1. The application materials shall be sequenced in the order as set out in the List of Application Materials in this Guide;

2. The documents prepared by the Applicant are printed with A4 papers, and those issued by the government and other authorities shall be provided in the size(s) as the original(s);

3. Copies of the application materials shall be clear and legible.

Formal Standards

The applicants of this administrative confirmation matter should provide applications materials required. The application materials should contain all necessary contents and be in valid form.
1.The applicant should, as required by the Marriage Registration Regulations, receive the marriage registration statement at the reception hall of the Shanghai Marriage (Adoption) Registration Center. They should complete the statement on-site. The template of the statement could be downloaded from the Form Downloading column of http://mzj.sh.gov.cn/, for reference.
2.Submit application materials in accordance with the instructions The information in the statement should be exactly the same as the information in the identity document.
3. Valid documents are documents issued by the competent departments with the true contents within the validity period.

Legal Basis
Article 8 of Marriage Law of the Peoples Republic of China: Both the man and the woman who want to get married must register their marriage with the marriage registration office in person. If the proposed marriage is found to conform with the provisions of this Law, the couple shall be allowed to register and issued marriage certificates. The husband and wife relationship shall be established as soon as they acquire the marriage certificates. Those who live as husband and wife without registration shall go through remedial registration procedures.
Article 35: After divorce, if both the man and the woman wish to resume their husband-wife relationship, they must go to the marriage registration office for registration.
The Regulation on Marriage Registration
Article 2.2: The registration office involving of Chinese citizens marriage with foreigners, and mainland residents marriage with the residents of the Hong Kong Special Administrative Region (hereinafter referred to as Hong Kong residents), residents of the Macao Special Administrative Region (hereinafter referred to as Macao residents), Taiwan regional residents (hereinafter referred to as Taiwan residents), and overseas Chinese is an office that is established and managed by the provincial, autonomous regional and municipal peoples government or by the civil affairs departments of the provincial, autonomous regional and municipal peoples government.
Article 4.2: Where Chinese citizens marrying foreigners in Chinese Mainland, Chinese Mainland residents marrying Hong Kong residents, Macao residents, Taiwan residents, and overseas Chinese in Chinese Mainland, both the men and women should go to the marriage registration organ in permanent registered residences location of the Chinese Mainland residents for registration.

Service description:
(1) Procedures: Shanghai Marriage (Adoption) Registration Center conducts the administrative confirmation of the application of marriage (restoration of marriage) by the applicants. Based on the on-site processing procedures, the staff ask both applicant about their willingness, check their certificate and supporting materials, and determine immediately if to permit their application. If permit, the staff enter the basic information of the applicant in the national marriage registration system, produce the marriage license and grant on-site.

Question: Do the marriage registration applicants need to go to the registration office in person for such registration?
Answer: Yes.

Common Unacceptable Sample

1.Common mistake: Marital status is not clearly stated in the certificate of no spouse.
Correct action: According to Document MH (2008) No.49, the no spouse certificate should specify unmarried, divorced, widowed, single and other words indicating the status of no spouse.
2Common mistake: The no spouse certificate is not translated into Chinese.
Correct action: According to Document MBH (2008) No.276, if being in foreign languages, the no spouse certificate should be attached with Chinese translation by qualified translation institutions and the duplicate of business license of such institution affixed with its official seal.
