role of the Integrated Online Platform for government services, establish green channels, optimize work procedures, and provide convenient services for the prevention and handling of public health incidents.

Article 15

Neighborhood committees and villagers’ committees shall play an autonomous role to assist the government and its departments and dispatched agencies in doing community public health publicity and education, and health reminders, and implement relevant prevention and control measures.

Article 16

Government organs, enterprises, public institutions, and social organizations shall establish and improve their own public health management systems, improve long-term environmental and health management mechanisms, maintain various sanitation facilities, and conduct public health publicity, education, training, and emergency drills and other work, and assume the main responsibility for the implementation of public health incident control and handling measures by the corresponding unit.

Article 17

Relevant industry organizations shall formulate and publish industry guidelines for the prevention and handling of public health incidents in accordance with actual needs and in line with industry characteristics, promptly convey relevant policy information to their member units, and promote the implementation of various prevention and handling measures.

The catering service unit shall provide serving chopsticks and spoons. The competent departments of the catering industry and relevant industry organizations shall formulate service standards for separate portioned meals and encourage catering service units to implement the requirements.

Article 18

Individuals shall strengthen self-health management, enhance self-protection awareness, and cultivate civilized and healthy living habits such as frequent hand washing, meal separating, using serving chopsticks and spoons, and no game eating; during the epidemic period of respiratory infectious diseases, everyone shall wear a  mask and maintain social distance as required upon entering public places

Individuals who raise pets such as dogs and cats shall abide by relevant laws and rules, fulfill their duties such as pet immunization according to law, and develop civilized breeding habits.

Article 19

The people’s governments at all levels shall organize and carry out patriotic health campaigns, comprehensively improve the living environment, strengthen the construction of public health and environmental infrastructure, promote urban and rural environmental sanitation improvement, advocate a civilized, healthy, green and environmentally friendly lifestyle, popularize health knowledge, and promote civilized and healthy living habits.

Units and individuals are encouraged to participate in mass health activities and jointly improve the public health environment.

Article 20

This Municipality shall cultivate social organizations and professional social workers and volunteer teams in the field of public health, improve the participation mechanism of social forces, and build a public health social governance  framework with multi-party participation, coordination and cooperation.

Article 21

The departments of health, education, and science and technology shall organize public health education and popular science propaganda on the prevention and control of infectious diseases, self-protection, and civilized and healthy lifestyles.

Mass media such as radio, television, newspapers and periodicals, and the Internet shall carry out public welfare publicity, popularize public health knowledge, publicize the concept of civilized and healthy life, and arouse a public sense of science and health.

Chapter III  Prevention and Emergency Preparedness

Article 22

This Municipality shall improve the public health emergency command system, perfect the corresponding working mechanism, build municipal and district public health emergency command centers, strengthen the coordination and linkage between the health departments and the emergency management departments, and build a unified, authoritative and efficient public health emergency management pattern.

Relying on this Municipality’s Integrated Online Administration Platform, this Municipality shall build a municipal public health emergency command and information system, and integrates the public health emergency management into the urban operation management system.

Article 23

The Municipal People’s Government shall formulate an emergency response plan for public health incidents in this Municipality in accordance with the relevant emergency response plans of the state and this Municipality and in light of the actual situation.

This Municipality’s public health incident emergency plan shall be drafted by the municipal health department in conjunction with relevant departments, and reported to the Municipal People’s Government for approval before being announced to the public.

The municipal health department shall, based on the assessment results of emergency drills, changes in public health incidents, or problems found in the implementation of emergency plans, organize the revisions of public health incident emergency plans in a timely manner, and report to the Municipal People’s Government for approval.

The district people’s government shall formulate corresponding public health incident emergency plans based on this Municipality’s public health incident emergency plans and in light of the actual situation.

Article 24

The municipal and district people’s governments shall regularly organize relevant departments to carry out emergency drills in accordance with the emergency plan for public health incidents.

The municipal and district health departments shall regularly organize medical and health institutions to carry out training on public health emergency response plans and relevant knowledge and skills, and guide emergency drills. Other relevant departments and units shall cooperate in the training and emergency drills of their respective industries and units.

The town/township people’s government and the sub-district office shall, under the unified command of the district people’s government, organize and coordinate neighborhood committees, villagers’ committees, and units and individuals within their jurisdiction to participate in emergency drills.

Article 25

This Municipality shall establish a public health emergency material reserve system for medicines, testing reagents, vaccines, medical equipment, rescue equipment and protective articles in accordance with the emergency plan for public health incidents.

The municipal departments of development & reform, and health, shall, in conjunction with emergency management, finance, commerce, economy and informatization, food and strategic reserves, drug supervision and others, compile this Municipality’s public health emergency material reserve catalog, and the municipal public health strategic reserve agency shall carry out physical storage according to the catalog. The physical reserve materials shall be replaced and transferred for use in a timely manner within the shelf life or validity period. The people’s governments of all districts shall build up strategic reserves in accordance with the actual situation of their respective jurisdictions.

Units and families shall be encouraged to stock appropriate supplies of protective equipment, disinfection supplies, medicines and other materials in accordance with the disease prevention and health tips issued by this Municipality.

Article 26

The municipal economy and informatization department shall have the technical plans for emergency materials and production capacity in reserve, and build and improve the production system of emergency materials. The relevant government departments shall sign, according to actual needs, agreements with relevant enterprises, specifying the production varieties, quantities, and capacity guarantees of emergency material supplies.

Article 27

This Municipality shall establish a reserve system for designated medical institutions of public health which are available in both peacetime and wartime. The municipal and district health departments shall scientifically plan the number of  medical beds and determine a certain number of medical institutions, which can be transformed into designated medical institutions when a public health incident occurs. Each district shall have in reserve no less than one designated medical institution.

The district people’s government shall plan and have in reserve certain number of temporary hospitals based on factors such as the territorial area and population in its jurisdiction.

Article 28

In accordance with the requirements of overall planning, system reshaping, and overall improvement, this Municipality shall establish and improve the prevention and control system, with disease prevention and control institutions (hereinafter referred to as disease control institutions) as the core supported by medical institutions and community health service centers,, and raise the working capacity of disease control  institutions and community health service centers at the municipal and district levels, strengthen the duty of disease prevention and control of medical institutions and community health service centers, and improve the working mechanism of the coordination of medical treatment and prevention, and the linkage of disease control institutions and communities.

Article 29

This municipality shall optimize the function setting and hardware facilities of the municipal and district disease control institutions, scientifically determine the staffing, perfect the personnel training and use mechanism, optimize the proportion of professional and technical positions, establish a long-term mechanism for dynamic salary raise, and stabilize grassroots disease control team and improve disease prevention and control capabilities.

The municipal disease control institution shall strengthen the work guidance, professional training and assessment of the district disease control institutions, and establish a division of labor and up-and-down coordination mechanism. The municipal disease control institution may uniformly dispatch and use the personnel and equipment of the district disease control institution according to the emergency response needs of public health incidents.

Article 30

The municipal and district health departments shall guide and urge medical institutions to carry out their duties of disease prevention and control, and establish coordination mechanisms between disease control institutions and medical institutions in areas of personnel exchange, information sharing, and resource intercommunication, with supervision and regulation mutually checked and balanced.

Medical institutions shall, under the guidance of the disease control institutions, carry out disease surveillance reports, epidemiological investigations, sample collection and reporting, and check and management of close contacts, and provide the disease control institutions with diagnosis of confirmed or suspected infection cases, laboratory testing, disease treatment and other relevant information.

Article 31

This municipality shall establish a public health laboratory testing network with disease control institutions as the main body, medical institutions, universities, scientific research institutes, and third-party testing institutions as other supportive working bodies, to improve public health testing capabilities.

The municipal and district health departments shall strengthen the bio-safety management and quality control of the public health laboratory testing network.

Article 32

The municipal health department shall, in accordance with the needs of infectious disease prevention and control, formulate an infectious disease vaccination plan and organize its implementation, and set up reasonable and standardized vaccination units to ensure the vaccination rate of the immunization plan. Vaccines used for vaccination should meet the national quality standards.

Medical institutions, disease control institutions and children’s guardians shall cooperate with each other to ensure that children receive timely vaccination. When a child or student enters a nursery, kindergarten or school, the nursery, kindergarten and school shall check the vaccination certificate, and if they are found not vaccinated in accordance with the regulations, the guardians of such children shall be urged to make up the vaccination in time.

Article 33

This municipality shall establish a major public health safety expert database composed of experts in the professional fields of public health, clinical medical care, emergency management, health education, psychological assistance, and law.

The municipal health department can select some experts from the expert database to establish an expert committee to guide the prevention and handling of public health incidents.

Chapter IV  Monitoring and Early Warning

Article 34

This Municipality shall improve the public health monitoring and early warning system and establish a comprehensive monitoring platform, set up monitoring posts including medical institutions, pharmacies, schools, childcare agencies, elderly service institutions, edible agricultural products wholesale trading markets, and imported cold chain food storage, transportation, processing and marketing enterprises, transportation hubs and other units and locations, rely on the municipal public health emergency command and information system, establish a smart early warning multipoint trigger mechanism, clarify the trigger criteria for different types of public health events, collect, store, analyze and share monitoring information of relevant departments, and enhance early monitoring and early warning capabilities.

Article 35

The municipal health department shall, in conjunction with relevant departments, formulate the municipal public health monitoring program and work plan in accordance with the requirements of the relevant national planning and monitoring program, combined with the actual situation, and organize disease control institutions and medical institutions to carry out monitoring work.

Disease control institutions and medical institutions shall organize and carry out monitoring and reporting of public health incidents, patients, symptoms and risk factors in accordance with the requirements of the municipal public health monitoring program and work plan, and establish information sharing, consulting, analyzing, and early warning systems to achieve real-time monitoring and active detecting.

The departments of market regulation, drug supervision, agriculture and rural affairs, landscaping and city appearance, education, civil affairs, transportation, and customs shall, in accordance with the requirements of the municipal public health monitoring plan and their respective duties, organize and carry out the relevant monitoring work within the corresponding working areas and share monitoring information in time.

Article 36

Units and individuals who have received information on public health incidents shall immediately report to the local people's government, health department or disease control institution, or report it through the 12345 citizen hotline.

Article 37

The municipal and district health departments shall, in a timely manner, organize relevant professional institutions to summarize, analyze, investigate and verify the public health incident information they have obtained or the public health incident reports received, and report results in accordance with the prescribed procedures and time limits.

The municipal and district disease control institutions shall actively collect, analyze, investigate, and verify information on public health incidents. When receiving reports on the epidemic situation of Class A or Class B infectious diseases and reports of sudden infectious diseases with unknown causes, or discovering outbreaks or epidemics of infectious diseases, they shall immediately report to the health department at the same level, and the health department shall immediately report to the people’s government at the same level, and at the same time report to the higher-level health department and the State Council health department.

Article 38

This Municipality shall establish a sound public health early warning system. For public health incidents that can be forewarned, the early warning level shall be determined according to the degree of urgency, the development trend and the possible harm. Early warning levels are divided into first, second, third and fourth levels from high to low.

The municipal and district health departments shall, based on the monitoring results of public health incidents and the reports of disease control institutions, carry out public health incident development trend analysis and risk assessment, and report public health incident warning information to the people’s government at the same level.

After receiving the early warning information report, the municipal and district people’s governments shall, in accordance with relevant laws, administrative rules and the authority and procedures prescribed by the State Council, issue warnings of corresponding levels, decide and announce that the relevant areas enter the early warning period, and meanwhile report to the higher people’s government in accordance with the law, take relevant measures and prepare for emergency response properly.

The municipal and district people’s governments shall, in accordance with the development of the situation, adjust the warning level and reissue it in a timely manner in accordance with relevant regulations; if there are facts proving that a public health incident is unlikely to occur or the danger has been lifted, it is imperative to immediately announce the cancellation of the warning, terminate the warning period, and cancel the related measures that have been taken.

Article 39

After a public health incident occurs in this Municipality, the Municipal People’s Government or the municipal health department shall promptly notify the provincial people’s government or health department of the region that may suffer harm.

The Municipal People’s Government or the municipal health department shall promptly notify the relevant departments and medical and health institutions of this Municipality after receiving, from the people’s governments or health departments of other provinces and cities, the notifications of public health incidents involving or possibly involving this Municipality.

When the relevant departments of the municipal or district people’s governments discover that a public health incident has occurred or may be caused, they shall promptly report to the health department at the same level.

Article 40

This Municipality shall establish a public health incident information release system. The municipal health department shall, in accordance with relevant laws and rules, promptly, accurately and comprehensively release information on public health incidents in this Municipality to the public, and promptly update the information based on the developments, respond to social concerns, and guide the public to respond correctly.

If it is necessary to release relevant personal information according to the needs of emergency handling of public health incidents, the information shall be processed according to law to protect personal privacy to the greatest extent.

Chapter V  Emergency Response

Article 41

After a public health incident occurs, the municipal and district health departments shall organize relevant professional agencies and experts from the expert database to conduct a comprehensive assessment, and judge the type and level of the public health incident and the type of infectious diseases in accordance with relevant national and municipal regulations, and propose to the people’s government at the same level whether to initiate an emergency plan.

Article 42

When the municipal or district people’s government decides to activate the emergency plan for a public health incident, it shall determine the emergency response level according to the level of the public health incident, and may determine the regional risk level as needed. The emergency response level of public health incidents is graded as first, second, third and fourth level from high to low; regional risk level is classified into high-risk, medium-risk and low-risk.

When the first or second level emergency response is initiated, the Municipal People’s Government shall establish an emergency response headquarters, and the main person in charge of the Municipal People’s Government shall act as the commander-in-chief, responsible for organizing, coordinating, and directing the emergency handling of the public health incident.

When the third level emergency response is initiated, the municipal health department shall be responsible for organizing and implementing the emergency  handling of the public health incident.

When the fourth level emergency response is initiated, the district people’s government is responsible for organizing relevant departments to carry out the emergency handling of the public health incident.

When a Class A or Class B infectious disease breaks out or is spreading, the municipal or district people's government shall report to the people's government at the next higher level for a decision, and may declare all or part of its administrative area to be an epidemic area.

Article 43

After the emergency response to a public health incident is initiated, the municipal or district people’s government may take one or more of the following emergency measures according to law:

1. controlling the source of danger, marking the dangerous area, blocking off the dangerous place, and delimiting the warning zone;

2. implementing traffic control and setting up crossroads inspection and quarantine stations ;

3.restricting or closing down theaters, stadiums, museums, exhibition halls and other places or stopping other crowd gathering activities;

4. suspending work, business and school;

5. closing places where infectious diseases may spread;

6. sealing up contaminated public drinking water sources, food and related articles;

7. controlling or culling infected wild animals, livestock and poultry;

8. deciding to blockade the affected areas of Class A infectious diseases; and

9. taking other measures required by laws and rules.

Where the emergency measures set out in the preceding Paragraph need to be reported to the people’s government at a next higher level for decision, the Municipal People’s Government shall report to the State Council and make an immediate decision on the reports received from the district people’s government.

The removal of emergency measures shall be decided and announced by the original decision-making organ in accordance with the law.

Article 44

According to the actual situation of public health incidents and the need of emergency handling, relevant units shall take the following measures:

1. disinfecting elevators in public places, workplaces and other public areas in accordance with technical standards, and shut down centralized air conditioning and ventilation systems;

2. implementing measures such as maintaining social distance and wearing masks in public places; in accordance with technical standards and guidelines,

3. gathering samples of infectant from the infected patients, suspected infected patients, and suspicious infectant on site, and conducting emergency inspection and test;

4. taking measures such as emergency vaccination, preventive dosing, and group protection for people who are susceptible to infectious diseases and other vulnerable groups;

5. inspecting or disinfecting polluted public drinking water sources, food and related articles;

6. disinfecting polluted sewage, filth, places, etc. according to requirements, and if relevant units or individuals refuse disinfection, the disease control institution shall perform compulsory disinfection; and

7. taking other measures required by laws and rules.

Article 45

The Municipal People’s Government may, provided that it does not conflict with the Constitution, laws, or administrative rules, and does not violate the basic principles of local rules of this Municipality, issue decisions, orders, and announcements on temporary emergency management measures for health and epidemic prevention, quarantine observation, crossing management, transportation, community and place management, labor security, city appearance and environment, and animal epidemic prevention.

With the authorization of the Municipal People’s Government, announcements may be issued in the name of the emergency response headquarters.

The decisions, orders, and announcements stipulated in the preceding two Paragraphs shall be announced to the public through press conferences, government websites, etc.

Article 46

After the disease control institution discovers or receives a public health incident report, it shall immediately carry out epidemiological investigations, determine the source of infection, determine close contacts, investigate suspected transmission links and places, and propose on-site handling recommendations.

When the disease control institution is conducting an investigation, it has the right to enter the unit involved in the public health incident and the scene of the occurrence, inquire relevant personnel, consult or copy relevant information and collect samples. The units and individuals under investigation shall cooperate and shall not refuse or obstruct.

Article 47

The disease control institution shall, based on the results of epidemiological investigations, carry out sanitary procedures in places where Class A infectious diseases have occurred or in places where Class B infectious diseases occurs, which shall be managed in accordance with Class A disease, conduct medical observation and take other necessary preventive and control measures in designated places for close contacts of infectious disease patients .

The district people’s government may implement quarantine measures for the premises specified in the preceding paragraph or the persons in certain areas of the premises and report to the Municipal People’s Government at the same time. The Municipal People’s Government shall make a timely decision on whether to approve or not; if a decision of disapproval is made, the district people’s government shall immediately lift the measures.

During the quarantine period, the district people’s government that implements the quarantine measures shall provide basic livelihood guarantees for the  quarantined persons; if the quarantined persons have a work unit, the unit where they belong to shall not stop paying their work remuneration during the quarantine period.

The dissolution of quarantine measures shall be decided and announced by the original decision-making organ.

Article 48

According to the needs of emergency response to major infectious disease epidemics, the district people’s government may conduct quarantine health observations in designated places or independent home health management, and take other necessary prevention and control measures for people with travel or residence history in areas of high epidemic risk. Relevant persons shall cooperate in receiving the health observation; if they refuse to cooperate, the public security organ shall provide assistance in accordance with the law.

The district people’s government may temporarily requisition hotels and other places with relevant conditions as centralized health observation points in accordance with the requirements for epidemic prevention and control.

Article 49

When a public health incident occurs, schools, nurseries, kindergartens and training agencies shall implement relevant prevention and control measures in accordance with regulations, and shall not organize students to return to school, organize offline teaching or collective activities during the schooling suspension period.

When a public health incident occurs, institutions of elderly service, child welfare institutions, care homes for the disabled, detention facilities and other places shall adopt closed management and other measures to suspend or reduce visitations according to emergency response needs.

Article 50

When a Class A infectious disease or a Class B infectious disease managed in accordance with Class A disease occurs, in order to prevent the spread of the infectious disease through means of transportation and the persons and materials carried thereby, the municipal and district people’s governments may implement transportation inspection and quarantine.in accordance with relevant national rules.

In respect to people, vehicles, transportation equipment, and luggage, goods, parcels and other items that may spread infectious diseases at frontier ports and entries and exits, the customs shall take sanitary and quarantine measures in accordance with the frontier inspection and quarantine laws and administrative regulations.

Enterprises that store, transport, process and sell imported cold chain food shall cooperate with the departments of customs, market regulation, agriculture and rural affairs, health and others to carry out inspection and quarantine and other supervision and management work, strictly implement daily protection, environmental disinfection, emergency handling and other requirements, and effectively prevent the transmission risks of infectious diseases in cold chain logistics.

Article 51

The neighborhood committee and villagers’ committee shall organize  and mobilize residents (villagers), volunteers, etc. to implement emergency prevention and control measures such as closed community management, personnel entry and exit control, home health observation management, and health tips, and promptly collect, register, verify and submit relevant information. The property owners’ committee shall cooperate in doing the relevant work.

Property management enterprises or other managers shall carry out emergency handling measures and other management measures implemented by the government in accordance with the law, and actively cooperate in relevant work. Residents (villagers) shall cooperate in accordance with the law.

The closed management of the community based on the need for emergency  handling of public health incidents shall abide by relevant laws and rules, and shall not damage the legitimate rights and interests of residents (villagers).

Article 52

Organs, enterprises, public institutions, and social organizations shall strengthen the responsibility and management system for prevention and control work, implement strict control over key persons and groups, important places and facilities, strengthen health monitoring, and report abnormalities in a timely manner to the relevant department.

When a unit discovers a person suffering from an infectious disease or showing symptoms of a suspected infectious disease, it shall urge the said person to see a doctor promptly, agree and cooperate with the disease control institution, the community health service centers, etc. in the process of investigation and treatment of infectious diseases, and implement relevant prevention and control measures.

Article 53

The municipal health department shall establish a joint entry-exit  control mechanism with the customs, and organize relevant medical and health institutions to promptly deal with patients with infectious diseases or suspected infectious diseases discovered under quarantine and transferred by the customs.

Article 54

After the occurrence of a public health incident, the departments of health, ecological environment, and landscaping and city appearance shall, within their respective responsibilities, strengthen the supervision over and management of the collection, transportation and disposal of medical waste and domestic garbage to prevent harm to public health and environmental pollution. .

Medical and health institutions shall make segregated collection of the medical waste generated by their own units according to law, and hand them over to the centralized medical waste disposal unit. The centralized disposal unit of medical waste shall collect, transport and dispose of medical waste in a timely manner.

Domestic garbage produced by medical and health institutions, and persons under medical or health observation, shall be collected, transported and disposed of in accordance with the relevant regulations of the State and this Municipality.

Article 55

The people’s governments at all levels and their relevant departments shall strengthen the monitoring of public opinion information during emergency handling of public health incidents, actively sort out public opinions and suggestions, coordinate and resolve public concerns in a timely manner, and actively respond to social concerns.

The people’s governments at all levels and their relevant departments, discovering false or incomplete information on public health incidents that affects or may affect social stability or disrupt social order, shall publish accurate and complete information within the scope of their duties, and take measures to deal with it in accordance with the law.

Article 56

This Municipality shall encourage and support voluntary service organizations to participate in public health incident response work, and organize volunteers to carry out volunteer services in popularization of science, community prevention and control, order maintenance, crossroads quarantine, psychological assistance, epidemiological investigation and other fields according to their own capabilities .

Volunteers arranged to participate in emergency handling of public health incidents shall be provided with necessary safety protection.

Volunteer service organizations and volunteers who carry out voluntary services in response to public health incidents shall accept the unified coordination of the municipal and district people’s governments and their relevant departments.

Article 57

The municipal and district people’s governments and their relevant departments shall formulate plans for resuming work, production and the market, helping enterprises to coordinate and resolve the difficulties encountered in resuming work, production and the market, and promote the orderly restoration of production and life.

The municipal education department shall, in accordance with the development trend of a public health incident and risk research and judgment, jointly with relevant departments, put forward suggestions for resumption of school, nurseries, kindergartens and training institutions, and report to the Municipal People’s Government for approval and promptly announce to the public.

Schools, nurseries, kindergartens and training institutions shall, in accordance with this Municipality’s requirements for emergency response to public health incidents, formulate plans for resumption of school, and school shall be resumed after the education department and the health department have checked and assessed all right.

Article 58

The municipal and district people’s governments shall, in accordance with the relevant national and municipal laws, rules, and emergency plans, organize experts to carry out evaluations and demonstrations, and adjust emergency response levels and regional risk levels in a timely manner in light of the actual conditions and the needs of prevention and control work, and corresponding emergency response measures, and announced to the public in the form of public notices.

After a public health incident is eliminated or effectively controlled, the emergency response state shall be lifted in due course. The procedure for lifting the emergency response state is the same as the procedure for initiating the emergency plan.

If an emergency response state is lifted, necessary measures may continue to be taken to prevent secondary and derivative incidents from occurring.

Chapter VI  Medical Treatment

Article 59

This Municipality shall establish an emergency medical treatment system consisting of designated medical institutions, pre-hospital first aid institutions, community health service centers, etc., and carry out treatment work in accordance with the requirements of concentrated patients, experts, resources, and treatment.

The Municipal Public Health Clinical Center and other designated medical institutions shall formulate medical treatment plans in accordance with the requirements of the regulations, take charge of the centralized admission and treatment of patients in public health incidents, and provide them with effective treatment.

Pre-hospital first aid institutions shall be equipped with a certain number of special ambulance vehicles, and first-aid medicines and equipment in accordance with the requirements of the regulations, and take charge of the on-site treatment and timely transfer of patients.

The community health service center shall, in accordance with the regulations, implement preliminary diagnosis and timely referral, and follow-up and health guidance for the cured persons during the recovery period.

Article 60

Medical institutions shall implement a pre-examination and triage system, and actively inquire about the epidemiological history of patients; arrange to send patients for whom the possibility of a disease related to a public health incident can’t be excluded through triage to the appropriate departments for diagnosis, treatment and investigation, implement the first diagnosis responsibility system, provide treatment in accordance with the diagnosis and treatment standards, and shall not deny treatment.

If a medical institution does not have the corresponding treatment capability, it shall, on the premise of ensuring safety, promptly refer the patient to a medical institution with the ability to treat the patient in accordance with the referral process.

Article 61

Patients or suspected patients with Class A infectious diseases, as well as those with Class B infectious diseases who shall be treated in isolation according to law, shall be concentrated in designated medical institutions for isolation treatment.

Patients and suspected patients with infectious diseases who need to be treated in isolation shall cooperate; if they refuse to cooperate, the public security organs shall  render them compulsive assistance according to law.

Article 62

Medical institutions shall establish an in-hospital infection management responsibility system, and strictly implement relevant management systems, operational norms and prevention and control measures.

Medical institutions shall adopt corresponding sanitary protection measures for out-patients, medical and health personnel, and attendants to prevent cross-infection and contamination.

Article 63

This Municipality shall give full play to the role of traditional Chinese medicine in the medical treatment of public health incidents, improve the ability of traditional Chinese medicine treatment, establish a joint consultation system of Chinese and Western medicine experts, and improve the cooperative treatment mechanism of Chinese and Western medicine.

The municipal department in charge of traditional Chinese medicine shall organize the formulation of traditional Chinese medicine treatment plans and guide medical and health institutions to actively use traditional Chinese medicine techniques in prevention, treatment and rehabilitation.

Article 64

During the emergency handling of public health incidents, individuals shall obey the measures taken by medical institutions to make appointments, avoid peak-time hospital visiting, restrict visits of relatives and friends, etc., and respect medical personnel, and shall not infringe upon the legal rights and interests of medical personnel.

Public security organs should strengthen the medical-police linkage, and shall, according to law, severely crack down on illegal and criminal acts of disrupting the medical order and injuring doctors with violence during the emergency response to public health incidents.

Chapter VII  Safeguard Measures

Article 65

The funds required for prevention, emergency preparedness, and emergency response in the field of public health shall be included in and guaranteed by the financial budgets of the people’s governments at all levels.

Article 66

This Municipality shall increase investment in scientific research, strengthen the system-building and capacity-building of public health science and technology research, encourage and support scientific research institutions and related enterprises to research and develop technologies and equipment for the prevention and treatment of public health incidents, and speed up research and development of vaccines, reagents of diagnosis, medical devices and medicines, and advance research on etiology and epidemiology.

Article 67

This Municipality shall, through college education, standardized training of  doctors, and continuing education, strengthen the training of professionals in the prevention and handling of public health incidents, and establish a corresponding a mechanism for personnel reserve and emergency medical team reserve.

This Municipality shall encourage medical schools to strengthen the construction of public health disciplines, with emphasis on strengthening preventive medicine and health promotion.

The municipal health department shall improve the standardized training system for resident and public health doctors, strengthen the training of capabilities in clinical treatment and risk prevention in epidemiology, infectious diseases, and nosocomial infections, and incorporate knowledge and skill training related to the prevention and handling of public health incidents in the continuing education assessment.

Article 68

After a public health incident occurs, with the consent of the Municipal People’s Government, the emergency materials of the municipal public health material reserve   may be used. Emergency materials shall give priority to meeting the needs of the forefront of emergency handling of public health incidents.

When the emergency materials are insufficient, the Municipal People’s Government and its relevant departments shall promptly activate the technical plan and production capacity reserves, and instruct relevant enterprises to quickly switch to production thereof.

When necessary, the municipal and district people’s governments may requisition facilities, equipment, venues, vehicles, and other materials needed for emergency response from units or individuals in accordance with the law, and require relevant enterprises to organize the production and supply of corresponding emergency materials and daily necessities, and issue emergency requisition  vouchers to the units or individuals requisitioned, and return and compensate them after use or the emergency response to the public health incident is completed.

For emergency materials that are in short supply, the municipal department of commerce can organize emergency procurement through multiple channels.

Article 69

During the emergency handling of a public health incident, the departments of public security, transportation and others shall set up special channels, improve relevant transportation facilities, and ensure the priority passage of emergency vehicles, personnel, medicines, medical equipment, protective equipment and other emergency materials for emergency response.

The relevant departments of the municipal and district people’s governments shall organize and coordinate the civil aviation, railway, highway, waterway and other business units to give priority to the transportation of personnel and emergency materials such as medicines, medical and protective equipment involved in emergency response.

Article 70

The municipal departments of commerce, development & reform, economy and informatization, agriculture and rural affairs, and food and strategic reserves shall, based on the reserves and production of basic necessities in this Municipality, coordinate the Municipality’s enterprises with the supply bases, manufacturers and suppliers of other provinces and cities   to ensure the market supply of basic daily necessities during emergency response to public health incidents.

The operating units of public facilities in this Municipality shall ensure the normal operation of various facilities, and guarantee the residents’ needs for basic public services such as water, electricity, gas, communications, and travel.

Medical institutions shall guarantee the needs for basic medical services in  emergency state, and may provide daily medical services through appointments, avoiding peak-time hospital visiting, etc., and guide patients to see doctors at different times.

Article 71

In accordance with relevant national regulations, this Municipality shall provide temporary work subsidies to personnel directly involved in the on-site handling, medical treatment and other front-line work of public health incidents, and give priority to the evaluation of professional titles and job promotion.

This Municipality shall give commendations and rewards to units and individuals that have made outstanding contributions to the emergency response to public health incidents.

This Municipality shall, in accordance with the regulations, grant work-related injury benefits, pensions, and martyrs praise to those who have become ill or disabled, or died as a result of participating in the emergency handling of public health incidents.

Article 72

The municipal and district people’s governments shall arrange necessary financial funds to guarantee the medical treatment expenses incurred due to public health incidents and establish medical expenses guarantee and fund compensation mechanisms.

For the patients with Class A infectious diseases or patients of Class B infectious diseases who shall be treated the same as patients with Class A diseases who receive isolation treatment in accordance with the provisions of the State and this Municipality, if they have participated in the basic medical insurance, the personal medical expenses arising from the isolation treatment in the designated medical institutions shall be partially subsidized by the finance, after payment by basic medical insurance, serious illness insurance, medical assistance, etc; if they fail to participate in the basic medical insurance, relevant regulations of the State shall apply.

For patients who have concealed their medical history, travel or residence history in high-risk areas of the epidemic, or escaped isolation treatment, medical observation, health observation, etc., the medical expenses borne by the individual shall not be subsidized.

Article 73

The municipal and district health departments shall establish emergency psychological assistance and crisis intervention mechanisms for public health incidents, and organize mental health service institutions, social organizations, and volunteers to provide psychological assistance to the people in need, with focus on providing psychological counseling and crisis intervention for patients and medical health personnel, minors, and the elderly.

Article 74

The relevant departments of the municipal and district people’s governments shall strengthen the standardized management of charitable donation activities related to the prevention and handling of public health incidents, and ensure that the entire process of receiving, spending, using and monitoring is transparent, open, efficient and orderly .

Article 75

The departments of development & reform, State-owned assets, financial management, taxation, human resources and social security, commerce, science and technology, finance and others shall promptly assess the impact and losses that various industries suffered from the public health incident, and shall, in accordance with relevant national and municipal regulations, help enterprises to develop smoothly and healthily through various policies and measures to reduce the burden on enterprises,

Article 76

The people’s governments at all levels shall use multiple mechanisms for resolving conflicts and disputes to guide the public through non-litigation channels such as mediation and arbitration to resolve conflicts and disputes caused by public health incidents.

This Municipality shall establish a guarantee mechanism for legal services in public health incidents, Lawyers,  notaries,  forensic evidence institutions and other industry associations shall be encouraged to form professional teams, improve fast channels, and provide the public with timely and convenient public legal services. Those who have difficulties in business or life due to public health incidents and who  require legal aid can be exempted from the economic status review, and given priority in case accepting and case handling.

Chapter VIII  Supervision Measures

Article 77

The municipal and district people’s governments shall urge their subordinate departments and lower-level people’s governments to implement public health emergency management responsibilities, and improve the corresponding reward and punishment mechanism.

The health department shall strengthen the supervision over and inspection of disease control institutions and medical institutions on the prevention and control of public health incidents, and on sanitation in public places, of drinking water, of centralized air-conditioning and ventilation systems, etc.

The departments of commerce, market regulation, agriculture and rural affairs, and urban management and law enforcement shall, in accordance with the requirements for handling public health incidents, strengthen supervision over and management of key places such as the farmer’s market and live poultry transactions, and strengthen law enforcement.

The market regulation department shall severely punish behaviors that disrupt the market order, such as raising prices, and making and selling fakes, and shall stabilize market prices, and maintain the market order.

Article 78

The standing committees of the municipal and district people’s congresses shall supervise the public health emergency management work of the people’s governments at the same level by listening to and reviewing special work reports, conducting law enforcement inspections and inquiries, and may organize deputies to the people’s congress to carry out inspection and research activities, and collect and convey the opinions and suggestions of the public.

The Municipal People’s Government shall report the decisions, orders and announcements issued in accordance with Article 45 of these Regulations to the Standing Committee of the Municipal People’s Congress for the record.

Article 79

Any unit or individual has the right to report that the people’s governments at all levels and their relevant departments fail to perform public health emergency management duties as required, that relevant units fail to carry out public health emergency response work as regulated, and that individuals fail to obey or cooperate with the measures for public health emergency response. The government or department that receives the report shall verify and handle it in a timely manner.

Article 80

The news media shall report on the emergency management of public health incidents in a timely, objective and fair manner, and conduct public opinion supervision over violations of public health emergency management.

Chapter IX  Legal Liability

Article 81

For violations of the provisions of these Regulations, where laws and administrative rules have already had provisions for punishment, such provisions shall prevail.

Article 82

If a medical and health institution violates the provisions of these Regulations  and fails to perform its duties related to the prevention and handling of a public health incident, the health department shall order correction, give a warning, and criticisms in a circular notice.

If the people’s governments at all levels and their relevant departments violate the relevant provisions of these Regulations and fail to perform their statutory duties, the relevant competent departments shall, in accordance with relevant laws and rules, impose penalties on the relevant personnel in accordance with the circumstances; if a crime is constituted, criminal liability shall be investigated in accordance with the law.

Article 83

If a unit or an individual violates the provisions of these Regulations, failing to obey the decisions, orders, or notices issued by the people’s governments at all levels and their relevant departments, or failing to cooperate with various measures taken in accordance with the law, the relevant competent department shall order correction, and for violation of public security administration, the public security organ shall, in accordance with the law, impose punishment; if anyone causes a public health incident to occur or the harm to spread to the person or property of others, the wrongdoer shall bear civil liability according to law; if a crime is constituted, criminal liability shall be investigated in accordance with the law.

If an individual enters a public place and fails to take preventive and control measures in accordance with the regulations, the relevant public place management unit may refuse to provide services for him/her.

If a catering service unit fails to provide consumers with serving chopsticks and spoons, the market regulation department shall order correction; if it refuses to make correction, a warning shall be given, the relevant situation shall be included in the scope of the scoring and grading management and assessment of food safety in catering services, and the assessment results shall be announced to the public .

Article 84

Where a unit or an individual violates the provisions herein prescribed, in addition to investigation of the corresponding legal liability according to law, relevant departments shall, in accordance with the relevant provisions, collect and put on record on this Municipality’s public credit information platform, the unit’s discreditable information or the individual’s personal information of concealment of medical history, travel history or residence history in high risk areas of the epidemic, or evasion of isolation treatment, medial observation, or health observation, and take disciplinary measures according to law.

Chapter X  Supplementary Provision

Article 85

These Regulations shall be effective as of November 1, 2020.
