Announcement of the Standing Committee of Shanghai Municipal People's Congress No. 66

Regulations of Shanghai Municipality on Traditional Chinese Medicine were adopted at the 30th Session of the Standing Committee of the 15th Shanghai Municipal People’s Congress on March 24, 2021 and are hereby promulgated. They shall be effective as of May 1, 2021.

Regulations of Shanghai Municipality on Traditional Chinese Medicine

Chapter I  General Provisions

Article 1 With a view to inheriting and carrying forward traditional Chinese medicine (TCM), ensuring and promoting the inheritance and innovative development of TCM in this Municipality, advancing the construction of a healthy Shanghai, and protecting public health, in accordance with the Traditional Chinese Medicine Law of the People's Republic of China and other laws and administrative rules and in the light of the actual circumstances of this Municipality, these Regulations were formulated .

Article 2 These Regulations apply to the activities of service, development and management of TCM, personnel training, inheritance and innovation, cultural dissemination and open-up development of TCM, and related guarantee and supervision within the administrative area of this Municipality.

Article 3 This Municipality shall follow the law of development of TCM, adhere to the combination of inheritance and innovation, develop the cause of TCM, promote the modernization and industrialization of TCM, and give full play to the unique advantages and effects of TCM in disease prevention and treatment.

This Municipality shall adhere to the equal emphasis on TCM and Western medicine, promote mutual learning, complementation and coordinated development of TCM and Western medicine, and promote the integration of TCM and Western medicine.

Article 4 The municipal and district people’s governments shall include the TCM undertaking in the national economic and social development plan, include the TCM work in the scope of government performance assessment, establish and improve the TCM management system and develop the coordination mechanism for TCM work, and coordinate the promotion of high-quality development of the TCM undertaking.

Town/township people's governments and sub-district offices shall provide support for the promotion and application of TCM within their jurisdiction, and give play to the role of TCM in community health services.

Article 5 The municipal and district TCM management departments shall be responsible for the management of TCM within their respective administrative regions.

Departments of development and reform, health, finance, economic informatization, medical insurance, market regulation, drug supervision, agriculture and rural areas, education, science and technology, human resources and social security, commerce, cultural tourism, sports, intellectual property, archives, etc. shall, in accordance with their respective duties and functions, jointly do a good job in the management of TCM.

Article 6 This Municipality shall strengthen the construction of a TCM service system, improve relevant plans, rationally allocate TCM service resources, improve the TCM service network, and establish the TCM service system integrating preventive health care, disease treatment and rehabilitation, with the municipal-level TCM institutions as the “locomotive”, the district-level TCM institutions and the TCM departments of other medical service institutions as the backbone, community health services as the foundation, and the TCM institutions organized by social forces as the components to provide TCM services covering the whole people and the whole life cycle.

Article 7 According to the needs of the development of TCM, this Municipality shall establish a TCM personnel cultivation system organically linking institute education, post-graduation education and continuing education of TCM, keeping on master-apprentice education on an appropriate scale and with rational specialties and structure.

Article 8 This Municipality shall encourage and support the scientific research and innovative development of TCM, improve the scientific research evaluation system of TCM, promote the application of scientific research results of TCM, protect intellectual property rights of TCM, and improve the scientific and technological level of TCM.

Article 9 This Municipality shall promote the establishment of a coordinated development mechanism for TCM in the Yangtze River Delta, strengthen regional cooperation in TCM, build a platform for TCM inheritance and innovation, and promote the joint development of TCM services, education, scientific research, and industry.

This Municipality shall promote foreign exchanges and cooperation of TCM, actively promote TCM culture, develop TCM service trade, and promote the international dissemination and application of TCM.

Article 10 Encourage TCM academic groups to organize academic exchanges and TCM consulting services, publicize TCM knowledge, and carry out continuing education for TCM personnel.

Encourage TCM industry associations to participate in the formulation of TCM industry standards and regulations, organize industry consultation, evaluation and technical training, promote industry exchanges, reflect industry demands, and strengthen industry self-discipline and integrity building.

Article 11 This Municipality shall support social forces to invest in the cause of TCM, and encourage organizations and individuals to donate to and aid financially the cause of TCM.

Article 12 This Municipality shall, in accordance with the relevant provisions, commend and reward organizations and individuals that have made outstanding contributions to the development of TCM.


Chapter II TCM Services

Article 13 The municipal and district people's governments shall incorporate the construction of TCM institutions into health-related plans such as the establishment of medical institutions. According to factors such as regional functions, population distribution, and health service needs, they shall establish TCM medical institutions with a comparable number and on an appropriate scale. There shall be no less than one independent TCM hospital established by the government in the administrative area of each district.

To merge or abolish a government-sponsored TCM medical institution or change the nature of TCM medical treatment, the opinions of the TCM management department of the people's government at the next higher level shall be sought.

Article 14 General hospitals, maternal and child health care institutions, community health service centers, and infectious disease hospitals run by the government shall incorporate the construction of TCM disciplines and the development of talents into the overall planning of medical institutions, set up TCM departments, and establish a cooperative mechanism of TCM and Western medicine, and carry out cross-hospital and cross-professional medical services and research.

Article 15 The municipal and district people’s governments, town/township people’s governments, and sub-district offices shall take measures to provide corresponding guarantees in the allocation of TCM facilities and equipment, staffing and service provision, and improve TCM service capabilities of community health service centers (stations) and village health rooms and other grassroots health services, and advance the development of the family doctor system integrated with TCM and realize the full coverage of TCM in family doctor team services.

The municipal TCM management and other departments shall increase the efforts of high-quality TCM resources to serve the grassroots by organizing TCM experts to serve in the community, setting up specialist and specialized disease alliances, and establishing famous TCM doctors’ studios at the grassroots level.

Article 16 This Municipality shall support the establishment of TCM institutions by social forces, and encourage the development of chain- and brand-orientation. TCM medical institutions run by social forces shall enjoy the same rights as government-run TCM medical institutions in terms of access, practice, basic medical insurance, scientific research and teaching, and evaluation of professional titles for medical personnel.

Encourage other medical institutions organized by social forces to comprehensively use TCM diagnosis and treatment techniques and methods to provide TCM services.

Article 17 The establishment of a TCM medical institution shall go through the relevant examination and approval procedures in accordance with the relevant provisions of the State and this Municipality, and shall abide by the relevant regulations on the management of medical institutions.

A TCM clinic to be run may conduct practice upon reporting the name, address, scope of diagnosis and treatment, and staffing of the clinic to, and being filed with, the local district TCM management department in accordance with the relevant national provisions. TCM clinics shall publicize the scope of diagnosis and treatment, the names of TCM physicians and their scope of practice in an obvious place of the clinic, and shall not carry out medical activities beyond the scope of filing.

Article 18 A person engaged in TCM medical activities shall obtain the qualifications of TCM physicians in accordance with the law and shall register for practice.

For those who have been studying TCM in this Municipality through a master-apprentice method or who have proven expertise in medicine after years of practice, the municipal TCM management department shall implement the qualification examination and registration management of TCM doctors in accordance with relevant national provisions.

Article 19 TCM medical institutions shall, in accordance with the relevant provisions of the State and this Municipality, be staffed with mainly TCM professionals and technicians, and mainly provide TCM services. Other medical institutions that provide TCM services shall be reasonably equipped with professional and technical personnel in TCM.

The development of TCM services shall be guided by the theories of TCM, apply the technical methods of TCM, and comply with the basic requirements for TCM services formulated by the State and this Municipality.

Encourage various medical institutions to cooperate in TCM, and support the development of new TCM medical services such as long-distance, mobile and smart TCM treatment.

Article 20 This Municipality shall establish and improve the TCM quality management system, formulate and improve the TCM quality management system and standards, and strengthen the quality management and control of the whole industry.

Medical institutions shall, in accordance with the requirements of the TCM medical quality management system and standards, strengthen TCM medical quality and safety management, and continuously improve the quality of TCM medical services.

Article 21 This Municipality shall encourage municipal TCM hospitals to take advantage of brand, medical management and subject technical talents, establish regional TCM medical consortia or medical groups, and strengthen the integration of talents and the standardization of technology and management.

Article 22 This Municipality shall encourage medical institutions at all levels and of various types to comprehensively use TCM technology and modern medical technology, promote the integration of TCM and Western medicine resources, and support the establishment of TCM and Western medicine clinical collaboration mechanisms for the prevention and treatment of chronic diseases, infectious diseases, and difficult diseases, form the integrated TCM and Western medicine diagnosis and treatment plan, and promote the integrated development of TCM and Western medicine.

TCM physicians who have obtained medical qualifications through examinations may adopt modern scientific and technological methods related to their professions in their practice activities after training and passing examinations in accordance with the relevant national and municipal provisions.

Non-TCM practitioners may provide TCM services in accordance with the relevant national provisions and participate in the evaluation of integrated TCM and Western medicine titles after they have passed the TCM education with record of formal schooling or participated in the systematic training of TCM organized or approved by the municipal TCM management department and passed the assessment.

Article 23 The municipal and district people's governments shall incorporate TCM into the public health emergency management system, strengthen the building of TCM treatment capacity, carry out the reserve of TCM emergency materials, equipment, facilities, technology and human resources, and establish a joint consultation system for TCM and Western medicine, improve the cooperative treatment mechanism of TCM and Western medicine, and focus on the role of TCM in the prevention and treatment of infectious diseases and emergency treatment of other public health incidents.

When a public health incident occurs, the municipal TCM management department shall promptly organize the formulation of TCM prevention and control plans, sort out the classic prescriptions of TCM, screen effective techniques and methods, formulate TCM treatment plans, and guide medical and health institutions to use TCM techniques and methods throughout the process of prevention, treatment and rehabilitation.

Article 24 The municipal and district people's governments shall develop TCM prevention and health services, and incorporate them into basic public health service items for overall planning and implementation in accordance with the relevant provisions.

This Municipality shall strengthen the capacity building of medical institutions for preventive medicine services, promote the integration of clinical and preventive medicine services, and provide the public with TCM health consultation and evaluation, intervention recuperation, follow-up management and other preventive medicine services.

Medical and health institutions shall actively use TCM theories and technical methods in disease prevention and control, health education and health promotion, and promote effective prescriptions and characteristic technologies.

Article 25 This Municipality shall develop TCM rehabilitation services, strengthen the building of the rehabilitation service capacity of TCM institutions, and encourage and support rehabilitation hospitals and departments to provide TCM rehabilitation services. Encourage social forces to establish rehabilitation hospitals, nursing homes and other medical institutions with TCM characteristics.

This Municipality shall support cooperation between medical institutions and elderly care institutions to promote integrated medical and elderly care services with TCM characteristics.

Article 26 This Municipality shall develop TCM health care services, support social forces to organize TCM health care institutions that comply with provisions, and register as non-medical TCM health care institutions in accordance with the law. Encourage TCM medical institutions to take advantage of resources such as technology and talents to provide technical support for the standardized development of TCM health care institutions.

TCM health care institutions shall be guided by TCM theories and comply with relevant national norms and standards in conducting health care services. They must not provide TCM medical services, publicize therapeutic effects, or illegally engage in the sale of medicines and medical devices.


Chapter III Development and Management of TCM

Article 27 The planting, breeding, collection, storage, transportation and preliminary processing of traditional Chinese medicinal materials shall comply with the relevant national technical specifications, standards and management provisions to ensure quality and safety.

The municipal departments of TCM management and drug supervision and other departments shall, in conjunction with the municipal market regulation department, formulate and improve relevant technical specifications and standards for traditional Chinese medicinal materials in accordance with the law.

Encourage social organizations and enterprises to formulate group standards and corporate standards for TCM materials that are higher than national, industry, and local standards.

Article 28 The municipal and district people's governments shall support the selection and breeding of local characteristic traditional Chinese medicinal materials and the protection of origin, and support the construction of industrial demonstration bases.

The municipal departments of development and reform, economic informatization, traditional Chinese medicine management, drug supervision and other departments shall take measures to support traditional Chinese medicinal manufacturers to build large-scale, standardized, and industrialized planting and breeding bases of commonly used traditional Chinese medicinal materials in authentic traditional Chinese medicinal materials production areas, and promote the use of high-quality varieties, and improve the quality of Chinese herbal medicines.

Article 29 TCM decoction pieces and formula granules shall be processed and produced in accordance with the national drug standards; if there are no provisions in the national drug standards, they shall be processed and produced in accordance with the specifications established by the municipal drug supervision department.

Article 30 When purchasing TCM materials and decoction pieces, a pharmaceutical manufacturing enterprise shall establish a record system for the inspection of the purchase. Operators of TCM materials and decoction pieces shall establish purchase inspection and purchase and sales record systems, and indicate the place of origin of TCM materials.

Encourage pharmaceutical manufacturing enterprise, operators of TCM materials and decoction pieces, medical institutions, and industry associations to establish an information-based traceability system in accordance with the relevant laws, rules and technical standards.

Article 31 Medical institutions shall establish and improve the pharmaceutical management system of TCM, strengthen the quality management of the whole process of procurement, acceptance, maintenance, prescription making up, and decoction of TCM decoction pieces, and establish a special comment system for prescriptions of TCM decoction pieces to ensure reasonable and safe medication.

Article 32 If a medical institution entrusts relevant units to provide decoction services for Chinese herbal medicines, it shall entrust the producers and operators of Chinese herbal medicines with corresponding sanitary conditions, equipment, and professional and technical personnel. Relevant units shall abide by relevant technical specifications and establish a recording system for the whole process of decoction and a quality tracking, tracing and monitoring system.

The municipal TCM management department shall, in conjunction with relevant departments such as drug supervision, formulate the service standards for the decoction of TCM decoction pieces, and strengthen the quality supervision and management of the decoction service.

Article 33 This Municipality shall support medical institutions to prepare and use TCM preparations according to the needs of clinical medication. The types of TCM preparations prepared by medical institutions shall obtain the preparation approval number in accordance with the law; the types of TCM preparations prepared only by using traditional techniques may be prepared after filing with the municipal drug supervision department in accordance with the provisions, without the need to obtain the preparation approval number.

If a medical institution entrusts the preparation of TCM preparations, it shall entrust a pharmaceutical manufacturing enterprise that has obtained a pharmaceutical production license or other medical institutions that have obtained a medical institution preparation license.

With the approval of the municipal drug supervision department, TCM preparations prepared by medical institutions may be used among designated medical institutions.

Article 34 The development and reform, economic informatization and other departments shall make overall plans for the development of the TCM industry, support the construction of characteristic industrial parks and service platforms, strengthen TCM brand, support and cultivate modern TCM production enterprises, and promote the standardization of the production technology and process of TCM, and improve the modernization and intelligence level of TCM production.


Chapter IV Cultivation of TCM Talents

Article 35 This Municipality shall support the development of higher education institutions that carry out TCM education, and strengthen the construction of clinical and practical teaching bases for TCM colleges in accordance with the national provisions.

The higher education of TCM must follow the laws and characteristics of TCM, focus on the content of TCM, and list the classic courses of TCM as compulsory courses for TCM majors. Clinical medicine majors must include TCM courses as compulsory courses, and increase the proportion appropriately.

This Municipality shall develop vocational education of TCM, and cultivate professional talents in TCM rehabilitation, nursing, health care, health management, and special technical talents in traditional Chinese medicinal identification and preparation of TCM decoction pieces.

Article 36 The municipal education, human resources and social security, TCM management and other departments shall establish a sound coordination mechanism of medical education, promote the connection of post-graduation education of TCM with professional degree education, and establish and improve standardized training of resident physicians and specialist physicians that meets the characteristics of TCM to improve TCM thinking and clinical diagnosis and treatment capabilities of TCM physicians.

Article 37 The municipal education, human resources and social security, TCM management and other departments shall perfect the continuing education system of TCM, improve the job training standards for professional and technical personnel of TCM at all levels and of various types, and carry out special training aiming at the service ability requirements of TCM professional technical positions.

Article 38 TCM master-apprentice education shall fully cover the TCM majors at the educational stage of colleges and universities, and be the main content of the standardized training of TCM resident physicians.

This Municipality shall encourage and support TCM physicians and professionals with rich clinical experience and technical expertise to teach apprentices, which shall serve as an important basis for their professional title review and evaluation.

Article 39 The municipal human resources and social security and TCM management departments shall establish and improve the selection system of famous TCM physicians, carry out the selection of famous TCM physicians, and give play to the leading role of famous TCM physicians in academic inheritance and talent training.

TCM management departments and medical, educational, scientific research and other institutions shall pay attention to cultivating TCM leaders and young and middle-aged professional backbones, and formulate cultivation plans and organize their implementation.

This Municipality shall develop TCM and western medicine combined education and cultivate high-level TCM and western medicine combined talents.


Chapter V Inheritance and Innovation of TCM

Article 40 This Municipality shall establish and perfect the academic inheritance system of famous TCM experts, strengthen the construction of famous and old TCM experts' studios, promote the academic thinking and clinical diagnosis and treatment experience of contemporary famous and old TCM experts, and tap, organize and inherit the academic thoughts of Shanghai-style TCM, clinical diagnosis and treatment experience and traditional technology, advance the inheritance project of Shanghai school of TCM, and cultivate the brand of Shanghai school of TCM.

The municipal TCM management department shall organize the selection of TCM academic inheritance projects and inheritors, and provide necessary conditions for inheritance activities. The inheritor shall carry out inheritance activities, cultivate successors, collect, sort and properly preserve the relevant academic materials

This Municipality shall support the collection, sorting, research, and utilization of TCM ancient documents and folk TCM diagnosis and treatment techniques, prescriptions, etc., and shall carry out academic theoretical research on TCM.

Article 41 The municipal and district people’s governments shall include the TCM projects that reflect the outstanding traditional culture of the Chinese nation in their administrative areas in the list of representative projects of intangible cultural heritage, increase protection and support, and cultivate representative inheritors and successor talents.

Article 42 This Municipality shall incorporate the scientific research and technological development of TCM into the scientific research and technological development plan, establish special research and development projects for TCM science and technology, and support the construction of TCM scientific research platforms.

The municipal science and technology department and the TCM management department shall establish a coordinated linkage mechanism of the TCM science and technology planning and management, establish a scientific research evaluation system that conforms to the laws and characteristics of TCM, improve the mechanism of project approval, review, reward, and performance evaluation of TCM scientific research projects, and promote TCM innovation and development.

Article 43 This Municipality shall support enterprises to independently research and develop innovative TCM and new TCM based on ancient classic prescriptions, famous and old TCM physicians’ experience prescriptions, and medical institution preparations, use new technologies, processes, and formulations to improve the varieties of TCM that have been listed, and carry out the research and development of TCM medical equipment and pharmaceutical equipment.

Article 44 This Municipality shall support the cooperation of medical institutions, colleges and universities, scientific research institutions and enterprises to promote the integrated, coordinated and innovative development of TCM production, study, research and application.

The municipal science and technology and TCM management departments shall, in accordance with their respective duties and functions, establish and improve a mechanism for the transformation of scientific and technological achievements of TCM, link up with institutions and talent evaluation mechanisms, strengthen the construction of transformation bases for scientific and technological achievements of TCM, and promote the transformation and application of scientific and technological achievements of TCM.


Chapter VI Communication and Open-up Development of TCM Culture

Article 45 This Municipality shall support the construction of museums and cultural publicity bases with TCM characteristics, cultivate popular science teams of TCM culture, and promote TCM health and wellness culture.

Departments of education and TCM management shall instruct elementary and middle schools to carry out popular science education on TCM knowledge that is easy to understand.

Newspapers, radio, television, and Internet information service providers shall carry forward the culture of TCM, and invite professional and technical personnel of TCM to popularize knowledge of and expand the influence of TCM.

Carrying out activities of publicity and knowledge dissemination of TCM culture shall abide by the relevant national regulations. No organization or individual shall make false or exaggerated publicity on TCM, or use the name of TCM to seek illegitimate interests.

Article 46 The municipal departments of TCM management, cultural tourism, sports, etc. shall support the integrated development of TCM with tourism, culture, and sports industries, and develop tourist attractions, routes, and bases with the characteristics of TCM, as well as TCM health and wellness products and service projects integrated with tourism, culture, and sports industries.

Encourage the research and development of TCM cultural and creative products, and create TCM culture and popular science works.

Article 47 The municipal departments of TCM management and drug supervision shall take measures to support relevant professional institutions and personnel to participate in the formulation of international standards of TCM and related rules of international traditional medicine.

TCM institutions of higher learning shall improve their ability to serve TCM international education and attract overseas students to come to China for TCM education and training.

Article 48 The municipal commerce and TCM management departments shall cultivate market entities with core competitiveness in the TCM service trade, push the construction of an international service trade platform for TCM and support TCM enterprises in opening up overseas markets.

Encourage qualified TCM health care and wellness institutions to develop overseas TCM health care and wellness, education, culture and other services to increase the international influence of TCM.


Chapter VII Guarantee and Supervision

Article 49 The municipal and district people’s governments shall include the development funds for TCM undertakings in their fiscal budgets, gradually increase funding input, and make overall arrangements for supporting TCM medical treatment, education, personnel cultivation, scientific and technological innovation, and industrialization of scientific and technological achievements, and other key projects.

Article 50 The Municipal People’s Government and its relevant departments shall, when formulating policies on basic medical insurance payment, drugs, prices, and other medical and health, fully listen to the opinions of the TCM management department, pay attention to the advantages of TCM, and improve the medical insurance payment mode suitable for characteristics of TCM to promote the provision and utilization of TCM services.

The municipal medical insurance department shall reasonably determine the charging items and price standards of TCM medical services, reflect the clinical value and technical labor value of TCM medical services, and implement dynamic adjustments.

The municipal medical insurance department shall, in accordance with the relevant national and municipal provisions, include qualified TCM medical institutions in the scope of designated medical institutions for basic medical insurance, and include qualified TCM decoction pieces and TCM preparations in medical institutions, as well as TCM medical services with curative effects and cost advantages in the payment scope of the basic medical insurance fund to ensure that the people receive high-quality TCM services.

This Municipality shall, relying on relevant industry associations, establish a quality grading evaluation system for TCM decoction pieces. The municipal medical insurance department shall improve the relevant procurement policies to promote high-quality and economical price of TCM decoction pieces.

Article 51 The municipal human resources and social security, TCM management and other departments shall improve the system of salary and benefits, professional title evaluation and appointment, commendation and rewards, etc., and establish and improve the classification and evaluation system of TCM talents and performance evaluation indicators that conform to the laws and job characteristics of TCM to stabilize and develop the professional and technical team of TCM, and appropriately tilt to the grassroots and suburbs.

Article 52 When carrying out the following related activities, an expert group for the review, evaluation, and appraisal of TCM shall be established, or TCM experts shall be the main group:

1.selection of TCM drugs and diagnosis and treatment technology included in the basic medical insurance drugs and diagnosis and treatment items catalog;

2. formulation and adjustment of charging items and price standards for TCM medical services;

3. evaluation of qualifications for TCM professional and technical positions;

4. review and evaluation of TCM treatment, teaching and scientific research institutions;

5. review and appraisal of TCM scientific research projects and achievements;

6. identification of TCM medical malpractice or medical damage; and

7. other activities related to the review, evaluation, and appraisal of TCM.

Article 53 The municipal and district TCM management departments and the government-run medical institutions shall establish and improve the assessment and evaluation system of TCM institutions that meet the characteristics of TCM, implement the functional positioning of TCM services of government-sponsored TCM institutions, and guide TCM institutions to improve service quality and operational efficiency. When conducting assessment and evaluation work on other government-sponsored medical institutions, the content of TCM shall be included.

Article 54 The municipal and district TCM management departments shall strengthen the building of TCM supervision capabilities, rationally allocate personnel and carry out supervision and inspection of TCM services.

The municipal drug supervision department shall, according to its duty, strengthen the supervision and random inspection of the quality of traditional Chinese medicinal materials, TCM decoction pieces and preparations in medical institutions, and shall regularly announce the results of quality random inspections.

The market regulation department shall, in conjunction with relevant departments, strengthen the supervision and management of TCM health care services. The health department shall investigate and punish the illegal medical practices of TCM health care institutions in accordance with the law.


Chapter VIII Legal Liability

Article 55 For violations of the provisions of these Regulations, if there are already penal provisions in the Traditional Chinese Medicine Law of the People's Republic of China and relevant laws and administrative rules, those provisions shall be followed.

Article 56 Where the municipal or district TCM management department and other relevant departments violate these Regulations by committing one of the following acts, the people’s government at the same level or the relevant department of the people’s government at a higher level shall order correction; if the circumstances are serious, the chiefs who are directly responsible and other persons directly responsible shall be punished according to law; if a crime is constituted, criminal liability shall be investigated according to law:

1. in violation of provisions, cancel or merge government-sponsored TCM medical institutions or change their nature;

2. issue practice licenses or certificates in violation of provisions;

3. fail to investigate and punish according to law any unlawful conduct that is found;

4. withhold or embezzle the development funds of TCM; or

5. other acts of abuse of power, negligence of duty, and malpractice for personal gain.

Article 57 Relevant information about institutions and individuals who have been given administrative penalties or investigated for criminal liability for violations of laws and rules in TCM activities shall be included in the public credit information platform in accordance with the provisions, and relevant departments shall implement credit punishments in accordance with the law.


Chapter IX Supplementary Provision

Article 58 These Regulations shall be effective as of May 1, 2021. Regulations of Shanghai Municipality on the Development of Traditional Chinese Medicine adopted at 5

Session of the Standing Committee of the 11

th

Shanghai Municipal People's Congress on September 22, 1998 shall be repealed at the same time.
