Legal Basis

Article 1 of the Implementation Measures for the Confirmation and Assessment of Export Enterprises and Technologically Advanced Enterprises with Foreign Investment (WJMZF [1996] No. 822): All Sino-foreign equity joint ventures, Sino-foreign cooperative ventures and wholly foreign-owned enterprises established within the territory of China in accordance with law (collectively, foreign-invested enterprises) that meet theProvisions of the State Council and the conditions for two-type enterprises in the Implementation Measures may be entitled to the relevant treatment granted under the Provisions of the State Council after they have been confirmed, assessed and obtained certifications. Article 6: Organs for confirming application for two-type enterprises shall be foreign economic relations and trade departments of provinces, autonomous regions, municipalities directly under the central government, cities with separate entries in national plans and special economic zones (hereinafter referred to as examination and confirmation organs).

Question: What foreign-invested enterprises can be accredited as technologically advanced enterprises?

Answer: (I) Foreign-invested manufacturing enterprises: 1. They are the encouraged productive projects as prescribed in the Catalogue for the Guidance of Foreign Investment Industries; 2. they adopt international advanced and applicable processes, technologies and equipment; 3. they are in leading position domestically in terms of product quality and technical performance; and 4. they have come into service for more than 5 months. (II) Other non-manufacturing enterprises; (III) High-tech development enterprises.

Common Unacceptable Sample

I. For application letterhead, Shanghai Municipal Commission of Commerce is written as Foreign Investment Promotion Office of Shanghai Municipal Commission of Commerce or the name of any other department by mistake.

II. The application materials are incomplete.

III. There are not signatures and seals of investors and/or foreign-invested enterprises and the dates of signature in the application materials (including application, contract and the articles of association).

IV. In case of the application materials signed by senior executives authorized by legal representative of the enterprise, no effective power of attorney is provided.

V. Where the originals of application materials should be provided, there are only their copies or colorful photocopies.

VI. The same application document (e.g.: Contract / the articles of association) has inconsistent categories of paper and front sizes.
