(1) Principles and procedures for filing

Filing work for inter-provincial transportation and recycling of general solid waste is carried out in accordance with the principles of “municipal-level platform, review and approval by the local administration, clarification of origin and destination of the waste, exchange of information, joint efforts by multiple departments”.

For inter-provincial transportation and recycling of general solid waste, the local organization that generates or collects the solid waste (hereinafter referred to as Organization of Waste Transportation) shall go through the filing process at the ecology and environment authorities at Government Online-Offline Shanghai in accordance with this Notice before waste transportation. Transportation should be done after filing is approved.

The Organization of Waste Transportation shall fill in authentic and accurate information concerning inter-provincial transportation and recycling of waste in the Government Online-Offline Shanghai platform. Documents for filing shall also be submitted and the filing period, which shall be no more than 12 months in principle, shall be decided according to the term of contract. The Organization of Waste Transportation shall submit its filing application to the ecology and environment department of the place where the facility of waste generation or waste collection is located. The Organization of Waste Transportation shall be responsible for the authenticity, completeness and validity of the documents it submits. For inter-provincial transportation and recycling of demolition waste, filing application form shall be submitted to competent authorities including the municipal landscaping and city appearance administration bureau for stamps and approval.

The competent ecology and environment authorities shall examine the documents that are submitted by the Organization of Waste Transportation and shall issue the digital filing form and corresponding filing No. on the Government Online-Offline Shanghai platform for applications with complete and consistent filing documents, clear waste origin and category, reasonable destinations and usage of waste as well as authentic and valid contracts. Upon approval of the filing application, the Organization of Waste Transportation shall transport and recycle the waste in accordance with the approaches specified in the filing. The municipal ecology and environment authorities shall summarize the filing work of inter-provincial transportation and recycling of general solid waste on a monthly basis, and report to the provincial ecology and environment department of the receiving side as well as the municipal competent authority of the industry.

(2) Situation where re-filing is required

In case of following situation, the Organization of Waste Transportation shall apply for re-filing, and shall transport the solid waste according to approaches specified in the filing upon approval of the re-filing:

1. The filing has expired or volume of waste exceeds that approved in the filing;

2. There is inconsistency between the category, main components, ways of transportation, ways of recycling and what is registered in the filing.

3. There is report from the ecology and environment authorities of the place of waste reception that the waste shall not be transported.

4. There is other situation that the enforcement and supervision departments deem not suitable for waste transportation.

(3) Functions and responsibilities

The ecology and environment authorities shall provide quality services for enterprises, and designate staff to handle filing applications in a timely manner. They shall also urge the organizations of waste transportation to implement their responsibilities, strengthen regulation on environment as well as local waste recycling organizations reported by other provinces and cities according to law with timely report to relevant authorities.

The landscaping and city appearance administration authorities are responsible for: 1. the whole-process administration of residual and construction waste; 2. filing and examination of the inter-provincial recycling plans on abolition waste generated during construction as well as urging the organization of waste transportation to finish filing process at the ecology and environment authorities; 3. confirmation of waste transfer stations and distribution sites in the “two integrated networks” and report to the ecology and environment authorities. The commerce department is in charge of administration of industry of recyclables, by strengthening the regulation on destinations of recyclables. The water authorities are in charge of administration of all kinds of sewage sludge generated during municipal construction including that in  sewage treatment works in the city. The economy and informatization authorities are in charge of promoting comprehensive recycling of industrial solid waste. The traffic and transportation authorities are in charge of administration of for-profit transportation companies. The Shanghai Maritime Safety Administration is in charge of administration of solid waste transportation in area within its jurisdiction.

Authorities in charge of ecology and environment, landscaping and city appearance, construction and management, commerce, water, economy and informatization as well as traffic and transportation at both municipal and district levels shall implement their functions and responsibilities according to law, strengthen advocacy of the newly amended Law of Prevention and Control of Environmental Pollution by Solid Waste, improve information exchange and form joint regulation efforts.
