1. The application materials shall be sequenced in the order as set out in the List of Application Materials in this Guide;
2. The documents prepared by the Applicant are printed with A4 papers, and those issued by the government and other authorities shall be provided in the size(s) as the original(s);
3. Copies of the application materials shall be clear and legible.

Legal Basis
Article 3 (1) of Circular of MOFTEC Concerning the Establishment of Foreign-funded Research and Development Center (WJMZF [2000] No. 218): The establishment of all Sino-foreign equity joint, Sino-foreign cooperative and wholly foreign-owned R&D centers with foreign investment shall be examined and approved by provincial approval bodies.

(I) Business description
Processing link: The handler is responsible for examination and approval, the head of relevant office is responsible for review, and the relevant director is responsible for issuance.

The applicant shall have the following rights according to laws:
1. The applicant has the right to know the processing procedures and the basis of approval;
2. The applicant has the right to know the progress of approval of relevant project;
3. The applicant has the right to require the approval body to keep project information confidential;
4. The applicant has the right to withdraw the application before the approval decision-making;
5. The applicant has the right to lodge a complaint, administrative review and administrative litigation.
The applicant shall have the following obligations according to laws:
1. The applicant shall submit relevant truthful materials;
2. The applicant shall disclose the facts to the approval body;
3. The applicant shall timely supplement or modify relevant materials as required by the approval body.

Question: What preferential policies are applied to foreign-invested enterprises accredited as research and development centers?
Answer: They may enjoy relevant encouragement policies in accordance with the Several Opinions of Shanghai Municipality on Encouraging the Development of Foreign-Funded Research and Development Centers (HFBF [2015] No. 42), the Several Opinions of Shanghai Municipal Peoples Government on Further Supporting Foreign-Funded Research and Development Centers in Participating in Shanghais Building of Globally Influential Science and Technology Innovation Center (HFF [2017] No. 79) and other documents.
Common Unacceptable Sample
I. For application letterhead, Shanghai Municipal Commission of Commerce is written as Foreign Investment Promotion Office of Shanghai Municipal Commission of Commerce or the name of any other department by mistake.
II. The application materials are incomplete.
III. There are not signatures and seals of investors and/or foreign-invested enterprises and the dates of signature in the application materials (including application, contract and the articles of association).
IV. In case of the application materials signed by senior executives authorized by legal representative of the enterprise, no effective power of attorney is provided.
V. Where the originals of application materials should be provided, there are only their copies or colorful photocopies.
VI. The same application document (e.g.: Contract / the articles of association) has inconsistent categories of paper and front sizes.
