Notice of Shanghai Municipal Public Security Bureau on Issuing the Procedures for Accommodation Registration for Overseas Personnel

Attention:all branch offices, departments of the municipal bureau, and public security offices (bureaus):

We hereby issue to you the Procedures for Accommodation Registration for Overseas Personnel and request you to implement them conscientiously. In case of any problem, please make timely contact with the Municipal Exit-entry Administration Bureau.

Procedures for Accommodation Registration for Overseas Personnel

Article 1 With a view to effectively promoting the entry and exit administration service abilities of this Municipality, further standardizing the accommodation registration of overseas personnel, these Procedures are formulated in accordance with the Exit and Entry Administration Law of the People’s Republic of China, Procedures for the Administration on Travel of Chinese Citizens to and from Taiwan Region, Interim Procedures for the Administration on the Travel of Chinese Citizens to and from the Hong Kong Region or the Macao Region for Private Purposes, Regulations of the Peoples Republic of China on Consular Privileges and Immunities, Procedures of the Local Police Stations for the Management of Accommodation Registration for Aliens (trial) and other relevant provisions, and in the light of the actual circumstances of this Municipality.

Article 2These Procedures shall apply to overseas personnel that register for residence or lodging in habitations other than hotels of this Municipality.

The overseas personnel as used in these Procedures refer to foreigners and residents of Hong Kong, Macao and Taiwan, not including consular officers and administrative/technical personnel in the consulates who are exempted from the obligation of accommodation registration according to law.

These Procedures shall not apply to overseas personnel who dwell in the hotels in this Municipality. Hotels shall, in accordance with the relevant provisions on the administration of public security in the hotel industry, handle the accommodation registration for overseas personnel and submit the registration information to the local public security organ.

Article 3 Public security organs shall facilitate the accommodation registration for overseas personnel, widen the channels for registration, simplify the registration materials, and prompt the overseas personnel to apply for accommodation registration upon their entry.

Article 4Overseas personnel shall, within 24 hours after checking in, go through the registration process by himself or the person who accommodates him. Residents of Hong Kong, Macao and Taiwan therein who lodge or stay in rural areas may register for accommodation within 72 hours after check-in.

Article 5 The following channels may be used for the accommodation registration for overseas personnel:

1. the public security service windows, such as the household registration service windows set up in the police stations and the public security service windows stationed in the community affairs acceptance service center of the sub-district, town and communities (hereinafter referred to as the public security window);

2. the socialized declaration platform set up in service stations for overseas and such immigration and entry and exit service centers (hereinafter referred to as the socialized declaration platform); and

3. the self-declaration platform set up on Internet such as portal websites and mobile device application software (hereinafter referred to as the "self-declaration platform").

Article 6Those who apply for accommodation registration through the public security window or the socialized declaration platform shall submit valid identity documents and residence certificates of the overseas personnel for examination. In case that an overseas personnel is not able to provide the residence certificate, but the application records are verified authentic by the public security organ, the overseas personnel may make a real and effective written commitment on the spot for accommodation. Where an overseas personnel entrusts another person to handle the registration or the registration is handled by the host who accommodates him, the valid identity certificate of the entrusted person or the host shall be provided.

Those who apply for accommodation registration through the self-declaration platform shall submit relevant materials according to the system prompts.

Article 7A foreign baby that was born in China and does not have a valid residence (stay) certificate may apply to the exit and entry administration department for residence (stay) certificate first, and report the accommodation registration through the public security window or the socialized declaration platform with the receipt of acceptance.

Aliens who have lost their entry/exit documents may first report the loss to the exit and entry administration department and handle the accommodation registration with the loss receipt; residents of Hong Kong, Macao and Taiwan who have lost their exit/entry documents may apply to the exit and entry administration department for replacement of their exit/entry documents and handle the accommodation registration with the acceptance receipt.

Article 8Those who apply for accommodation registration through the public security window or the socialized declaration platform and whose identities are verified to be authentic, valid and complete, shall be handled by the unit that accepts the application on the spot and issues the Registration Form of Accommodation for Overseas Personnel; if their materials do not conform to the provisions, registration shall be made first, then the overseas personnel shall be informed on the spot of the materials that shall be supplemented.

Those who fulfill accommodation registration through the self-declaration platform shall, after the approval of system, download the electronic file of Registration Form of Accommodation for Overseas Personnel and print it out according to self needs.

If the Registration Form of Accommodation for Overseas Personnel is lost, it may be reissued or reprinted through the original application channel.

Article 9Overseas personnel shall truthfully apply for accommodation registration. Those who resort to fraud or falsehood shall bear the corresponding legal liabilities according to law and shall not be provided with such convenient services as self-declaration or exemption from submission of residence certificate when re-applying for their accommodation registration.

Article 10The list of valid identity documents and residence certificates for overseas personnel affirmed by these Procedures shall be determined by the exit-entry administration bureau of the municipal public security bureau and made public.

Article 11These Procedures shall be effective as of April 1, 2020.

The Procedures of Shanghai Public Security Police Station for the Administration of Accommodation Registration for Overseas Personnel (SMPSB D No. 46 [2008]) shall be repealed simultaneously.
