Regulations of Shanghai Municipality on Advancing the Development of Shanghai Hongqiao International Central Business District were adopted at the 45th Session of the Standing Committee of the 15th Shanghai Municipal People’s Congress on October 28, 2022, and are hereby promulgated. They shall be effective as of November 1, 2022.

Shanghai Hongqiao International Central Business District

Chapter I  General Provisions

Article 1

with a view to advancing the development of Shanghai Hongqiao International Central Business District (hereinafter referred to as the “Business District”), promoting the construction of the Hongqiao International Opening-up Hub, serving the state strategy of integrated development of the Yangtze River Delta region (hereinafter referred to as the “Yangtze River Delta”), and ensuring higher-standard and in-depth reform and higher-level opening up, these Regulations are formulated in accordance with the Outline for the Integrated Regional Development of the Yangtze River Delta, the Overall Plan for the Construction of the Hongqiao International Opening-up Hub (hereinafter referred to as the “Overall Plan”), and relevant laws and administrative rules, and in the light of the actual circumstances of this Municipality.

Article 2

These Regulations shall apply to activities including the planning, construction, administration, service and support for the development of the Business District.

Article 3

The Business District shall strive to build a new development pattern of positive interplay between domestic circulation and international circulation, advance the creation of such functions as an international central business district, a new platform of the international trade , and an integrated transport hub, bring into full play the Business District’s role in allocating global resources, driving scientific and technological innovations, leading the development of high-end industries, and serving as a gateway and hub for opening-up, so that the Business District will become an important growth pole for the city of Shanghai to enhance its capacity and core competitiveness, an important driver to lead the integrated development of the Yangtze River Delta, an important entity to implement the state strategies, and a landmark area for advancing reform and opening-up in the new era.

Article 4

The Municipal People’s Government shall strengthen its leadership over the work related to the Business District and make overall planning and coordination for the construction and development of the Business District.

The municipal development & reform department shall be responsible for promoting major institutional reforms, comprehensive policy making and major investment projects in the Business District, and pushing forward the interactive development of the Hongqiao International Opening-up Hub with the Business District at its core (“One Core”) and with the northward and southward extended regions as the “Two Extended Regions”.

The municipal commerce department shall be responsible for guiding and coordinating the development of the convention and exhibition economy and the international trade ’s new platform in the Business District, so as to drive the upgrading of the regional open economy.

The municipal planning and natural resources department shall be responsible for the planning and land management in the Business District, and for making an overall spatial layout for shared use of facilities.

The municipal transportation department shall be responsible for making overall guidance for the operation of the Hongqiao Integrated Transport Hub and promoting the construction of major transportation projects in the Business District.

Other relevant municipal departments shall assume their respective responsibilities to jointly improve the relevant administration and service for the Business District.

The Minhang, Changning, Qingpu and Jiading District (hereinafter collectively referred to as “the Four Districts”) People’s Governments shall advance the work related to the Business District in line with the Overall Plan, the deployment of the Municipal People’s Government, and their respective responsibilities, and in consideration of the features of the industries within their respective jurisdictions.

Article 5

Shanghai Hongqiao International Central Business District Administration Committee (hereinafter referred to as the CBD Administration Committee), as an agency assigned by the Municipal People’s Government, shall make overall arrangements to coordinate with the relevant departments and administrative agencies of the Municipal People’s Government and the District People’s Governments of the Four Districts to perform the following duties:

1. formulating development plans for the Business District, so as to promote its developmental construction and upgrade its functions;

2. participating in drawing up the territorial space planning within the Business District, coordinating for the implementation of the territorial space, and organizing the formulation of special plans within the Business District;

3. working out the development plan and catalogue of industries of the Business District, and making coordinated efforts to guide distribution of industries and cultivation of industry functions within the Business District;

4. coordinating efforts to facilitate investment, improve the business environment and public services, build a pool of talents, etc.;

5. coordinating efforts to make development and construction plans for the Business District, formulating the annual land reserve plan for the Business District and advancing the construction of major investment projects;

6. establishing administrative standards and service criteria to enhance refined city administration;

7. establishing and improving the mechanism for statistics cooperation;

8. advancing the innovation and implementation of policies and systems;

9. providing service and support for the China International Import Expo (hereinafter referred to as the “CIIE”);

10. coordinating the management of transport facilities within the Hongqiao Integrated Transport Hub and of the connection, distribution, transit and transfer between different transport modes;

11. coordinating the allocation of the special development fund for the Business District;

12. guiding and coordinating the People’s Governments of the Four Districts to perform their respective administrative duties to supervise and inspect the implementation of relevant work; and

13. other matters designated by the Municipal People’s Government.

Article 6

The CBD Administration Committee shall take the lead in organizing relevant departments and administrative agencies of the Municipal People’s Government and the people’s governments of the Four Districts to communicate among them on important situations, coordinate to tackle major issues, and specify relevant measures and their respective duties.

The CBD Administration Committee shall strengthen its guidance for the designated agencies of the People’s Governments of the Four Districts that are responsible for the work related to the Business District. The designated agencies shall report the progress of their work to the CBD Administration Committee on a regular basis.

The CBD Administration Committee shall, in accordance with the requirements of the Municipal People’s Government, establish a mechanism to assess the performance of duties in accordance with the law by the People’s Governments of the Four Districts as well as their progress in reforms and innovations.

Article 7

This Municipality shall, in accordance with the authorization of the State and in line with the needs for the development of the Business District, implement pilot opening-up programs in key areas, establish a system that is compatible with international rules and norms, gather business flow, capital flow, information flow, etc., and explore measures to expand opening-up in such fields as digital trade, financial service, information service, and convention and exhibition service, so as to build the Business District into a frontier for all-round opening-up.

The major reform initiatives that need to be tried out in this Municipality may be first launched as pilot projects in the Business District when it is qualified to do so.

Article 8

This Municipality shall establish a mechanism to ensure financial support for the development of the Business District, and for the important infrastructure construction and industrial development in the Business District.

The People’s Governments of the Four Districts shall provide the corresponding financial support for the construction and development of the Business District.

Article 9

The CBD Administration Committee shall establish a consultation mechanism for decision-making and strengthen its cooperation with relevant think tanks, scientific research institutes and universities at the municipal, national and international levels, so as to provide intelligence support to promote the innovation-driven development of the Business District.

Article 10

In accordance with the state development strategies, the Hongqiao International Opening-up Hub with the Business District at its core shall realize the developmental pattern of “One Core” and “Two Extended Regions” which link the adjacent cities and areas of Jiangsu Province and Zhejiang Province to form a northward extended region and a southward extended region.

This Municipality shall cooperate with Jiangsu Province and Zhejiang Province to establish a consultation mechanism for formulating the planning of “One Core” and “Two Extended Regions” to facilitate cooperation on the development planning of “One Core” and “Two Extended Regions”. During the formulation of relevant planning, the opinions of the People’s Governments and relevant departments of the City of Suzhou and the City of Jiaxing shall be solicited.

This Municipality shall promote the coordinated development of “One Core” and “Two Extended Regions” in infrastructure connectivity, synergetic industrial development and unification of market access, so as to form a new pattern of cross-regional cooperation.

Article 11

This Municipality shall strengthen the coordination and joint action between the Business District and other regions in the Yangtze River Delta to advance industrial linkage, business interaction, and resource flow in the Yangtze River Delta, in order to transform the Business District into a hub in the Yangtze River Delta which unblocks domestic circulation and further facilitates interplay between domestic and international circulations.

Chapter II  Regional Planning and Arrangements

Article 12

The formulation of relevant planning of the Business District shall, in line with the highest international standard, be committed to integrating such functions as high-end business, convention/exhibition, and transportation, so as to create an international central business district that is home to a cluster of leading industries, a place of concentration and distribution of global resources, a platform of new business models, and that enjoys efficient infrastructure connectivity, quality public services and diverse human ecologies –- all in an effort to develop the Business District into a landmark international open hub.

Article 13

The CBD Administration Committee shall, jointly with the People’s Governments of the Four Districts, make overall arrangements to formulate a five-year development plan for the Business District.

Article 14

The municipal planning and natural resources department and the CBD Administration Committee shall, in accordance with the territorial space planning of this Municipality, coordinate with the People’s Governments of the Four Districts to make overall arrangements for the drawing-up of the territorial space planning for the Business District and to enhance connectivity at the common boundaries between the districts.

The detailed regulatory plans for each zone of the Business District shall, in accordance with the unit planning, be formulated by the municipal planning and natural resources department jointly with the CBD Administration Committee and the relevant district people’s governments, and shall be submitted to the Municipal People’s Government for approval in accordance with the legal procedures.

The CBD Administration Committee shall, jointly with the municipal planning and natural resources department, competent departments in charge of relevant industries, and the People’s Governments of the Four Districts, organize and advance the formulation of special plans for ecological space, integrated transportation, city landscape, underground space, etc.

The special plans on civil airports, railways and commuter rail lines within the Business District shall be formulated in accordance with relevant laws, rules and regulations.

Article 15

The CBD Administration Committee shall, jointly with relevant departments and administrative agencies of the Municipal People’s Government and the People’s Governments of the Four Districts, and by ing on innovation-intensive industries, build high-caliber headquarters economy, high-end service economy, high-flow trade economy, and convention and exhibition economy with great spillover effect, and formulate and publish plans for industrial development in the Business District in the light of the state and municipal guiding catalogues and relevant policies on industrial structure adjustment.

The CBD Administration Committee shall coordinate the formulation of industrial policies and investment policies of the Business District, so as to promote differentiated and coordinated development among the zones of the Business District.

Article 16

The CBD Administration Committee shall, jointly with the People’s Governments of the Four Districts, formulate plans for annual land reserve, land transfer, key government-invested projects, and major project implementation within the Business District, which, upon approval through prescribed procedures, serve as the basis for the relevant departments of the Municipality and the Four Districts to promote project implementation.

Article 17

The CBD Administration Committee shall formulate the corresponding norms for construction and administration in alignment with advanced international standards and in accordance with the requirements for building smart Hongqiao and achieving green and low-carbon development, city-industry integration, distinctive features, high quality, etc.

Article 18

This Municipality shall, by ing on developing the functions of large-scale transportation, big commerce and grand convention and exhibition, and focusing on key industrial fields and core development indicators, establish a statistical indicator system in line with the aim of creating an international central business district. The CBD Administration Committee shall, under the guidance of the municipal statistics department, strengthen cooperation with the Four Districts on statistic work in the light of the actual needs.

Article 19

This Municipality shall support the bonded warehouses and bonded logistics s in the Business District to play their role of bonded warehousing and logistics, and explore how to set up special customs supervision zones including integrated bonded zones that match such functions as high-end business, convention, exhibition and transportation.

Chapter III  International Business Services

Article 20

This Municipality shall give full play to the role of the Business District in gathering headquarters economy, convention and exhibition economy, innovation-driven economy and modern service industries, and promote the business services for conventions and exhibitions, business travel, finance and information consulting to be more international, professional and brand-oriented.

Article 21

This Municipality shall support the Business District to attract and cultivate regional headquarters of transnational corporations, trade-oriented headquarters, headquarters of central state-owned enterprises and private enterprises, implement more attractive opening-up policies, improve internationalized and professional services, and upgrade the capacity of the headquarters economy, so as to build a high-level agglomeration of the headquarters economy.

The CBD Administration Committee shall, in accordance with relevant standards, provide policy support for certified regional headquarters of transnational corporations, trade-oriented headquarters and headquarters of private enterprises.

Article 22

This Municipality shall encourage investors to set up regional headquarters and functional institutions of transnational corporations, and support them in gathering their business and expanding their functions in the Business District. These regional headquarters of transnational corporations are entitled to facilitated procedures concerning fund management, trade logistics, goods clearance by the customs, data flow, bringing in of talents, and entry and exit of personnel in accordance with law.

Qualified transnational corporations in the Business District are encouraged to carry out centralized operation of cross-border fund, and create an integrated capital pool in domestic and foreign currencies. Transnational corporations are encouraged to set up global or regional fund management s in the Business District.

Article 23

This Municipality shall support high-caliber trading entities in setting up trade-oriented headquarters in the Business District to tap both domestic and international markets, so as to improve their capital operation, scale up trade volumes and create new trade models.

Article 24

This Municipality shall support central state-owned enterprises in setting up headquarters or functional headquarters, research and development platforms and innovation-oriented consortiums in the Business District.

This Municipality shall support domestic private enterprises that carry out transnational investment and financing in applying to set up regional headquarters of transnational corporations and in establishing functional institutions including research and development, sales, logistics, and clearance s in the Business District.

The CBD Administration Committee shall establish a list of headquarters of private enterprises to be cultivated, and support enterprises in gathering their business and expanding their functions in the Business District, so that they can develop into the headquarters of private enterprises.

Article 25

The CBD Administration Committee shall, in accordance with the deployment of the State and this Municipality, coordinate to facilitate foreign enterprises and organizations’ participation in the CIIE and organize the Hongqiao International Economic Forum, so as to capitalize on the CIIE as a platform for international procurement, investment facilitation, cultural exchanges, and opening-up and cooperation.

Article 26

This Municipality shall support the Business District in developing the convention and exhibition economy to agglomerate world-renowned conventions and exhibitions and events, and bring in headquarters of world-famous convention and exhibition enterprises, domestic and overseas professional convention and exhibition organizations, conventions and exhibitions of international brands and related upstream and downstream enterprises, so as to scale up the convention and exhibition economy and develop the Business District as an important capital of international conventions and exhibitions.

The Business District shall innovate the modes of convention and exhibition services and enhance its international competitiveness in convention and exhibition technology, professional personnel, service capability, and administration system.

This Municipality shall support the Business District in establishing a development and coordination mechanism for the convention and exhibition industry and also a linkage mechanism for introducing and bidding for international conventions and exhibitions and events.

Article 27

This Municipality shall enhance the coordination between conventions and exhibitions and industries with a focus on pillar industries and leading industries, and promote docking between trading partners, projects and industries.

The Business District shall promote the translation of the convention and exhibition volumes into increments in regional consumption, trade and industries.

The Business District may formulate special policies to promote the development of the convention and exhibition economy, and offer targeted support to the convention and exhibition hosts and service providers, and convention and exhibition projects and talents.

Article 28

Professional service organizations of accounting, law, design, and consultancy that provide international services are encouraged to be based in the Business District to strengthen their role in supporting the convention and exhibition, commerce and trade, aviation, finance, medical service and health industries, so as to build an agglomeration of modern service industries.

Renowned overseas arbitral and dispute resolution institutions established in Lin-gang Special Area of China (Shanghai) Pilot Free Trade Zone are encouraged and attracted to set up branches in the Business District to carry out arbitrations on civil and commercial disputes in the fields of international commerce and international investment.

Article 29

Foreign investors are encouraged to set up investment institutions in the Business District, and facilitated services shall be provided concerning finance, talents and customs clearance to qualified foreign investment companies.

Premium investment institutions are supported to be based in the Business District. The CBD Administration Committee shall provide services for investment institutions in the Business District and cooperate with relevant departments in risk control.

Article 30

This Municipality shall encourage the Business District to agglomerate research and development s.

This Municipality shall support transnational corporations, domestic enterprises, research institutes, and universities in setting up in the Business District research and development s that conform to the industry development orientations.

This Municipality shall guide the research and development s to translate their research outcomes into practice, so as to serve the construction of “Two Extended Regions” and other regions of the Yangtze River Delta.

Chapter IV  New Platforms for International Trade

Article 31

This Municipality shall support the Business District in expanding trade functions to innovate and develop new types of international trade, gather high-level trade platforms and entities, promote in-depth integration of finance and trade, and strengthen support for the international trade industry, so as to build a new platform for the international trade .

Article 32

This Municipality shall support the Business District in building a global digital trade port, actively conforming to the new models, rules and standards of e-commerce, promoting the application of cloud services, digital content and digital services in the industries, and promoting cross-border e-commerce and other special digital trade. Efforts shall be made to build a national base for digital service exports.

Construction shall be accelerated of an agglomeration zone of digital trade cross-border services based mainly in the Business District to promote the digitalization transformation and facilitated development of the trade regulation. Explorations shall be made, in accordance with relevant laws, rules and regulations, to formulate catalogues of data of low-risk cross-border flows so as to promote safe and orderly cross-border data flows.

Article 33

This Municipality shall actively transform into regular regimes and arrangements according to law the policies on preferential taxes for exhibits, customs clearance supervision, funds settlement, investment facilitation, and personnel exit and entry during the CIIE, so as to enhance liberalization and facilitation of trade, unblock and improve the distribution channels for the CIIE commodities, build an import and export commodity distribution  radiating throughout the Asia-Pacific region, so that there will be continued and combined effects of the CIIE.

Article 34

This Municipality shall advance the construction of national demonstration zones for promoting and innovating import trade to drive innovations in trade policies, services and business models, optimize overall arrangements of functions, improve and perfect the multi-layered security system for trade, and achieve integration of import trade elements.

Article 35

The Business District shall provide better public services for construction projects under the Belt and Road Initiative, and provide enterprises with all-round and comprehensive services including information consulting, financing platforms, professional services, investment projects, talents service and risk prevention.

The Business District shall promote the construction of professional trade platforms and country-specific commodity s for Belt and Road countries and regions.

Article 36

This Municipality shall support various functional trade-and-investment facilitating platforms in being based in the Business District to form a multi-layered, multi-functional and open system of functional platforms, so as to support the innovation-driven development of the Business District.

This Municipality shall improve and optimize the service function of the Hongqiao Overseas Trade , attract social organizations that promote international trade, and provide high-level international trade services.

This Municipality shall establish display and trading platforms for imports and exports in the Business District to give full play to their functions of displaying bonded goods, pricing, information release, bonded logistics, etc.

Article 37

This Municipality shall strengthen the construction of the New Hongqiao International Medical , develop trade in medical services and establish a national demonstration base for health tourism. Public hospitals are supported in carrying out medical cooperation with the New Hongqiao International Medical  and exploring a scientific and reasonable mechanism on revenue distribution and use.

This Municipality shall support the Business District in introducing advanced medical institutions, medical research institutes, and technical personnel with expertise from home and abroad, in exploring institutional innovation in supervision over entry, inspection and testing, etc., and in accelerating the registration and listing of innovative medicine and medical equipment; it shall also support the establishment of research s for advanced-technology clinical research and application and the building of a cluster of life and health industries in the Business District.

This Municipality shall strengthen the construction of medical institutions in the Business District, provide support for access of medical services and for designated hospitals of basic medical insurance, and promote the innovation of commercial health insurance. The privately-run medical institutions in the Business District need only to perform the notification and commitment obligations when purchasing large category B medical equipment, and are entitled to support in accordance with state provisions when purchasing large category A medical equipment. Support shall be given to qualified medical institutions in the Business District that have self-developed and used in accordance with state provisions in-vitro diagnostic (IVD) reagents that have no like products in the Chinese market. The medical institutions in the Business District are encouraged to explore cross-regional and even cross-border medical cooperation and introduce medical technology, medicine and medical equipment in accordance with law.

Article 38

Qualified enterprises in the Business District may, in compliance with applicable laws, rules and regulations, open free trade accounts and develop new types of international trade, and relevant departments and organizations shall provide them with cross-border financial facilitation services including international settlement and trade financing.

Financial institutions are encouraged to provide enterprises and non-residents in the Business District with services including cross-border bond issuance, cross-border investment in mergers and acquisitions on the premise of legality, controllable risks and sustainable business. Enterprises are supported in operating cross-border RMB trade financing and refinancing services.

This Municipality shall facilitate services related to payment from capital accounts receipts for qualified enterprises in the Business District. When the qualified enterprises make payments of foreign exchange from capital accounts and payment of RMB from foreign exchange settlement within the mainland of China, they may make the payments against special certificates with qualified banks within the jurisdiction of this Municipality.

Measures to facilitate foreign exchange receipts and payments for goods trade and services trade shall be implemented in accordance with state provisions. Qualified banks shall, on the basis of fully understanding their clients and their clients’ business and performing due diligence, take facilitation measures including optimizing the examination of the documents of qualified enterprises.

Article 39

The CBD Administration Committee shall regularly formulate and release reports on “Hongqiao Openness Index” that reflect the degree of financial and trade facilitation, regional trade activity, the influence of conventions and exhibitions and events, etc.

The CBD Administration Committee shall establish and improve the relevant system for the collection, statistics and analysis of “Hongqiao Openness Index”, so as to give full play to the role of “Hongqiao Openness Index” in promoting the development of the Business District, advancing the construction of the Hongqiao International Opening-up Hub, increasing the country’s opening up to the outside world, and enhancing the new advantages of international competition and cooperation.

Chapter V  Integrated Transport Hub

Article 40

This Municipality shall strengthen the core functions of the Hongqiao Integrated Transport Hub across the board and enhance the core status of Shanghai as an international aviation hub. This Municipality shall be committed to establishing the rail transit system with which the Hongqiao International Opening-up Hub will connect with Pudong International Airport and the Yangtze River Delta and to improving the cooperation mechanism on international air transport, so as to build an unimpeded, convenient and comprehensive transport gateway that serves the Yangtze River Delta and connects with the outside world.

Article 41

This Municipality shall deepen the research on comprehensive transportation planning for the Business District to support the construction of roads which connect different zones of the Business District, improve the road traffic system in the Business District, arrange backbone bus lines that link up with the rail transit, expand coverage and connect surrounding areas so as to optimize the public transport layout in the Business District and the surrounding areas.

Article 42

The functions of international transport service of the Hongqiao International Airport shall be optimized and expanded, so as to promote the optimization of premium airlines that connect with major international aviation hubs.

The Hongqiao International Airport shall strengthen cooperation with surrounding airports, enhance cooperation in information sharing, operation management, flight diversion, emergency rescue, etc., and promote the development of multi-modal transport service, so as to better support the international service functions of the Hongqiao International Opening-up Hub.

Article 43

This Municipality shall promote the Hongqiao International Airport to be qualified as an import port of air transported complete vehicles and strengthen relevant support for this purpose. The qualified enterprises are supported in carrying out bonded maintenance and aircraft financial leasing in accordance with the authorization of the competent department of the State.

This Municipality shall support the Business District in developing the aviation service industry and its relevant supporting industries, and promote innovations of special regulations on key enterprises in the aviation service industry, so as to establish a global headquarters for aviation enterprises and a business district that enjoys an agglomeration of high-end airport-related service industries.

Article 44

The municipal transportation department shall strengthen coordination and communication with relevant departments of the State and transportation departments of other areas in the Yangtze River Delta to enhance the outward radiation effect and distribution capacity of the Hongqiao Railway Station. The municipal transportation department shall improve the rail transit networks connecting major cities of the Yangtze River Delta, promote coordination in cross-regional rail transit planning, and perfect the construction models and operation mechanisms, so as to facilitate the integration of cross-regional rail transit in the Yangtze River Delta.

Article 45

This Municipality shall actively advance the construction of intelligent transportation at the Hongqiao Integrated Transport Hub and achieve digitalization transformation and upgrading of all travel modes, all application scenarios and the whole management process, so as to establish a digitalized intelligent transportation ecosystem.

Article 46

The CBD Administration Committee shall, jointly with the municipal transportation department, organize and coordinate the management of traffic facilities within the Hongqiao Integrated Transport Hub.

The entities responsible for operation and management of the transportation facilities within the Hongqiao Integrated Transport Hub shall carry out operation and maintenance of these transportation facilities in accordance with the technical standards and regulations of the State and this Municipality.

The transportation infrastructure in the Business District shall be managed and maintained by the relevant municipal and district departments, and the municipal transportation department and the CBD Administration Committee are responsible for coordination between them and supervision over their work.

Chapter VI  City-Industry Integration

Article 47

The Business District shall build a supporting service system for both business and living that is characterized by a reasonable layout, full-range functions, and high quality and efficiency, and solidify the foundations for regional green and low-carbon development, so as to build a demonstration area for showcasing city-industry integration with an intensive and efficient production space, a convenient and fully-equipped living space, and a comfortable and pleasing ecological space.

Article 48

This Municipality shall support the Business District in constructing quality supportive facilities for public service, and creating a living environment congenial for living, working, traveling and studying by relying on high-quality communities, cultural facilities and urban parks.

This Municipality shall support the Business District in increasing the supply of government-subsidized rental housing (GSRH) by means of constructing new GSRH, reconstructing the existing housing, or constructing a certain proportion of GSRH which commercial developers are required to in all the housing they construct.

Article 49

Backed by the Hongqiao International Opening-up Hub and the Hongqiao sub-, an area shall be built featuring an agglomeration of international-class consumption and a number of new landmarks for high-quality consumption.

Enterprises are encouraged to build s for launching and exhibiting mid-to-high-end consumer goods in the Business District and to develop new business forms including smart retail, crossover retail and green retail to boost the building of Shanghai into an international consumer  and an important commercial and circulation  that connects with the Asia-Pacific region, opens to the rest of the world, and exerts influence in the domestic Chinese market.

Article 50

The Business District shall provide effective, convenient, and quality social and public services. Social and public affairs including education, public health, public security, social security, and public legal services within the Business District shall be subject to the administration of the relevant localities, over which the CBD Administration Committee shall be responsible for guidance, coordination and supervision.

This Municipality shall accelerate the overall arrangements of major cultural and athletic projects in the Business District and introduce a number of influential cultural and athletic events, so as to upgrade the public services to an internationalized level.

Article 51

The CBD Administration Committee shall, jointly with relevant departments of the Municipal People’s Government, guide and coordinate the People’s Governments of the Four Districts to further refine their urban management.

The CBD Administration Committee shall, jointly with relevant departments and administrative agencies of the Municipal People’s Government and the People’s Governments of the Four Districts, formulate construction and management standards on roads, landscaping, city appearance and environmental sanitation, rivers and other watercourses, engineering facilities, outdoor advertisements, shop signboards, landscape lighting, etc. for which relevant working mechanisms shall be established and implemented.

The CBD Administration Committee shall accelerate the promotion of smart urban management and carry out integrated construction and maintenance management, so as to improve the environment and overall quality of this city.

Article 52

The Business District shall promote in-depth integration of high-end businesses, conventions and exhibitions, and the transport functions, deepen the reform “to streamline administration and delegate power, improve regulation, and upgrade services”, and improve the new-type oversight mechanism characterized by “supervision through random inspections by randomly selected inspectors and prompt release of the inspection results” as the basic method, “supervision over important targets” as an additional method, and “credit-based supervision” as the foundation. The Business District shall improve the inclusive and prudent supervision that is compatible with innovation and creation, and fully implement the list of minor offences not to be punished in accordance with the law, so as to accelerate the building of a business environment which is market-oriented, law-based and internationalized.

Article 53

The Business District shall take advantage of such government service platforms as the “Government Online-Offline Shanghai”, the city operation platform of the “Integrated Online Administration” and the Special Path for International Internet Data to strengthen the development of first-class digital infrastructure, encourage the promotion and application of new-generation communications technologies, and develop application scenarios for business and trade, transportation organization, city operation, industrial development, etc. The Business District shall leverage such means as digital bases, empowered platforms, and digital economy to explore the construction models of digitalized city transformation with Hongqiao characteristics and promote the formation of a functional system with smart transportation, smart conventions and exhibitions, smart business, and smart living, so as to build a smart Hongqiao.

Article 54

This Municipality shall advance the development of functional zoning in the Business District in line with the concept of green and low-carbon development.

The CBD Administration Committee shall make overall arrangements to guide the construction of a sponge city and green ecological urban areas, guide the construction and application of energy systems in line with the requirements on green and low-carbon development, and establish and further expand the coverage of an administrative platform on low-carbon and energy-efficient operations. The owners of buildings in the Business District are encouraged to obtain the label for green building operations.

Chapter VII  Serving the Integrated Development of the Yangtze River Delta

Article 55

This Municipality shall build platforms in the Business District to provide services for enterprises and projects in the Yangtze River Delta. The CBD Administration Committee shall coordinate and enhance the cooperation on matters associated with the Yangtze River Delta in the Business District and take advantage of the functional platforms of trade shows and exhibitions, so as to promote quality brands from the Yangtze River Delta to cluster in the Business District.

Article 56

This Municipality shall support the Business District in promoting the sharing of public services in the Yangtze River Delta and provide convenient and reliable services for various market entities in the Yangtze River Delta to connect with the international market in the fields of intellectual property protection, legal services related to international trade, and international commercial arbitration.

In the Business District the municipal department of intellectual property shall open windows for trademark services for enterprises in the Yangtze River Delta, to provide enterprises in the Yangtze River Delta with services on registration, renewal, modification, and transfer of trademarks.

Foreigners who are hired or recruited in accordance with law by enterprises registered in the Yangtze River Delta and filed with the functional platforms of the Business District may apply for foreigners’ work permits in this Municipality.

Article 57

This Municipality shall strengthen cooperation and communication with other parts of the Yangtze River Delta in government services to improve the working mechanism of “inter-provincial government services”, and to promote reciprocal recognition of electronic certificates and sharing of data resources in the Yangtze River Delta, so as to create high-frequency and high-quality scenario-based applications in the Business District.

Article 58

This Municipality shall establish, in a market-oriented manner, investment funds for serving the integrated development of the Yangtze River Delta that are mainly used for investment in major infrastructure construction projects, development of scientific and technological innovation-oriented industry platforms, and integration of public service information systems in the Hongqiao International Opening-up Hub.

Article 59

This Municipality shall build an exhibition  in the Business District to showcase cities in the Yangtze River Delta, and coordinate with other cities in the Yangtze River Delta to jointly build the “Hongqiao International Reception Hall”.

Chapter VIII  Services and Guarantee

Article 60

This Municipality shall establish a mechanism of ensuring land for special purposes corresponding to the development of the Business District.

This Municipality shall, at the municipal level, give priority guarantee for land quotas for major projects in the Business District. The development intensity and capacity of the key areas of the Business District shall be rationally determined in accordance with the construction standards of central urban areas and on the basis of the projection of the total population and the orientation of industrial functions. This Municipality encourages mixed and multi-purpose utilization of land for such sectors as industries, warehousing, and research and development in the Business District.

A mechanism for dynamically adjusting commercial and residential lands shall be implemented, to allow the already existing but inefficiently-used commercial and office buildings in the Business District to be transformed for a rental purpose in accordance with procedures.

The Business District shall explore approaches for land-management reforms and innovations such as vertical development of urban underground space capacity and multi-layer land use rights, and establish separate land use rights to the spaces above, on and below the ground of the construction land.

Article 61

This Municipality shall establish special development funds for the Business District, guaranteed by the municipal finance department and the Four Districts’ finance departments, and the funds shall be mainly used to optimize the layout planning and regional functions, gather high-end industries and top talents, improve public facilities and services, and improve the ecological environment and regional living standards.

Article 62

Part of the revenue obtained by the Four Districts from the assignment of state-owned land use rights within the Business District may be used for infrastructure construction within the Business District.

Special bonds issued by local governments shall be used preferably for qualified major projects within the Business District.

The newly-established municipal-level industry investment funds invested in by governments are encouraged to be based in the Business District.

Qualified projects in the Business District may carry out real estate investment trusts (REITs) on a pilot basis. The Business District shall set up platforms for docking project resources to support intermediary agencies of law, accounting, taxation, asset appraisal, etc. to provide professional services for REITs projects. The Four Districts are encouraged to provide subsidies for the intermediary costs incurred for the issuance of REITs.

Instrumentation of accounts receivable and the pilot financial service mechanism of “Discounting Commercial Papers” (tie xian tong) shall be promoted in the Business District.

Article 63

This Municipality shall support the Business District in carrying out pilot programs in innovating an intellectual property protection mechanism for convention/exhibition events. This Municipality shall provide whole-process services and support for intellectual property protection of large-scale international convention/exhibition events including the CIIE, so as to explore more accurate, efficient and convenient working modes for prompt protection and handling of intellectual property rights involved in the convention/exhibition events in the Business District.

The Business District shall encourage commercial banks, guarantee institutions, insurance institutions, etc. in providing enterprises in the District with innovative financial services on intellectual property including the property’s securitization, pledge and financing, and insurance. Relevant social organizations and intellectual property service institutions are encouraged to provide enterprises in the Business District with professional services including monitoring over intellectual property infringements, risk warning, evidence collection, evaluation and pricing, dispute mediation, and assistance in rights protection.

Article 64

This Municipality shall create a high-level international  of talents and build the Hongqiao International Business Talents Port, so as to attract professional, international and innovative talents to gather in the Business District through functional platforms including China Shanghai Human Resources Service Industrial Zone’s Hongqiao Park.

Relevant departments shall strengthen the construction of the immigration policy practice base in the Business District and carry out innovative management of international talents, so as to provide facilitated services on visa, work, residence, permanent residence, etc. for high-level overseas talents’ work and relevant exchanges and cooperation in China, and provide foreign talents with immigration and assimilation services including information consulting, legal services, and language and culture services.

The CBD Administration Committee may recommend high-level foreign talents, urgently needed talents and qualified foreign investors working in the Business District to apply for permanent residence, whose foreign spouses and minor children may also submit such accompanying applications. Convenient use of foreigners’ permanent residence identity cards shall be promoted to facilitate the holders’ residence, study and work in the Business District.

Article 65

Qualified foreign university graduates may apply for foreigners’ work permits with the employment certificates issued by the Business District.

This Municipality shall, in accordance with the requirements of the State, gradually loosen the restrictions on foreigners’ employment in such fields as finance, architecture, planning and design in the Business District, and provide facilitated services concerning their residence and practicing in the Business District.

Article 66

This Municipality shall support the Business District in introducing international higher education resources in line with relevant policies of the State and the Municipality as well as the functional positioning of the Business District, and in carrying out cooperation in aspects including institutions, training and teachers, so as to cultivate high-quality internationalized talents.

Premium schools for foreigners’ children shall be established in the Business District to provide quality international education. Qualified schools for foreigners’ children are encouraged to enroll students across the country.

Article 67

This Municipality shall set the stage for attracting various high-level talents who meet the functional positioning of the Business District. The qualified talents at home and abroad brought in by the employers in the Business District are entitled to favorable policies for talents to apply for permanent residence in this Municipality, etc. in accordance with relevant provisions.

Chapter IV  Supplementary Provisions

Article 68

“One Core” refers to relevant areas of Minhang District, Changning District, Qingpu District, and Jiading District that fall in the Business District, covering a total area of 151.4 square kilometers.

“Two Extended Regions” refer to a northward extended region and a southward extended region, both with the Business District as the core and the starting point. The northward extended region covers the Hongqiao Business District - Changning District - Jiading District - Kunshan City under the administration of Suzhou City - Taicang City under the administration of Suzhou City - Xiangcheng District of Suzhou City - Suzhou Industrial Park; and the southward extended region covers the Hongqiao Business District - Minhang District - Songjiang District - Jinshan District - Pinghu City under the administration of Jiaxing City - Nanhu District of Jiaxing City - Hanyan County of Jiaxing City - Haining City under the administration of Jiaxing City.

Article 69

These Regulations shall be effective as of November 1, 2022.
