Decree of the Standing Committee of Shanghai Municipal People's Congress No. 51

  Regulations of Shanghai Municipality on the Guarantee and Promotion of Public Cultural Services were adopted at the 26th Session of the Standing Committee of the 15th Shanghai Municipal People’s Congress on October 27, 2020, and are hereby promulgated. They shall be effective as of January 1, 2021.

Chapter I  General Provisions

Article 1

With a view to improving the public cultural service system, enriching the spiritual and cultural life of the people, safeguarding their basic rights and interests in culture, carrying forward the core socialist values, inheriting the excellent traditional Chinese culture, enhancing cultural self-confidence, and promoting the development and prosperity of the socialist culture with Chinese characteristics, these Regulations are formulated in accordance with the Law of the People’s Republic of China on Guaranteeing Public Cultural Services and other laws and administrative rules, and in the light of the actual circumstances of this Municipality.

Article 2

These Regulations apply to the construction and administration of public cultural facilities, the provision of basic public cultural services, the public cultural events, the “Shanghai Culture” brand building and other activities for guaranteeing and promoting public cultural services in the administrative area of this Municipality.

Article 3

The work on guaranteeing and promoting public cultural services in this Municipality shall adhere to the orientation of advanced socialist culture, and pursue the people-centered development philosophy; meet the requirements for “building the city for the people”, be guided by the core socialist values, and follow the principles of government guidance, public participation, guarantee of the basic needs with well-distributed quality services, opening and sharing of public service, and servicing the people - all these can manifest the Shanghai Spirit characterized by inclusiveness, excellence, wisdom and modesty.

Article 4

The people’s governments at all levels shall be directly responsible for the public cultural services in their respective administrative area, and shall incorporate the work on public cultural services into the assessment of government objectives and responsibilities.

The municipal and district people’s governments shall incorporate public cultural services into their respective national economic and social development plan, strengthen the construction of public cultural facilities, ensure the provision of basic public cultural services, support public cultural activities, and improve the effectiveness of public cultural services in accordance with the requirements of public welfare, basic needs, balance and convenience.

The town/township people’s governments and sub-district offices shall be specifically responsible for the routine administration of the community public cultural facilities in their own administrative area, enrich the provision of public cultural products, and organize and carry out public cultural activities.

Article 5

The competent department of culture shall be responsible for developing public cultural undertakings, promoting the building of the public cultural services system involving culture, radio and television, implementing cultural projects beneficial to the people, coordinating and advancing the standardization and equal distribution of basic public cultural services, and guiding, organizing and carrying out public cultural activities.

The competent department of press and publication shall be responsible for the public cultural services in the press and publication sector, organizing and carrying out the construction of the press and publication public cultural services system, coordinating and guiding the planning and development of the press and publication public cultural services, advancing the copyright protection of public cultural service products, and guiding, organizing and carrying out work such as the nationwide reading project.

The competent department of film administration shall be responsible for public cultural services in films, organizing and carrying out the system construction of public cultural services in films, and guiding and coordinating such work as film showings for public benefit.

The competent department of education shall be responsible for organizing and guiding the cultural activities and the popularization of culture and art in schools, and the sharing of cultural and sports facilities of schools.

The competent department of sports shall be responsible for organizing and guiding the national fitness activities, promoting the opening of sports facilities to the public, and supervising and managing the public sports facilities.

The competent department of science and technology shall be responsible for coordinating and organizing the popularization of science and technology activities, and promoting the opening of popular science and technology museums to the public.

The departments of development & reform, economy and informatization, public security, civil affairs, justice administration, landscaping and city appearance, finance, human resources and social security, planning and resources, housing and urban-rural development, agriculture and rural affairs, health, and statistics shall coordinate the implementation of these Regulations according to their respective responsibilities.

The labor union, youth league, women’s federation, disabled person’s federation, science and technology association and other people’s organizations should make use of their respective advantages and carry out relevant public cultural services.

Article 6

This Municipality shall establish a comprehensive coordination mechanism for public cultural services at the municipal and district levels to guide, coordinate and promote the guarantee and promotion of public cultural services within its administrative area, strengthen the coordination of public cultural service resources, and advance the realization of joint construction and sharing. The municipal and district competent departments of culture shall assume the responsibilities of comprehensive coordination.

Article 7

The Municipal People’s Government shall, based on the national guiding standards for basic public cultural services and in the light of the economic and social development of this Municipality, formulate and publish the implementation standards for the basic public cultural services of this Municipality, and adjusts them dynamically.

The district people’s governments shall, based on the national guiding standards and the municipal implementation standards for basic cultural services and in the light of the actual needs and the local cultural characteristics, formulate and publish the basic public cultural service catalogue and organize its implementation in their respective administrative area.

Article 8

The public cultural services in this Municipality shall be provided for free or at preferential prices to promote equal, universal and convenient provision of basic cultural services.

The people’s governments at all levels shall provide differentiated public cultural services according to the characteristics and needs of minors, the elderly, the disabled, the migrant population and other groups.

Article 9

This Municipality shall coordinate and promote the integrated development of public cultural services and the civility practices in the new era, and take advantage of public cultural facilities in resources, services and organizational systems to carry out civility practices.

This Municipality shall encourage and support the integrated development of public cultural services in education and science and technology, achieve resource sharing, give play to the role of public cultural services in public education, and improve the moral education and scientific and cultural knowledge among the public.

This Municipality shall advance the integrated development of public cultural services and tourism, promote the functional integration of public cultural facilities and tourism public facilities, give play to the role of tourism in major brand festivals and public cultural facilities, and enhance the influence of public culture.

Article 10

This Municipality shall advance the cooperation in public cultural services in the Yangtze River Delta region, enhance the connectivity and sharing of public cultural resources, and promote the integrated development of regional public cultural services.

Chapter II  Construction and Administration of Public Cultural Facilities

Article 11

For the purpose of these Regulations, the public cultural facilities mean the buildings, sites and equipment used to provide public cultural services, including the following main facilities:

1. libraries, cultural centers, museums (memorial halls), art galleries, science and technology centers, and intangible cultural heritage centers;

2. sports centers and facilities;

3. facilities for radio and television broadcast and transmission;

4. workers’ cultural palaces, youth palaces, women’s and children’s activity centers, and the elderly’s activity centers;

5. community cultural activity centers;

6. community/village comprehensive cultural activity rooms, reading rooms for villagers or workers, and community sports and fitness facilities; and

7. other public cultural facilities as provided by laws and rules.

The municipal and district people’s governments shall make public the directory of public cultural facilities and other related information within their respective administrative area.

Article 12

The people’s governments at all levels shall, in accordance with relevant provisions of the State and this Municipality, reasonably determine the types, quantities, scale and distribution of public cultural facilities, and plan and construct public cultural facilities in a balanced manner to form a public cultural facilities network.

No organization or individual shall encroach upon the land used for public cultural facilities or change its use without authorization. If the land used for the public cultural facilities needs to be adjusted due to certain circumstances, the land area after the adjustment shall not be smaller than the original area.

No organization or individual shall demolish public cultural facilities or change their functions and uses without authorization, encroach upon or misappropriate them, or use them for commercial activities unrelated to public cultural services.

Where it is necessary to demolish the public cultural facilities or change their functions and uses due to urban and rural development, the construction may be carried out before or simultaneously with the demolition. The standards and floor space of the reconstructed or renovated public cultural facilities shall not be lowered.

Article 13

The department in charge of managing the public cultural facilities (“managing department”) shall, in accordance with relevant provisions of the State and this Municipality, reasonably arrange the space for the basic functions, set up convenient service areas, put up equipment and devices necessary for public cultural services, and inspect, maintain and update the said equipment and devices according to the plan, and ensure the normal use and operation of public cultural facilities.

Billboards, bulletins and signs installed in the public cultural facilities shall comply with relevant provisions of the State and this Municipality; and shall, if the conditions permit, provide the corresponding foreign words that conform to the writing and translation norms or common practice.

Article 14

The managing department shall establish a statistics reporting system on public cultural facilities and assets as well as an annual report system on the implementation of public cultural activities. The activities and service performance of public cultural services shall be made known to the public.

Article 15

The managing department shall establish and improve the safety administration system, carry out safety evaluation on public cultural facilities and public events, and provide safety equipment and personnel as provided by law so as to ensure the safety of public cultural facilities and public events. The managing department shall be encouraged to buy public liability insurance.

The managing department shall establish an emergency response system, formulate emergency plans and conduct regular emergency drills; in the event of an emergency, emergency response measures such as restricting the use of facilities or equipment, and closing down or restricting the use of relevant venues shall be taken according to law.

Article 16

The departments of culture, and science and technology shall encourage the managing department for public libraries, cultural centers, State-owned museums (memorial halls), State-owned art galleries, and science and technology museums to establish and improve, based on their functions and positioning, a corporate governance structure mainly in the form of the board of directors, and attract representatives from the relevant sectors, professionals and the public to participate in the management.

Article 17

The district people’s governments shall establish a hierarchical system in which the district public libraries and cultural centers serve as the main facilities, the community cultural activity centers as the branches, and the community/village comprehensive cultural activity rooms as the primary-level service stations to promote the sharing and service extension of public cultural resources.

This Municipality shall encourage the libraries (reading rooms), workers’ reading rooms, cultural activity rooms of the eligible schools, research institutes, enterprises and other places that provide public cultural services to act branches or service stations.

The municipal public libraries and cultural centers shall provide guidance and support in terms of resource distribution, service improvement and professional training to enhance service collaboration.

Article 18

When using the public cultural facilities, people shall observe the public order, and take good care of public facilities, and shall not damage public facilities, equipment or other objects.

Chapter III  Basic Public Cultural Service Provision

Article 19

The people’s governments at all levels shall make full use of the public cultural facilities, promote the provision and spread of excellent public cultural products, support the managing department to provide the public with cultural performances, exhibitions, films, radio and television programs, digital cultural services, readings services, excellent traditional cultural heritage experience, art popularization, tourism consultation, publicity of the rule of law, sports and fitness, science popularization and other cultural services according to this Municipality’s implementation standards for basic cultural services.

Article 20

The public cultural facilities shall, according to their functions and features and the State provisions, be made open for free or at preferential prices.

If the public cultural facilities or the services are made open with charges, minors, the elderly, the disabled, and active military personnel and firemen shall be offered free admissions or preferential prices.

The service charges and their standards shall be reported to the departments of pricing administration and culture for approval. The fees collected shall be used for the maintenance, management and development of the public cultural facilities, and shall not be used for other purposes.

Article 21

The opening hours of the public cultural facilities shall be reasonably determined according to their functions, and features and the needs of the people for whom the service is intended, and shall not be less than the minimum time limit stipulated by the State and this Municipality. Extended or staggered opening hours shall be encouraged.

The public cultural facilities shall be made open on public holidays, and the opening hours during the national holidays and festivals and school summer and winter vacations may be appropriately extended.

Article 22

The managing department shall establish a service information disclosure system, disclosing their service items, service details and opening hours to the public through their websites or at the places of services.

If the public cultural facilities are temporarily shut down or the opening hours are changed, an announcement to the public shall be made seven days in advance.

The relevant competent departments including the department of culture shall collect the service information of the public cultural facilities, and incorporate such information into the Integrated Online Platform for public inquiry.

Article 23

The people’s governments at all levels shall increase the public cultural services for students, organize the introduction of excellent traditional culture and high art performances to campuses.

The schools shall be encouraged to use public cultural facilities to carry out teaching activities such as moral, aesthetic, intellectual and physical education, and to regularly organize students to visit museums and art galleries, and to watch patriotic education films and classic works of art.

The managing department shall provide convenience with regard to exhibition visits, cultural works appreciation, and facility use for the school’s extra-curriculum activities.

Article 24

The municipal and district public libraries shall set up special areas or seats for Braille reading or audio reading for the blind, and the community cultural activity centers shall have Braille books or audio-books to provide barrier-free reading services.

This Municipality shall encourage the use of sign language or subtitles in news, science popularization, education, documentaries and other television programs; encourage the film and television producers to provide barrier-free versions, and install barrier-free equipment for eligible movie and opera theaters to offer special movies and organize the activities for the barrier-free movie day.

Article 25

This Municipality shall provide public cultural services favorable for the elderly through the elderly activity centers, community cultural activity centers and other public cultural facilities.

The elderly service providers shall be encouraged and supported to set up public cultural activity areas to provide convenience for the elderly’s cultural activities.

Article 26

This Municipality shall improve the public cultural service system at the municipal, district, sub-district office or town, and neighborhood or village levels, strengthen the connection between the supply and demand of public cultural service provision, and enhance the efficiency and efficacy of service distribution.

The people’s governments at all levels and the departments of culture, press and publication, film administration and sports shall increase the provision of public cultural services in outer suburbs and large resident communities.

Article 27

The people’s governments at all levels shall organize and provide mobile cultural services such as mobile libraries, mobile exhibitions, mobile performances, and film showings for the public; and shall, according to the actual circumstances, provide public reading boards (screens), self-service cultural facilities, and other facilities and equipment to provide accessible and convenient public cultural services in public places with large flows of people.

Article 28

The departments of culture, and economy and informatization shall be responsible for organizing and implementing the construction of a public cultural service digital platform, integrate the public cultural service data, connect with the new government media and the Integrated Online Platform, innovate the methods of providing public cultural services, promote the use of the Internet and the radio and television network to provide public cultural services, and improve the capabilities for targeted services.

The people’s governments at all levels and their relevant competent departments such as the department of culture shall rely on the public cultural service digital platform and other channels to establish a public culture demand and feedback system.

Chapter IV  Popular Cultural Activities

Article 29

The people’s governments at all levels shall improve the mechanism for popular cultural activities, and support activities and programs such as launching a nationwide reading project, law publicity, fitness for all, popularization of science and arts, and excellent traditional culture experience.

Article 30

Citizens, legal persons and other organizations are encouraged to voluntarily carry out reading exchanges, lectures, books exchange and sharing, and other reading-related activities for people to form good reading habits.

The relevant organizations or individuals shall be encouraged to provide reading promotion service for the people.

The people’s governments at all levels and their relevant departments shall organize reading guidance, recommendation of good readings, and other activities of the nationwide reading project.

Article 31

The public are encouraged to voluntarily learn about the Constitution and laws to improve their knowledge and awareness of law.

The people’s governments at all levels and their relevant departments shall promote the socialist rule-of-law culture, increase the creation and promotion of legal cultural works, conduct law publicity in various forms and case explanations and other popular legal cultural activities, and improve the people’s respect for, compliance with, learning, and application of law.

Article 32

The public shall be encouraged to engage in fitness activities, improve their fitness skills and form the habit of physical exercise.

The community sports organizations and the primary-level fitness teams shall be encouraged to organize fitness activities and sports competitions.

The popular sports and fitness activities shall comply with relevant provisions and the public order, and shall not affect others’ work and life. The town/township people’s governments, the sub-district offices and the managing departments shall better organize and coordinate their local activities and ensure them in good order.

Article 33

The public shall be encouraged to take part in science popularization activities, oppose feudal superstitious activities, and uphold the scientific spirit.

Mass organizations including the science and technology association shall be encouraged to conduct mass, social and regular science popularization activities to disseminate scientific knowledge, advocate scientific methods, communicate scientific ideas, and uphold the scientific spirit.

The people’s governments at all levels and their relevant departments shall formulate working plans on science popularization, provide policy guidance, and conduct supervision and inspection, so as to promote the development of science popularization.

Article 34

The cultural performance groups and performance venue management organizations shall be encouraged and supported to carry out universal art popularization activities including art performances, art education and art guidance.

The competent department of culture shall organize art professionals, primary-level core cultural workers, and volunteers to provide artistic guidance for popular cultural activities.

Article 35

The cultural exhibitions, contests and other forms shall be encouraged and supported to disseminate and communicate the excellent traditional culture.

The managing department shall organize and carry out activities for the dissemination and communication of the excellent traditional Chinese culture and local special-feature cultures including opera, calligraphy, painting, and martial arts.

The representative projects of intangible cultural heritage shall be encouraged to be reasonably used to develop local and ethnic public cultural products and services. The representative inheritors of intangible cultural heritage shall be encouraged to carry out knowledge and skills dissemination, demonstration and performance.

Article 36

This Municipality shall encourage and support the establishment of people’s cultural teams characterized by self-education, self-management and self-service, and guides the healthy, standardized and orderly development of their cultural activities.

The community cultural centers and other managing departments shall provide guidance, art training, information and facilities for popular cultural activities.

The departments of culture and sports and mass organizations such as trade union, youth league, women’s federation, disabled person’s federation, and the science and technology association shall support and foster the development of people’s cultural teams, and improve the quality of people’s cultural activities.

Article 37

The public are encouraged to voluntarily carry out folk cultural activities that inherit and disseminate local cultural traditions and meet the needs of the farmers.

The people’s governments at all levels and their relevant departments shall support the people’s cultural activities, festivals and folklore activities in rural areas, attach importance to the discovery and development of local cultural products, and increase the public cultural services in rural areas.

Chapter V  “Shanghai Culture” Brand Building

Article 38

According to the objective of faster establishment of a socialist international cultural metropolis, this Municipality shall adhere to the national standards, highlight Shanghai’s characteristics, strengthen the building of the “Shanghai Culture” brand, and inherit and carry forward the red culture, Shanghai local culture and the “Jiangnan culture” (culture of the area south the Yangtze River) and other special-feature cultures, so as to promote the quality development of public cultural services.

Article 39

The people’s governments at all levels shall improve the systems for red culture inheritance, innovation, spread and development, protect and use red culture resources including the founding history of the Communist Party of China, deepen the exploration and promotion of the glorious history of Shanghai as the birthplace of the Communist Party of China, and develop the red culture brand.

Article 40

The people’s governments at all levels shall make use of the characteristics of Shanghai local culture, and take the celebrities, landmark buildings and historical events of Shanghai as the carriers to strengthen the Shanghai culture brand development, enrich Shanghai local culture, and inherit the cultural traditions of Shanghai.

Article 41

The people’s governments at all levels shall attach importance to the protection of historical sites such as the small towns with the Jiangnan culture characteristics and intangible cultural heritage, add new meanings and forms to the Jiangnan culture, enhance the Jiangnan culture brand building, and heighten people’s sense of cultural identity and sense of belonging.

Article 42

This Municipality shall support China (Shanghai) International Art Festival, Shanghai International Film Festival, Shanghai TV Festival, Shanghai Book Fair, Shanghai Spring International Music Festival, Shanghai Tourism Festival and other important brand festivals, and shall amplify the public-benefiting effect by arranging more non-profit shows and tickets.

This Municipality shall strive to improve the quality of major sports events including the Shanghai Marathon, organize the people’s sports activities including the Citizens Sports Meeting, and foster and protect local original brand sports events with great social influence, high brand reputation and independent intellectual property rights.

This Municipality shall strengthen the work on science popularization, and organize branding activities such as the Shanghai Science Festival.

Article 43

The people’s governments at all levels shall strengthen the construction of quality public cultural spaces, cultivate the red culture, Shanghai local culture and the Jiangnan culture landmarks, and support high-level public cultural activities by relying on the regional advantages and features of the cultural landmarks.

Article 44

This Municipality shall strive to foster exemplary cultural teams with local characteristics and influence that specialize in traditional opera, folk art, and modern art. The competent department of culture shall provide professional guidance and an exchange and demonstration platform for these teams.

Article 45

The local art creation based on rural cultural traditions and farmers’ cultural needs shall be encouraged to promote the development of beautiful rural culture with Shanghai characteristics.

Article 46

The managing departments for libraries, cultural centers, museums (memorial halls), art galleries, and science and technology museums shall enhance the original research and development of public-culture digital products through smart digital information technologies, expand the application of public cultural services, and improve the quality of public-culture digital products.

Article 47

The managing departments for public libraries, cultural centers, State-owned museums (memorial halls), State-owned art galleries, and science and technology museums as stipulated by the provisions of the State may develop original cultural products, the revenues from which shall be incorporated into the department budget for the purpose of improving public cultural services, continuing investment in creative cultural product development, or incentivizing the eligible persons.

Article 48

This Municipality shall establish a sustainable-development mechanism for Shanghai Citizens Art Festival, implement a public cultural service mode featured by the interaction, development and sharing among the government, the market and the society, and enhance the platform effect.

The different regions and industries shall be encouraged and supported to carry out public cultural activities with regional or industrial characteristics based on their own cultural resources, implement brand-fostering projects, and expand the influence of public cultural services.

Article 49

The competent department of culture shall play the exemplary role in the innovative projects of public culture, guide and support the citizens, legal persons and other organizations to provide quality public cultural services.

The competent department of culture shall establish a recommendation and exchange platform, improve the connection between the supply and demand of public cultural services, optimize regional resource distribution, and provide more quality public cultural services.

Article 50

This Municipality shall encourage and support the use of foreign-oriented communication channels in foreign affairs, tourism, commerce and education to carry out international cooperation and exchanges in public culture, and improve the influence of public cultural service brands.

Chapter VI  Social Participation

Article 51

This Municipality shall encourage and support citizens, legal persons and other organizations to participate in the construction and management of public cultural facilities, the provision of public cultural services, and other relevant activities.

Article 52

The government departments, public institutions, and enterprises shall, on the premise of ensuring their normal operations, be encouraged to create conditions to open their cultural and sports facilities to the public.

The public schools shall create conditions to open their cultural and sports facilities to the public without affecting their normal teaching, and the private schools shall be encouraged to open their cultural and sports facilities to the public. The municipal and district people’s governments and their relevant departments shall support the schools that open their cultural and sports facilities to the public in their operations, management, maintenance and accident insurance.

Article 53

This Municipality shall expand the offline and online space for public cultural services and activities by relying on the public space and facilities along the Huangpu River and the Suzhou River, and the online platforms including the Culture in the Cloud platform.

The departments in charge of managing the parks, squares, scenic spots, shopping malls, transportation stations and other public spaces shall be encouraged to provide convenience for public cultural activities in their public spaces.

Article 54

This Municipality shall adopt measures such as government procurement to support the citizens, legal persons and other organizations to participate in the provision of public cultural services. The range and contents for government procurement of public cultural services shall be regulated by the guiding directory and published according to the provisions.

The purchasers of public cultural services shall establish and improve an internal supervision and management system, disclose the relevant information about the purchase of services in accordance with the provisions, and accept audit supervision and public supervision.

Article 55

This Municipality shall encourage and support the citizens, legal persons and other organizations to construct public cultural facilities independently, by donations, or jointly with government departments, and to participate in the operation and management of public cultural facilities according to law.

A public cultural facility donated by a single donor or mainly funded by a donor may be named after the donor or by the donor, and the name for the public cultural facility shall be approved by the competent department of culture before being submitted to the same-level people’s government for approval, unless otherwise provided by laws and rules.

Article 56

This Municipality shall encourage and support cultural facilities including museums, art galleries and libraries built by citizens, legal persons and other organizations, as well as for-profit cultural organizations including cinemas and opera houses to provide public cultural services through free use, preferential prices, or non-profit shows or tickets.

The municipal and district people’s governments and their competent departments of culture, etc. may provide the aforesaid projects with financial support including subsidies if the conditions of the preceding Paragraph are met.

Article 57

The citizens, legal persons and other organizations that donate properties for public cultural services through non-profit social groups or the municipal or district people’s governments and their departments are entitled to tax incentives according to law.

The departments of finance, tax and civil affairs shall support the eligible non-profit social groups to apply for pre-tax deduction for donations for non-profit purposes according to law.

Article 58

This Municipality shall encourage and support legally-established industry organizations for public cultural services to formulate industry regulations, promote industry discipline, enhance industry services, safeguard the members’ legitimate rights and interests, guide and supervise the members’ activities, and improve the quality of public cultural services.

Article 59

The citizens, legal persons and other organizations shall be encouraged to participate in cultural volunteer services.

The managing departments shall establish and improve the cultural volunteer service mechanism, improve the volunteer recruitment, training, assessment and incentive mechanism, publish the cultural volunteer service projects, and organize cultural volunteer service activities.

The departments of culture, education, sports, and science and technology shall provide necessary guidance and support for cultural volunteer service activities.

Chapter VII  Guarantee Measures

Article 60

The people’s governments at all levels shall, according to the economic and social development needs and the financial conditions, incorporate the public cultural service budget into their respective fiscal budget, and arrange the funds necessary for public cultural services .

The people’s governments at all levels shall give priority to the funds for ensuring basic public cultural services according to the division of responsibilities concerning fiscal affairs and expenditures.

The Municipal People’s Government may apply such methods as transfer payment to support the work on public cultural services in outer suburbs.

This Municipality shall gradually improve the subsidy scheme for non-profit shows, support cultural performance groups and performance venue management organizations to provide non-profit cultural services at preferential prices or free of charge.

Article 61

The people’s governments at all levels shall reasonably set up public cultural service posts and arrange professionals according to the functions and tasks of the public cultural service facilities and the population size to be served.

The town/township people’s governments and the sub-district offices shall, according to this Municipality’s implementation standards for basic public cultural services, employ staff for community cultural centers to work for community public cultural services.

The neighborhood/villagers’ committees shall arrange staff to manage the community/village comprehensive cultural activity rooms. The town/township people’s governments and sub-district offices may provide the necessary fund.

Article 62

The municipal human resources and social security department shall reasonably optimize the proportion of professional posts in non-profit public cultural institutions based on the needs for public cultural undertaking development.

The non-profit public cultural institutions shall optimize their internal assessment mechanism and give preferential treatment to the staff at key posts, the key staff and the well-performing staff based on the principle of connecting good performance with better payment.

People engaged in public cultural services in cultural institutions other than those specified in the preceding Paragraph shall enjoy the same treatment as people of non-profit public cultural institutions in terms of professional title evaluation, study and training, project application, commendation and awards organized by relevant departments.

Article 63

The managing departments, higher education institutions and research institutes shall be encouraged and supported to conduct theoretical research on public culture.

The departments of culture and sports shall regularly train the managing staff, professionals and technicians engaged in public cultural services to improve their professionalism and capabilities.

The managing departments shall formulate training plans and conduct various levels and types of training based on the needs of different posts.

Article 64

The people’s governments at all levels shall enhance supervision and inspection of the work on public cultural services, establish an assessment and evaluation mechanism on the efficacy of public cultural facility use and the work on public cultural services. The assessment and evaluation results shall be made known to the public, and used as the basis for work improvement, service upgrading, and determination of subsidies or awards.

The assessment and evaluation shall invite public participation by such means as public satisfaction assessment and field visits.

Article 65

The standing committees of the municipal and district people’s congresses shall enhance supervision over the implementation of these Regulations by listening to and deliberating over the special work reports, conducting law enforcement inspections, or by other means.

The standing committees of the municipal and district people’s congresses shall bring the role of deputies to the people’s congresses at all levels into full play, organize the deputies to conduct activities such as targeted investigations and inspections on the guarantee and promotion of the public cultural services, collect and report the people’s opinions and suggestions, and urge the relevant parties to implement the various tasks of this Municipality’s public cultural services.

Chapter VIII  Legal Liabilities

Article 66

Any act that violates these Regulations, the Law of the People’s Republic of China on Guaranteeing Public Cultural Services, other laws or administrative rules shall be handled according to the provisions of those laws and administrative rules if any.

Article 67

If the people’s governments at all levels and their departments fail to guarantee the public cultural services in violation of these Regulations, the higher-level authority or the supervisory authority shall order them to make corrections within a prescribed time limit; if the circumstances are serious, the persons directly in charge and other persons directly responsible shall be sanctioned according to law.

Article 68

The managing departments have the authority to dissuade and stop the acts that damage public cultural facilities or disturb the order of public cultural facility management; if their dissuasion or stop is ineffective, they may refuse to provide the service.

If anyone damages the public cultural facilities or disturbs the order of public cultural facility management, which constitutes a violation of the public security order, he/she shall be subject to administrative penalties by the public security department; if such an act constitutes a crime, he/she shall be subject to criminal liability according to law.

Chapter IX  Supplementary Provision

Article 69

These Regulations shall be effective as of January 1, 2021.
