Legal Basis

Item (1) of Article 3 of the Notice of the Ministry of Foreign Trade and Economic Cooperation on Issues Regarding Establishing Foreign-funded Research and Development Centers (Waijingmaozifa [2000] No.218): The establishment of foreign-funded R&D centers in the forms of joint venture, cooperative joint venture and sole proprietorship shall be subject to the examination and approval of provincial authorities.

Q: What preferential policies are available to accredited foreign-funded R&D centers?

A: Relevant preferential policies are provided according to the Several Opinions of Shanghai Municipality on Encouraging the Development of Foreign-funded Research and Development Centers (Hufubanfa [2015] No.42), the Several Opinions of Shanghai Municipal People’s Government on Further Supporting Foreign-funded Research and Development Centers to Participate in Building Shanghai into a Scientific and Technological Innovation Center with Global Influence (Hufufa [2017] No.79), etc.

 

Common Unacceptable Sample

1. Miswrite the name of “Shanghai Municipal Commission of Commerce” on the Application Form as “Foreign Capital Department of Shanghai Municipal Commission of Commerce” or other departments’ names;

2. Incomplete application materials;

3. Omit the signature and/or seal of the investor and/or the foreign-funded enterprise or the signature date in the application materials (including the Application Form, contract, articles of association, etc.);

4. Fail to provide effective power of attorney when the legal representative of the enterprise authorizes senior management to sign the application materials;

5. Only provide the copy or colored copy when the original document should be provided;

6. Inconsistent paper or font size in the same application material (such as contract/articles of association).
