Applicants shall finish the application process on the Government Online-Offline Shanghai platform where digital documents shall be submitted to the platform according to requirements. Complete documents presented in compliance with law will be handled. The Shanghai Municipal Ecology and Environment Bureau shall carry out examination and approval work in accordance with subscribed procedures. However, examination and approval for classified construct projects shall not be handled on the online platform.

1. What are the individual responsibilities of municipal and district ecology and environment bureaus on the examination and approval work?

Division of work and responsibilities shall be implemented in accordance with the List of Construction Projects for EIA Examination and Approval by the Shanghai Municipal Environment Protection Bureau (2016 Version).

2. How to formulate public disclosure documents, including EIA documents and Situation Presentation on Public Engagement?

According to the relevant prescriptions specified in Article No. 5 of the Measures on Public Engagement of EIA of Construction Projects in Shanghai (Trial), part of document that contains state secrets, trade secrets and personal privacy in the EIA documents and Situation Presentation on Public Engagement as well as information that may endanger national, public and economic security and social stability upon disclosure, shall be redacted.

3. How to get updated of the current condition of the EIA approval?

Since Oct. 1, 2019, current condition of EIA approval can be checked on the Government Online-Offline Shanghai.

4. Is there any requirements on the qualification of organization of EIA issuance?

According to relevant prescriptions in the EIA Law of China, there is no requirements on the qualification of organization of EIA issuance.

5. How to provide documents for initiative information disclosure?

EIA information posted on websites, newspaper or bulletin boards can be taken picture or screen captured to formulate the documents for initiative information disclosure. The documents shall be attached with stamps of the construction company before submission.

6. How to apply for EIA approval?

Since Oct. 1, 2019, applicants have been able to log in the website of Shanghai Municipal People’s Government to fill in the application form of approval on the “EIA document approval of construction projects” site in the Government Online-Offline Shanghai column. Digital version of documents shall also be uploaded.

7. How to obtain the statement on source of total volume?

Quota of total volume shall be applied from competent ecology and environment department according to the total volume measured in the EIA documents.

(6) Common mistakes

1. Common mistake: Stamps are not attached on the application form.

Correct practice: Stamps shall be attached at the space for “construction company” on the last page of the application form.

2. Common mistake: Digital version of basic information form of EIA approval for construction projects is not filled according to the prescribed form.

Correct practice: The EXCEL version of basic information form of EIA approval for construction projects can be downloaded in the form downloading column in the Government Online-Offline Shanghai platform. The form shall be filled according to requirements in the form and submitted in digital form. No hard copy is required.
