Legal Basis

1. Article 12 of the Regulations of the Peoples Republic of China on Chinese-foreign Cooperative Education (Decree No. 372 of the State Council, as adopted at the 68^th executive meeting of the State Council on February 19, 2003): Applications for establishing Chinese-foreign cooperatively-run vocational schools shall be subject to the examination and approval of administrative departments of labor under the peoples governments of the provinces, autonomous regions, and municipalities directly under the central government of the places where the schools to be established are located.
2. Article 11 of the Measures for the Administration of Chinese-foreign Cooperative Education on Occupational Skills Training (Order No. 27 of the Ministry of Labor and Social Security, as adopted at the 15^th executive meeting of the Ministry of Labor and Social Security on July 19, 2006): The establishment of a Chinese-foreign cooperatively-run vocational school shall be subject to the examination and approval of the administrative department of labor and social security of the peoples government of the province, autonomous region, or municipality directly under the central government where the school under planned establishment is located.

(I) Acceptance. In order to apply for preparing the establishment of a Chinese-foreign cooperatively-run vocational school, the Chinese education and training institution shall file an application and submit relevant application materials to the functional department responsible for vocational training management of the approval body for acceptance.
 (II) Examination and approval. Upon acceptance of the application, the approval body shall organize the experts or entrust a qualified social intermediary to review the application and give review comments. The required review period shall be notified to the applicant by the approval body and shall not be included in the approval period.
 (III) Decision. For an application for preparing the establishment of a Chinese-foreign cooperatively-run vocational school, the approval body shall decide whether or not to approve it within 45 working days from the date of acceptance of the application, and notify the applicant of such decision in a timely manner. In case of disapproval, the reasons shall be explained in writing.
 (VI) Issuance. When approving the preparation of establishment of Chinese-foreign cooperatively-run vocational school, the approval body shall issue a letter of approval for preparation of establishment.
